Terms and conditions of the “Kleenex Share the Softness Prizes”

Information on how to enter the “Kleenex Share the Softness Prizes” promotion and prizes form part of these Terms and Conditions. By participating in this promotion you accept these Terms and Conditions.
The Promoter is Kimberly-Clark Australia Pty Limited, 52 Alfred Street Milsons Point NSW 2061, ABN 65 000 032 333, Tel: 1800 028 334.
Entry is only open to Australian residents who are aged 18 years or over.
Employees of the Promoter and their immediate families, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entries open at 4:00pm on 13/05/2013 and close at 11:59pm AEST on 01/08/2013. This is stated as the Promotion Period.
To enter, entrants must, during the Promotion Period:

Enter a pledge with a category the same as an ‘open prize’ as indicated on the prize page on the Website at sharethesoftness.kleenex.com.au/prizes. The entry pledge can be completed with or without Facebook and completed fields must include: Name; a pledge in the field ‘or write one from the heart’; select who it is for (category); email (if the pledge is not completed with Facebook); Mobile; Suburb; and State.
Click the ‘submit’ button to submit your pledge before the end of the Promotion Period.
The Promoter will accept multiple entries, subject to the following restrictions:
Each pledge is unique; and
Each entry must be submitted separately and in accordance with these Terms and Conditions.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants’ details (including an entrant’s identity, age and place of residence), and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. The Promoter may accept errors and omissions at its discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible entries will be invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, at its sole discretion, to determine the entrant’s identity.
This promotion is a game of skill. Subject to any re-judging under clause 18, each entry will be judged based on the creativity of their pledge, the category it has been submitted under and its relevance to the prizes on offer within that category. Each winner will be selected due the creativity of their pledge and awarded the prize which is most relevant and which would help them fulfil the winning entry pledge if awarded.
The judging of entries will take place at Soap Creative, Suite 406/22-36 Mountain Street, Ultimo NSW 2007 on 8/8/13. The winners will be notified by email or phone within 7 days of winning.
The Promoter’s decision is final and the Promoter will not enter into any correspondence with entrants other than winners in relation to this promotion or the prize.

Prizes are subject to substitution based on the most suitable prize for the winner based on their circumstances and location and within the maximum value of the prize. The final prize is determined by the promoter.

Entrants are only eligible to go into the pool for the prizes, which have the same allocated category as their pledge. A category is defined as the six available options under ‘who is it for?’ on the pledge submission page. Each prize states it’s eligible category on the prizes page on the Website.

The maximum total prize pool value is $8,973.00
Subject to clause 18, if for any reason a winner does not redeem the prize or a part of the prize by the time stipulated by the Promoter, then the prize or that part of the prize will be forfeited and cash will not be awarded in lieu of that prize or element of that prize.
If the prize (or part of the prize) is unavailable, the Promoter, at its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The prize, or any unused part of the prize, is not transferable or exchangeable and cannot be taken as cash.
Judging will be conducted to distribute any unclaimed prize on 30/09/13 at the same place as the original judgment, subject to any directions from a regulatory authority. The winner or winners will be notified via email or phone on 04/10/13.
Winners should allow 28 days for the Prize delivery. Prizes will be sent by the most suitable method of delivery for the prize (for example email or mail). The promoter will notify the winner how they will receive their prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the Promoter’s reasonable control, including but not limited to technical difficulties, infection by computer virus, unauthorised intervention or fraud corrupting or affecting the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, at its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant who the Promoter suspects has tampered with the entry process; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Website is the entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees under the Australian Competition and Consumer Act or the New Zealand Consumer Guarantees Act 1993, as well as any other implied warranties under the ASIC Act or similar consumer protection laws (Non-Excludable Guarantees). Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or in relation to this promotion.
The Website or Application may not be available for access from time to time during the Promotion Period. All access to, and use of, the Website is at the individual’s risk. Any contact details entered incorrectly on the Website or the Application will result in the relevant entry being invalid.
To the fullest extent permitted by law, the Promoter and Facebook exclude liability for any problems or technical malfunction of any communication network or lines, computer on-line systems, servers, or providers, computer equipment, software, or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to entrants’ or any other person’s computer or other device related to or resulting from participating in this promotion, or downloading from, or uploading any materials to, the Website in relation to this promotion.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize.

Entrants consent to the Promoter using their name, likeness, image and voice (including photograph, film and recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
