Competition and Promoter 1.1. By entering the “Hyundai Goal of the Week” Game of Chance Competition (Competition) and in consideration for the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Subject to paragraph 2.3, entry into the Competition is open to all permanent residents of Australia aged 18 years or over who hold a current full Australian driver’s licence at the date of entry into the Competition. 2.2. Each eligible entrant may only submit one entry during a Weekly Period (defined below). 2.3. The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter, Hyundai Motor Company Australia Pty Limited (Hyundai) and their related corporations and associated agencies are not eligible to enter the Competition. 3. Competition Period 3.1. The Competition commences at 8:30pm Australian Eastern Daylight Time (AEDT) on 27 January 2013 and closes at 5:00pm AEDT on 5 April 2013 (Competition Period). 3.2. Entries not received during a Weekly Period or not completed in accordance with these Conditions of Entry will not be eligible to win. -2- 4. How to enter Eligible entrants must, during a Weekly Period: (a) go to the FOX SPORTS website (www.foxsports.com.au/win) and follow the link to the Competition; (b) enter the details requested; and (c) select their favourite goal of the week from the Hyundai Goal of the Week video package using the voting buttons. 5. Prizes 5.1. The Competition is a game of chance. 5.2. A total of 12 prizes will be awarded in the Competition: (a) 10 Weekly Prizes (one for each Weekly Period); (b) 1 Overall Major Prize; and (c) 1 Overall Runner-up Prize. 5.3. The maximum total prize pool for the Competition is valued at A$54,185 (including GST). 6. Weekly Prizes 6.1. All valid entries received during a Weekly Period will be entered into a random computerised draw for that Weekly Period. 6.2. The random computerised draw for each Weekly Period will be conducted by Mike Da Silva & Associates (Aust) Pty Ltd (MDSA) on behalf of the Promoter at Ground Floor, 15 Grosvenor Street, Neutral Bay NSW 2089 at 11:00am Australian Eastern Standard Time (AEST) on 8 April 2013. The winners will be notified within 2 business days of the draw. 6.3. The entrant with the first valid entry drawn for each Weekly Period will win A$300 (Weekly Prize). 6.4. The total value of all Weekly Prizes (10 x A$300) is A$3,000. 6.5. The Weekly Prizes will be provided to the Weekly Prize winners via electronic funds transfer. The Promoter will request each Weekly Prize winner’s bank account details when the prize winner is notified. The Promoter accepts no liability for prizes lost in transit if a Weekly Prize winner supplies incorrect bank account details. 7. Overall draw 7.1. All valid entries received by the Promoter during a Weekly Period will be entered into an overall random computerised prize draw. For the avoidance of doubt, an entrant will receive one entry into the overall draw for each Weekly Period in which the entrant submitted a valid entry into the Competition.-3- 7.2. The overall random computerised prize draw will be conducted by MDSA on behalf of the Promoter at Ground Floor, 15 Grosvenor Street, Neutral Bay NSW 2089 at 11:00am AEST on 8 April 2013. The winners will be notified within 2 business days of the draw. 8. Overall Major Prize 8.1. The entrant with the first valid entry drawn in the overall draw will win one Hyundai Veloster 1.6L SR Turbo Manual (Hyundai Veloster SR), valued at A$31,990, plus on road costs including dealer delivery, registration and CTP for 12 months and other Government charges, valued at a maximum of A$3,600, and optional metallic paint, valued at A$595 (Overall Major Prize). 8.2. The maximum total value of the Overall Major Prize is A$36,185 (including GST). 8.3. Without limiting paragraphs 11.1, 11.2, 11.3 and 13.1 below, the following terms and conditions apply to the Hyundai Veloster SR: (a) colour selection will be at the Overall Major Prize winner’s discretion, subject to availability; (b) The Overall Major Prize winner must specifically request metallic paint for the Hyundai Veloster SR; (c) the Hyundai Veloster SR will be delivered to the Hyundai dealership located closest to the Overall Major Prize winner’s place of residence and the Overall Major Prize winner is responsible for all expenses associated with collecting the Hyundai Veloster SR from that Hyundai dealership; (d) delivery of the Hyundai Veloster SR to the Hyundai dealership may take up to 4 weeks; (e) the Promoter accepts no responsibility for any variation in the value of the Hyundai Veloster SR due to depreciation; and (f) the Overall Major Prize winner must comply with any additional terms and conditions imposed by Hyundai in respect of the Hyundai Veloster SR. 9. Overall Runner-up Prize 9.1. The entrant with the second valid entry drawn in the overall draw will win a Hyundai A-League Grand Final Experience comprising: (a) return economy class airfares for the prize winner and three companions from the capital city nearest to the prize winner’s place of residence to the host city for the 2012/13 A-League Grand Final (Match) on 20 April 2013, departing on 19 April 2013 and returning on 21 April 2013, valued at a maximum of A$6,000; (b) return airport/hotel transfers and hotel/Match venue transfers, valued at a maximum of A$2,000; (c) two nights’ accommodation in a four star hotel from 19 April 2013 to 20 April 2013, valued at a maximum of A$4,000; and-4- (d) four Corporate Box tickets to the Match, valued at a maximum of $3,000. (Overall Runner-up Prize) 9.2. The maximum total value of the Overall Runner-up Prize is A$15,000 (including GST). 