Competition and Promoter 1.1. By entering the “FOX SPORTS and HSBC Legendary Lions Journey” Game of Skill Competition (Competition) and in consideration for the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Information on how to enter and prize details form part of these Conditions of Entry. 1.2. The promoter of the Competition is FOX SPORTS Australia Pty Limited ABN 16 065 445 418 of 4 Broadcast Way, Artarmon NSW 2064 (Promoter). 2. Who may enter 2.1. Subject to paragraphs 2.2, entry into the Competition is open to all permanent residents of Australia aged 18 years or over. 2.2. The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter and HSBC Bank Australia (HSBC) and their related corporations and associated agencies are not eligible to enter the Competition. 2.3. Each entrant may submit an unlimited number of entries in the Competition during the Competition Period (defined below), provided that each entry is unique. 3. Competition Period 3.1. The Competition commences at 12:00pm Australian Eastern Standard Time (AEST) on 24 May 2013 and closes at 10:00am AEST on 10 June 2013 (Competition Period). 3.2. Entries not received during the Competition Period or not completed in accordance with these Conditions of Entry will not be eligible to win. 4. How to enter Eligible entrants must, during the Competition Period: (a) go to the FOX SPORTS website (www.foxsports.com.au/win) and follow the link to the Competition; (b) enter the details requested; and (c) tell us in 25 words or less why you should win a legendary journey to see the Wallabies v Lions in Brisbane. (Entry Question). 5. Prizes 5.1. Judging of all entries received during the Competition Period will be conducted by the Promoter at 4 Broadcast Way, Artarmon NSW 2064 on 10 June 2013. 5.2. A total of 3 prizes will be awarded in the Competition: (a) 1 Major Prize; and (b) 2 Runner-Up Prizes. 5.3. The maximum total prize pool for the competition is valued at A$7,150 (including GST.) 6. Major Prize 6.1. The entrant who submitted the most creative and unique answer to the Entry Question during the Competition Period (as judged by the Promoter in its sole discretion) in accordance with these Conditions of Entry will win: (a) return economy class airfares for the prize winner and the one companion from the capital city nearest to the prize winner’s place of residence to Brisbane, departing on 22 June 2013 and returning on 23 June 2013, valued at a maximum of A$1,000; (b) return airport/hotel transfers and ground transport on public transport to/from the Match (defined below), valued at a maximum of A$200; (c) 1 night’s accommodation in a 5 star hotel in Brisbane on 22 June 2013, valued at a maximum of A$700; (d) 2 Platinum Category tickets to the Wallabies v British and Irish Lions test match on Saturday, 22 June 2013 at Suncorp Stadium, Brisbane, (Match), valued at A$600 in total; (e) 2 Lions replica playing jerseys, valued at $300 in total; (f) 2 Lions Merchandise packs consisting of one pair of Lions socks and one Lions notebook, valued at A$50 in total; and (g) a meet-and-greet breakfast with a retired Lions player on 23 June 2013, valued at a maximum of A$2,500. (Major Prize) 6.2. The maximum total prize value of the Major Prize is A$5,350 (including GST). 6.3. Without limiting paragraph 9.3 below, the Major Prize winner is responsible for all expenses not specified in these Conditions of Entry, including but not limited to spending money, any meals not stated above, insurance (including medical, travel and health), transport to and from the Major Prize winner’s nearest capital city, any transfers not stated above, items of a personal nature (including but not limited to in-room charges, tips, telephone and laundry) and all other ancillary costs. 6.4. Prize travel is subject to fare rules and other conditions of carriage. Tickets will not be exchanged for another destination. The Major Prize winner and their travel companion cannot upgrade any prize travel or prize accommodation using cash or frequent flyer points and will not accrue frequent flyer points on any prize flights or with any prize accommodation. The Major Prize winner and their travel companion must travel together on the same flights on all sectors and stay together at the nominated hotel. Prize travel must be taken in order to coincide with the prize in paragraph 6.1 above. Prize travel may not be changed by the Major Prize winner or travel companions under any circumstances. If the Major Prize winner cannot travel in accordance with these Conditions of Entry and on the flights nominated by the Promoter, the prize will be forfeited. Bookings will be made by the Promoter. Flight schedules and accommodation arrangements are subject to change without notice. If the capital city nearest to the Major Prize winner’s place of residence is Brisbane, the economy class airfares under paragraph 6.1(a) above will not form part of the Major Prize. 7. Runner-up Prize 7.1. The entrants who submitted the second and third most creative and unique answers to the Entry Question (subject to any unclaimed prize draw under paragraph 10.1 (if required)) during the Competition Period (as judged by the Promoter in its sole discretion) in accordance with these Conditions of Entry will each win: a) 2 Platinum Category tickets to the Wallabies v British and Irish Lions test match on Saturday, 22 June 2013 at Suncorp Stadium, Brisbane, (Match), valued at $600 in total; and b) 2 Lions replica playing jerseys, valued at $300 in total; (Runner-up Prize) 7.2. The maximum total prize value of the Runner-Up Prize is A$1,800 (including GST). 8. Notification of prize winners 8.1. The Major Prize winner will be notified by telephone and e-mail on 10 June 2013. The Major Prize winner must accept or reject the prize by 10:00am AEST on 13 June 2013. 8.2. The Runner-up Prize winners will be notified by telephone and e-mail by 5:00pm AEST on 14 June 2013. Each Runner-up Prize winner must accept or reject the prize by 10:00am AEST on 18 June 2013. 9. Information for all prize winners 9.1. The Promoter accepts no responsibility for any variation in the value of a prize. The prizes are not transferable or exchangeable. The prizes are not redeemable for cash and must be taken as offered. If for any reason a prize winner does not take an element of a prize during the stated period and on the conditions stipulated by the Promoter or any third party, that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize. 9.2. In the event that any element of a prize is not available, the Promoter reserves the right to substitute a prize of equal or greater value. 