TERMS AND CONDITIONS:

1.      Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
 
2.      Promotion is only open to residents of Australia aged 18 years and over. Employees (and their immediate families) of the Promoter, the Promoter’s associated companies, participating retailers andtheir agencies associated with this promotion are ineligible to participate.
 
3.      The Promoter reserves the right, at any time, to verify the validity of entries andentrants (including an entrant’s identity, age and place of residence) andreserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
 
4.      Promotion commences 12:00pm AEST on 13/05/13 and closes 11:59pm AEST on 07/07/13 (“Promotional Period”).
 
 
How to Enter
5.      To be eligible to enter, individuals must purchase any one [1] of the following products from any participating Australian retailer during the Promotional Period:

6.      To enter, individuals must then, during the Promotional Period either:
(a) visit www.moccona.com.au, follow the prompts to the promotion entry page, input the requested details including the store of purchase, their full Moccona product barcode number and their full contact details and submit the fully completed online entry form; or
(b) register their participation via the Moccona promotional application (“Application”) on the Facebook Platform, which can be located on the Moccona Facebook Page (https://www.facebook.com/moccona), fully complete the online entry form including the store of purchase, their full Moccona product barcode number, and their full contact details and then submit the fully completed online entry form.
 
7.      Entry and participation in the promotion is dependent on entrants following andacting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
 
8.      This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to thePromoter and not to Facebook.
 
9.      Incompleteor indecipherable entries will be deemed invalid.
 
10.   Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) unrecognised barcodes will be deemed invalid.
 
11.   Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
 
12.   All entries are deemed to be received at the time of receipt into the promotional database and NOT at the time of transmission by the entrant.
 
How Winners are Determined
 
13.   There will be one (1) Major Prize Draw conducted for this promotion. The Major Prize Draw will be conducted on 09/07/13 at 12.00pm AEST at Prime Focus, Suite 403, 62 Beach Street, Port Melbourne, VIC 3207.
 
Notification of Winners
 
14.   All provisional winners will be notified in writing, and where possible by telephone, within two [2] business days of the Major Prize Draw.
 
15.    All provisional winners will be required to send the Promoter their original or a photocopy of their original eligible purchase receipt(s) to a reply paid address for verification purposes to claim their prize. Receipt(s) must be received by 20/09/13 (prior to the unclaimed prize draw) in order to be verified as a winner in the promotion. Failure to provide the proof of purchase as set out for all entries when requested may, in the absolute discretion of the Promoter; result in invalidation of ALL of that entrant’s entries and forfeiture of any right to a prize.
 
16.    Provisional winners from the Major Prize Draw will be published online at www.moccona.com.au for a minimum period of twenty eight (28) days commencing on 16/07/13.
 
Prize
 
17.    Major Prize Draw: The first fifteen [15] valid entries drawnin the Major Prize Draw will each win a trip for two [2] adults to Venice, Italy valued at up to AU$9,700.00 depending on date and point of departure. Prize includes return economy airfares for two (2) adults (including airfaretaxes) from the winner’s nearest Australian capital city to Venice, Italy, five [5] nights twin share accommodation at a 4 star hotel including daily breakfast and a day trip to Verona, Italy, to visit Juliet’s Balcony/House in thehistorical centre of Verona. Spending money, additional meals, additional taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport from departure point, transfers, items of a personal nature, in-roomcharges and all other ancillary costs are not included. Prize must be taken by 20/06/14. Block out periods apply from 09/07/13 until 10/08/13, and from 10/12/13 until 20/01/14. Prize winner and travel companion must have valid travel insurance for their period of travel.
 
18.    All travel is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partner. All bookings must be made at a minimum of thirty [30] days in advance of requested departure date. All bookings and documentation regarding the prize must be made via Free-2-Travel Holidays Pty Ltd or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices. No portion of the prize is redeemable for cash. The prize is not refundable or transferable. Each winner and their companion must be in possession of a valid passport with a minimum of six [6] months validity on it prior to departure. Winners are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. Each winner and their companion must have valid travel insurance for their period oftravel.
19.   Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.  In the event that a portion of a prize is awarded to the winner in the form of a voucher /ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
20.   If any prize is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the prize with a prize of equal value and/or similar specification, subject to any written directions from a State and/or Territory regulatory authority.
21.   There are a total of fifteen [15] Major Prizes to be awarded.
 
22.    Total prize pool is valued at up to AU$145,500.00.
 
Unclaimed Prize Draw
 
23.    The Promoter may conduct an unclaimed Prize Draw at 12:00pm AEST on 09/10/13 at Prime Focus, Suite 403, 62 Beach Street, Port Melbourne, VIC 3207 as is necessary to award any unclaimed prizes, subject to any directions from a regulatory authority. Without limiting the requirement for compliance with these Terms and Conditions, all valid entries received during the Promotional Period (other than those entries which have already been drawn as winners) will be eligible to win any unclaimed prize.
 
24.    Winners, if any, will be notified in writing, and where possible by telephone, within two [2] business days of the draw.
 
25.    Major Prize winners of the unclaimed Prize Draw, if any, will be published online at www.moccona.com.au for a minimum period of twenty eight (28)days commencing on the 11/10/13.
 
General Conditions
 
26.   If there is a dispute as to the identity of an entrant, the Promoter reserves theright, in its sole discretion, to determine the identity of the entrant.
 
27.   If for any reason a winner does not redeem a prize (or an element of the prize) then the prize (or that element of the prize) will be forfeited.
 
28.   The Promoter’s decision is final and no correspondence will be entered into.
 
29.   Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
 
30.   If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited totechnical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
 
31.   Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
 
32.    Nothing in these Terms and Conditions limits, excludes or modifies orpurports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes allliability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
 
33.    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or notunder the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) participation in a prize and/or use/taking of a prize.
 
34.    As a condition of accepting a Major Prize, each winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
 
35.    The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The details of persons making online entries will be held in accordance with the D.E Coffee & Tea Australia Pty Ltd privacy policy which can be accessed by visiting http://www.moccona.com.au/public/privacy-policy.aspx policy or by contacting our Privacy Officer at D.E Coffee & Tea Australia Pty Ltd, Level 1,924 Pacific Highway, Gordon NSW 2072, telephone 02 9551 3000. All entries will becomethe property of the Promoter. The Promoter may, foran indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. Each entrant’s submitted entries will be stored by the Promoter for further research purposes.