9.3. The Overall Runner-up Prize winner acknowledges that, as at the commencement of the Competition Period, the host city for the Match has not been confirmed by Football Federation Australia. 9.4. The Overall Runner-up Prize winner’s companions must be aged 18 or over. 9.5. Without limiting paragraph 11.2 below, the Overall Runner-up Prize winner is responsible for all expenses not specified in these Conditions of Entry, including but not limited to spending money, any meals not stated above, insurance (including medical, travel and health), transport to and from the Overall Runner-up Prize winner’s nearest capital city, any transfers not stated above, items of a personal nature (including but not limited to in-room charges, tips, telephone and laundry) and all other ancillary costs. 9.6. Prize travel is subject to fare rules and other conditions of carriage. Tickets will not be exchanged for another destination. The Overall Runner-up Prize winner and their travel companions cannot upgrade any prize travel or prize accommodation using cash or frequent flyer points and will not accrue frequent flyer points on any prize flights or with any prize accommodation. The Overall Runner-up Prize winner and their travel companions must travel together on the same flights on all sectors and stay together at the nominated hotel. Prize travel must be taken in order to coincide with the prize in paragraph 9.1 above. Prize travel may not be changed by the Overall Runner-up Prize winner or travel companions under any circumstances. If the Overall Runner-up Prize winner cannot travel in accordance with these Conditions of Entry and on the flights nominated by the Promoter, the prize will be forfeited. Bookings will be made by the Promoter. Flight schedules and accommodation arrangements are subject to change without notice. If the capital city nearest to the Runner-up Prize winner’s place of residence is the host city for the Match, the economy class airfares under paragraph 9.1(a) above will not form part of the Overall Runner-up Prize. 10. Notification of prize winners The Weekly Prize, Overall Major Prize and Overall Runner-up Prize winners will be notified by telephone and e-mail on 8 April 2013 and their names will be published in the public notices section of The Australian newspaper on 10 April 2013. The Overall Runner-up Prize winner must accept or reject the Overall Runner-up Prize by 12:00pm AEST on 15 April 2013. 11. Information for all prize winners 11.1 The Promoter accepts no responsibility for any variation in the value of a prize. The prizes are not transferable or exchangeable. The Overall Major Prize and the Overall Runner-up Prize are not redeemable for cash and must be taken as offered. In the event that any element of a prize is not available, the Promoter reserves the right to -5- substitute a prize of equal or greater value, subject to written directions from State regulatory bodies. 11.2. Each prize winner is responsible for all expenses not specified in these Conditions of Entry. 11.3. Each prize winner acknowledges that the prize may be subject to additional terms and conditions imposed by third party prize suppliers. The prize winner must become acquainted with any such additional terms and conditions prior to taking the prize. The Promoter does not accept responsibility and is not liable for any additional conditions imposed on the taking of the prize or the breach of those conditions by any person. 11.4. If for any reason a prize winner does not take an element of the prize during the stated period and on the conditions stipulated by the Promoter or any third party prize suppliers, that element of the prize will be forfeited. Cash will not be awarded in lieu of that element of the prize. All entrants agree to provide the Promoter or the Promoter’s authorised agent with identification and/or proof of age if selected as a prize winner. In accepting a prize, the prize winner agrees to the limitation of liability set out below. The form of identification and/or proof of age are at the discretion of the Promoter. 12. Unclaimed prizes 12.1. If the Overall Runner-up Prize is unclaimed by 11:00am AEST on 15 April 2013, a random computerised second chance draw will be conducted by MDSA on behalf of the Promoter at Ground Floor, 15 Grosvenor Street, Neutral Bay NSW 2089 at 12:00pm AEST on 15 April 2013, subject to written directions from State regulatory bodies. The winner of the Overall Runner-up Prize second chance draw, if any, will be notified by telephone and in writing on 15 April 2013 and their name will be published in the public notices section of The Australian newspaper on 17 April 2013. 