How to Enter

To be eligible to claim, individuals must 'Like' the Smarthouse Facebook page, and 'Follow' the Smarthouse Twitter page.There is one prize to be won, and entries close 31st March 2013. All entriesmust be entered online.

Instructions on how to claim and the rewardform part of these Terms and Conditions. Participation in this promotion isdeemed acceptance of these Terms and Conditions. Offer not valid in conjunctionwith any other offer.

Claims are only open to Australianresidents. Entrants under 16 years old must have parental/guardian approval toenter and further, the parent/guardian of the entrant must read and consent toall terms and conditions. Parents/guardians may be required by the Promoter toenter into a further agreement as evidence of consent to enter this Promotion.

Employees (and their immediate families) ofthe Promoter 4Square Media Pty Ltd and agencies associated with this promotionare ineligible to claim. Immediate family means any of the following: spouse,ex-spouse, de-facto spouse, child or step-child (whether natural or byadoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt,niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

The Promoter reserves the right, at anytime, to verify the validity of entries and claimants (including a claimant’sidentity, age and place of residence) and to disqualify any claimant whosubmits an entry that is not in accordance with these Terms and Conditions orwho tampers with the entry process. Errors and omissions may be accepted at thePromoter's discretion. Failure by the Promoter to enforce any of its rights atany stage does not constitute a waiver of those rights.

Incomplete or indecipherable claims will bedeemed invalid.Multiple claims permitted, subject to the following: (a) onlyone (1) claim permitted per specified purchase requirement; (b) each claim mustbe submitted separately and in accordance with claim requirements; and (c) amaximum of two (2) claims per household are permitted. Offer is strictlylimited to the first 20,000 valid claims received.

Successful claimants will be notifiedimmediately online and subsequently by email.

The Promoter’s decision is final and nocorrespondence will be entered into.

The first valid claim received will beawarded a Samsung ES9000 TV Value $9,499

If for any reason a claimant does not takethe reward or an element of the reward by the time stipulated by the Promoter,then the reward or that element of the reward will be forfeited.

If the reward is unavailable, the Promoter,in its discretion, reserves the right to substitute the reward with an offer tothe equal value and/or specification, subject to any written directions from aregulatory authority.

Rewards are not transferable orexchangeable and cannot be taken as cash.

Once the rewards leave the Promoter’spremises, the Promoter shall not be liable for the rewards being lost, stolen,damaged or tampered with in any way before they reach the claimant.

Claimants consent to the Promoter usingtheir name, likeness, image and/or voice (including photograph, film and/orrecording of the same) in any media for an unlimited period withoutremuneration for the purpose of promoting this offer (including any outcome),and promoting any products manufactured, distributed and/or supplied by thePromoter.

If this promotion is interfered with in anyway or is not capable of being conducted as reasonably anticipated due to anyreason beyond the reasonable control of the Promoter, the Promoter reserves theright, in its sole discretion, to the fullest extent permitted by law (a) todisqualify any claimant; or (b) subject to any written directions from aregulatory authority, to modify, suspend, terminate or cancel the promotion, asappropriate.

Any cost associated with accessing thepromotional website is the claimant’s responsibility and is dependent on theInternet service provider used.

The use of any automated software or anyother mechanical or electronic means that allows a claimant to automaticallyclaim repeatedly is prohibited and will render all claims submitted by thatentrant invalid.

Except for any liability that cannot beexcluded by law, the Promoter (including its officers, employees and agents)excludes all liability (including negligence), for any personal injury; or anyloss or damage (including loss of opportunity); whether direct, indirect,special or consequential, arising in any way out of the Promotion, including,but not limited to, where arising out of the following: (a) any technicaldifficulties or equipment malfunction (whether or not under the Promoter’scontrol); (b) any theft, unauthorised access or third party interference; (c)any claim or offer that is late, lost, altered, damaged or misdirected (whetheror not after their receipt by the Promoter) due to any reason beyond thereasonable control of the Promoter; (d) any variation in offer value to thatstated in these Terms and Conditions; (e) any tax liability incurred by a claimant;or (f) use of the reward.

The Promoter collects personal informationin order to conduct the Promotion and may, for this purpose, disclose suchinformation to third parties, including but not limited to agents, contractors,service providers, offer suppliers and as required, to Australian regulatoryauthorities. Claim is conditional on providing this information. The Promotermay, for an indefinite period, unless otherwise advised, use the informationfor promotional, marketing, publicity, research and profiling purposes,including sending electronic messages or telephoning the claimant. Claimantsshould direct any request to access, update or correct information to thePromoter. All claims become the property of the Promoter.

These terms and conditions seem strange - e.g. first valid claim received will be awarded the prize - surely that's already happened?!