9.3. Each prize winner is responsible for all expenses not specified in these Conditions of Entry. 9.4. Each prize winner acknowledges that the prize may be subject to additional terms and conditions imposed by third party prize suppliers. The prize winner must become acquainted with any such additional terms and conditions prior to taking the prize. The Promoter does not accept responsibility and is not liable for any conditions imposed on the taking of the prize by any third party prize supplier, or the breach of those conditions by any person. All entrants agree to provide the Promoter or the Promoter’s authorised agent with identification and/or proof of age if selected as a prize winner. In accepting a prize, the prize winner agrees to the limitation of liability set out below. The form of identification and/or proof of age are at the discretion of the Promoter. 10. Unclaimed prizes 10.1. If the Major Prize is unclaimed by 10:00am AEST on 13 June 2013, it will be awarded to the entrant who submitted the second most creative and unique answer to the Entry Question (as determined by the Promoter in its absolute discretion). The unclaimed prize winner will be notified by telephone and email on 13 June 2013 and must accept or reject the prize by 10:00am AEST on 14 June 2013. The process will be repeated every 2 hours until a prize winner is contacted and the Major Prize is claimed. 10.2. If a Runner-up Prize is unclaimed by 10:00am AEST on 18 June 2013, it will be awarded to the entrant who submitted the next most creative and unique answer to the Entry Question (as determined by the Promoter in its absolute discretion). The unclaimed prize winner will be notified by telephone and email on 18 June 2013. The process will be repeated every 2 hours until a prize winner is contacted and the Major Prize is claimed. Each prize remains the property of the Promoter until it is collected by the selected prize winner or unclaimed prize winner as the case may be. 11. Limitation of Liability 11.1. Except for any liability that cannot by law be excluded (including as set out under paragraph 11.3), the Promoter, its related corporations and associated agencies (and any of their personnel) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant (including the prize winner and their companions) in connection with the Competition or a prize, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, its related corporations and associated agencies (and any of their personnel); and (iii) any liability for personal injury or death. 11.2. No responsibility will be taken by the Promoter or its authorised agents for lost, ineligible, misdirected or late entries due to technical reasons or any other reason. Entries that are not genuine or are incomplete, late or in any way fraudulent will be declared void. 11.3. Nothing in these Conditions of Entry limits, excludes or modifies, or purports to limit, exclude or modify, the statutory implied guarantees/warranties as provided under the Competition and Consumer Act 2010 (Cth) and the ASIC Act 2001 (Cth), including the statutory consumer guarantees under the Australian Consumer Law, or similar laws in the States and Territories of Australia. 12. Privacy By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the entrant’s personal information to assist in conducting the Competition or communicating with the entrant in regard to special offers from the Promoter. Without limiting the foregoing, the Promoter may disclose the prize winner’s personal information with HSBC for the purpose of fulfilling the prize. Entrants in the Competition acknowledge that the Promoter may share an entrant’s personal information with the Promoter’s Australian related entities which may contact the entrant with special offers. If an entrant elects to receive information from third parties, the Promoter may also disclose the entrant’s personal information for that purpose. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). General 13.1. All entries must be original to and created solely by the entrant. All entries and all copyright and other rights in such entries and/or other materials become the property of the Promoter and will not be returned. Each entrant agrees to provide a written assignment of all rights to the Promoter if requested. By submitting an entry and any other materials (save for any personal information) to the Promoter in connection with the Competition, each entrant: (a) specifically authorises the Promoter to use and/or license third parties to use such entry in whole or in part, throughout the universe, in perpetuity in or on any and all media, whether currently in existence or developed in the future, and alone or together or as part of other information, content and/or material of any kind or nature; (b) represents and warrants that all elements contained in the entry or other material: (i) are original to the entrant and fully cleared for use as contemplated in these Conditions of Entry; (ii) do not and will not, in any way, violate or breach any of the terms of any other agreement the entrant may be a party to; (iii) do not contain defamatory, tortious or otherwise unlawful, untrue or inaccurate information, infringe or violate any copyright or other right; or contain any matter the publication or sale of which will violate any law; (iv) are not obscene or likely to cause offence; (v) are not in any way cruel or abusive; and (vi) will not require the Promoter to pay or incur any sums to any person or entity as a result of Promoters’ use or exploitation of the same; and (c) unconditionally and irrevocably consents to any act or omission which would otherwise infringe any of their moral rights in the entry and waives all moral rights in the entry that arise outside Australia. 13.2. This Competition is a game of skill. Chance plays no part in determining the prize winner. 13.3. Acceptance of the prize constitutes consent on the prize winner’s part to allow the use of the prize winner’s name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law. 13.4. No correspondence will be entered into and the judges’ decision is final and binding. 13.5. If for any reason the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the fairness or integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the Competition. 13.6. The prize winner is advised that tax implications may arise from the prize and should seek independent financial and taxation advice prior to their acceptance of the prize. The prize winner is responsible for all taxes (excluding GST) which may be payable as consequence of receiving a prize. 14. Contact details 14.1.
