(the ‘Promoters’). Entry Eligibility 4. Subject to clause 5, entry is open only to Australian residents over the age of 18, as of the date of entry. Each entrant must read and consent to these Terms and Conditions. 5. The competition Entry Period commences 27 May 2013 at 00:01 AEST and closes at 30 September 2013 23:59 AEST (‘Competition Entry Period’). The winner will be notified by phone and email within 2 business days of the draw. The Promoters may conduct such further draws on 20 November 2013 (within 3 months of the draw as prize must be taken from 7 December 2013) at the same time and place as the original draw in order to distribute any prizes unclaimed by this date, subject to State and Territory legislation. Prize 17. The Prize has a recommended retail value of up to A$4,710 for 2 people (the winner and their companion), inclusive of all taxes, fees and gratuities (tips). 18. The one (1) winner will receive an 11-night New Zealand cruise on Voyager of the Seas departing on December 7, 2013. Prize is for two people in an ocean view stateroom. 19. The prize is not redeemable for cash and is not transferable to another date or cruise. 20. The prize does not include airfares, transfers, travel insurance, shore excursions or drinks purchased on board, passports, visas, vaccinations, other spending money, or other onboard activities including spending money for the casino. 21. The prize includes onboard main meals and entertainment for 2 people (with the exception of those restaurants which have an additional cover charge), and all Australian and overseas port charges and taxes. 22. The prize winner will be subject to the booking terms and conditions as outlined in the Royal Caribbean Cruises Australia, New Zealand & South Pacific 2012-2014 brochure. 23. The prize or any unused portion of the prize, cannot be transferred, exchanged or redeemed for cash. Where a prize, or part of a prize, is unavailable, the Promoters retains the right to substitute the prize (or part) with a prize (or part) of equal or greater value. General 24. By entering this competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoters are not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoters do not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered. 25. Compliance with any health or other government requirements is the responsibility of the prize winner and their travel companions. All prize travel will be subject to the carrier’s General Conditions of Carriage. The Promoters and carrier make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade at www.smartraveller.gov.au. Prizes for travel for a particular event or attraction must be taken to coincide with the event or the times and dates during which the attraction is available. Travel insurance is not included in the prize but is highly recommended. 26. Any entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoters have sole discretion to determine if this clause has been breached by any entrant. The Promoters reserve the right to request whatever documentation they deem necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoters upon request. 27. If the prize is unavailable, for whatever reason, the Promoters reserve the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. Cash will not necessarily be awarded as a substitute. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. 28. The Promoters may (but are not obliged to) at any time reject and/or remove from access by the public or disqualify or invalidate any entry that they consider (in their sole judgment) infringes these terms and conditions, subject to State and Territory Legislation. The Promoters will have no liability to entrants in that regard. If this occurs in respect of a winning Entry, the Promoters reserve the right to conduct an immediate redraw. If for any reason any aspect of this competition is not capable of running as planned including by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoters which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoters may in their sole discretion (but subject to State and Territory legislation) cancel, terminate, modify or suspend the competition, or invalidate any affected entries. 31. To the fullest extent permitted by law (including the Competition and Consumer Act 2010 (Cth)) and without limiting any other conditions of entry, the Promoters may, in their discretion, terminate, modify or suspend the competition. All entrants participating in the competition at the point of termination, modification or suspension of the competition will be notified by the Promoters in writing. In the event of modification or suspension of the competition, the entrant may choose to terminate their participation in the competition at no cost. 32.
