1.      Instructions on how to enter, prize details and other information contained within the promotional advertisements form part of these terms and conditions. By participating, in this promotion entrants agree to be bound by these terms and conditions.
 
2.      Subject to clause 19, entry is open to all residents of Western Australia who are 18 years and over.  Photo identification may be required upon claiming the prize.
 
The promotion commences at 12am on 10/05/2013 and closes at 10am on 24/05/2013.
 
3.      Only entries submitted via www.thewest.com.au/competitions before 10am Friday May 24, 2013 with all the details required including the unique codeword within The West Australian in WestMate on Friday May 10 and 17, 2013 are eligible.  Only one entry per valid email address.
 
4.      The one winner will be drawn at random from all valid entries at 11am on Friday May 24, 2013 at The West Australian, Newspaper House, 50 Hasler Road, Osborne Park WA 6017 and will be notified by phone.  The Promoter will make every attempt to contact the winner. In the instance that the winner cannot be contacted on the phone number provided within five (5) working days, the prize will be forfeited and a new winner will be drawn at the same time and place as the first draw
 
5.      Prize consists of one trip for the winner and three (3) guests who are Australian residents and aged 18 years or over to XXXX Island located on the Great Barrier Reef, Australia departing on 27/06/13 and returning on 30/06/13.  The trip includes return economy class airfares for four (4) adults from Perth to Rockhampton Airport, including airline and airport taxes, transfers from Rockhampton Airport to and from XXXX Island and three (3) nights 3 star (or equivalent) accommodation.  Winner and guests must travel together.  Accommodation may consist of a mix of single, double and/or dormitory-style rooms and semi-permanent tents with a mix of ensuite and communal bathrooms, and will be allocated at the discretion of the Prize Sponsor.  Selected food and beverages will be provided at the Prize Sponsor  discretion, including unlimited water.  Activities available on the Island are subject to weather and management discretion, and may include (but are not limited to) snorkelling, rod fishing, kayaking, canoeing and beach games.  Participation in any activities will require the completion of a Participation Agreement and Release and is taken at the risk of the individual.  The Prize Sponsor may amend or substitute available activities in its absolute discretion.  Prize value is up to RRP$10,000 (depending on point of departure).  All other ancillary costs, including but not limited to taxes (excluding GST), fuel, meals and beverages (unless specified), transfers (unless specified), activities (unless specified), insurance, incidentals and any and all other expenses are the responsibility of the winner.  It is a condition of accepting the Prize that the winner and their guests arrange at their own expense valid travel insurance with the highest available coverage for their period of travel.  The Prize is a single event trip for the winner and their guests and cannot be separated into separate trips or components.  Total maximum RRP value of prizes is $10,000.
 
6.      The winner and their guests must be Australian residents and aged 18 years and over.  The winner and their guests must be able to travel on 27/06/13 – 30/06/13. Within 7 days of being notified that they are a winner, the winner will receive an email confirming that they have won a trip.  The winner will also be advised of other information and documents they will need to provide to the Prize Sponsor to complete their booking. The winner must provide all other information and documents requested by the Prize Sponsor  (including in respect of their guests). If the winner is unable to travel on the specified dates (27/06/13 – 30/06/13), the prize will be forfeited.
 
7.      Before any prize is awarded, the winner and each of their guests will be required to:
a.      sign a Participation Agreement and Release in favour of the Promoter, the Prize Sponsor and event organiser; and
b.      provide evidence of valid travel insurance with the highest available coverage for their period of travel.
        Winner and their guests may also be required to provide a credit card imprint at check-in to the accommodation on XXXX Island that will be used to charge for incidentals (such as optional activities) and/or as a bond in case of damage to the property.
8.      Accommodation and flight arrangements, including suppliers, will be determined by the Prize Sponsor in its sole discretion.  The Prize Sponsor may refuse any requested changes, and will not accept any request made within 24 days of departure.  If any requested change is accepted by the Promoter, change fees may be applicable.
9.      All additional costs incurred will be at the expense of the winner.
 
10.     If the winner is a country resident it will be their responsibility to make their own way to Perth city to claim/redeem their prize.
 
11.     The prize must be taken as supplied and is neither redeemable for cash nor transferable. No responsibility is accepted for any variation in the value of the prize. 
 
12.     If any prize or any element of a prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize or element of a prize of equal or greater value at the Promoter’s sole discretion, subject to any written directions from the relevant authorities. Winners will not be entitled to any additional compensation in the event that the prize or element of a prize has been substituted at equal or greater value
 
13.     The Promoter reserves the right to request verification of age, identity, residential address and any other information relevant to entry into or participation in this promotion.  Verification is at the discretion of the Promoter, whose decision is final.  The Promoter reserve the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with this promotion.
 
14.     The prize is subject to the terms and conditions of the transport, accommodation and other third party suppliers or prize components. The Promoter and the Prize Sponsor are  not responsible or liable for any loss, damage or injury suffered by any winner or their guests as a result of the conduct of any third party prize suppliers, or otherwise as a result of the winner and their guests accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or the Prize Sponsor (as applicable) or which cannot be excluded by law.
 
15.     Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws, codes or policies including those of the relevant liquor licensee relating to the responsible service of alcohol. The Promoter supports the responsible service of alcohol.
 
16.     It is a condition of entry that all prize winners agree to have their name and suburb published for publicity purposes if required. By participating in this competition, participants signify their acceptance of all conditions and the requirement to participate in promotional activity if required.  Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
 
 
17.     ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO TAKE WHATEVER ACTION IT CONSIDERS NECESSARY AGAINST ANY PERSON WHO IS PARTY TO THE SAID CONDUCT.
 
 
18.     The entrant consents to the use by West Australian Newspapers Limited and its related corporations (as defined by the Corporations Act 2001)of the entrants’ details and acknowledges that West Australian Newspapers Limited and its related corporations, may, at its discretion, disclose and use those details for the purpose of providing you with goods or services, communicating with you, planning, research, product and business development and sales, the promotion and marketing (whether target, direct or indirect) of their businesses, services or products or those of a third party which we believe may be of benefit to you. The details will also be used to investigate complaints, as required or permitted by any law, to enable West Australian Newspapers Limited  to perform its obligations to you under this or any other agreement and to ensure that you perform your obligations under this or any other agreement.

19.     Employees of West Australian Newspapers Limited, Lion-Beer, Spirits & Wine Pty Limited and their associated agencies and immediate families, are ineligible to enter.   Immediate family includes spouse, defacto spouse, parent, natural or adopted child or sibling living under the same roof.
 
20.     All contestants release from, and indemnify, West Australian Newspapers Limited and Lion-Beer, Spirits & Wine Pty Limited against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the competition including (but not limited to) loss of income, personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
 
21.     West Australian Newspapers Limited, Lion-Beer, Spirits & Wine Pty Limited and associated agencies accept no responsibility for any loss, damage, accident, death or injury resulting from the promotion.
 
22.     Entry into this competition signifies acceptance of all conditions.  The Promoter's decision will be final and cannot be contested.  No correspondence will be entered into.  The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches.  If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion.