12.2. If the Overall Major Prize or any Weekly Prize is unclaimed by 11:00am AEST on 8 July 2013, a random computerised second chance draw will be conducted for all unclaimed prizes by MDSA on behalf of the Promoter at Ground Floor, 15 Grosvenor Street, Neutral Bay NSW 2089 at 12:00pm AEST on 8 July 2013, subject to written directions from State regulatory bodies. The winner of the Overall Major Prize and/or Weekly Prize second chance draw, if any, will be notified by telephone and in writing on 8 July 2013 and their name will be published in the public notices section of The Australian newspaper on 10 July 2013. 13. Limitation of liability 13.1 Except for any liability that cannot by law be excluded (including as set out under paragraph 13.2), the Promoter, its related corporations and associated agencies (and any of their personnel) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant (including the prize winner and their companions) in connection with the Competition or a prize, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, its related corporations and associated agencies (and any of their personnel); and (iii) any liability for personal injury or death.-6- 13.2. Nothing in these Conditions of Entry limits, excludes or modifies, or purports to limit, exclude or modify, the statutory implied guarantees/warranties as provided under the Competition and Consumer Act 2010 (Cth) and the ASIC Act 2001 (Cth), including the statutory consumer guarantees under the Australian Consumer Law, or similar laws in the States and Territories of Australia. 14. Privacy By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the entrant’s personal information to assist in conducting the Competition or communicating with the entrant in regard to special offers from the Promoter. Without limiting the foregoing, the Promoter may disclose the prize winner’s personal information for the purpose of fulfilling the prize. Entrants in the Competition acknowledge that the Promoter may share an entrant’s personal information with the Promoter’s Australian related entities which may contact the entrant with special offers. If an entrant elects to receive information from third parties, the Promoter may also disclose the entrant’s personal information for that purpose. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). General 15.1. By entering the Competition, the prize winner agrees that: (a) if requested by the Promoter, the prize winner will: i. provide comments about the Competition and/or a photograph or audio-visual clip of themselves; and ii. participate in a promotional shoot in connection with the Competition; (b) the Promoter may use the prize winner’s name, image, comments, photographs or clips (Materials) for publicity and promotional purposes in any form of media, without reference or compensation to the winner or any other person; (c) the Promoter may use, reproduce, edit and communicate to the public the Materials at any time in any form of media; (d) the Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same; and (e) the prize winner unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of their moral rights in the Materials and waives all moral rights in the Materials that arise outside Australia. 15.2. In the event that there is a dispute concerning the conduct of this Competition, the Promoter’s decision is final and binding and no correspondence will be entered into.-7- 15.3. The prize remains the property of the Promoter until it is delivered to the selected prize winner or unclaimed prize winner as the case may be. 15.4. If for any reason the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any causes beyond the Promoter’s control which corrupt or affect the fairness or integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the Competition, subject to written directions from State regulatory bodies. 15.5. The Promoter reserves the right to disqualify any entrant who conspires with others to gain an unfair advantage or who is otherwise involved in manipulating, interfering or tampering with the entry process or any other element of the Competition. The use of any automated entry software or any mechanical, electronic or other means which allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 15.6. No responsibility will be taken by the Promoter or its authorised agents for lost, ineligible, misdirected or late entries due to technical reasons or any other reason or due to periods of unavailability of the entry mechanism during the Competition Period. 15.7. The prize winner is advised that tax implications may arise from the prize and should seek independent financial and taxation advice prior to acceptance of the prize. The prize winner is responsible for all taxes (excluding GST) which may be payable as a consequence of receiving a prize. 15.8. It is the entrant’s responsibility to inform the Promoter of any changes to their contact details, including their residential address, e-mail address or daytime telephone number. 15.9.
