1 Definitions

AEST/AEDT means Australian Eastern Standard/Daylight Time.

Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or step- child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Promoter means Eat Now Services Pty Ltd (ACN 138 659 588) of 767 Springvale Road, Mulgrave, Victoria 3170.

Promotion means this EatNow.com.au Voucher Giveaway.

Promotional Period means the period starting on 20 May 2013 at 12:00pm AEST and ending on 10 June 2013 at 11:59pm AEDT.

2 Who May Enter

Entry is open to Australian residents aged eighteen (18) years or over who hold a current valid Australian driver's licence. Entrants under the age of 18 must have the consent of their parent/guardian. Entry by a minor is deemed acceptance of these terms and conditions by their parent/guardian.

Employees of the Promoter and their Immediate Families as well as agencies associated with this promotion are ineligible to enter.

3 Requirements for Entrants

Participation in this promotion is deemed acceptance of these Terms and Conditions.

It is compulsory for entrants to provide their full name, date of birth, residential address and email address to enter the promotion.

4 Validity

To enter, entrants must, during the Promotional Period, submit the fully completed entry form on the EatNow.com.au website.

One (1) entry permitted per person.

Incomplete entries will be deemed invalid.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's sole and unfettered discretion.

5 The Prize

The prize is:

A major prize of consisting of 52 x $35.00 Eat Now vouchers (“Major Prize”);

With regards to the Major Prize:

Only one voucher may be used per week;

Each voucher is valid for only one week, beginning on Monday at 12.00am and expiring on Sunday at 11.59pm. Unused vouchers will not be re-issued or credited to the winner’s Eat Now account;

No voucher may be used to purchase alcohol.

The total prize pool will be up to AUD$1820.00.

No prize is transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

6 Details of Draw

The Winner(s) of the prizes will be randomly drawn from eligible entries as described in condition 4 (“Winner”).

The Draw will take place at the Promoter’s office located at 767 Springvale Road, Mulgrave, Victoria on 11 June 2013 at 12.00pm AEDT.

The Winner(s) will be notified on 11 June 2013 following the Draw on the Promoter’s:

Website: www.EatNow.com.au;

Twitter feed; and

Facebook page.

In addition to the Winner being announced in accordance with condition 6.3, the Winner will also be contacted by the Promoter via email following the draw on 11 June 2013. and an announcement will be published in The Australian newspaper within 7 days of the announcement of the Winner, identifying the Winner.

The Winner(s) of the prizes must sign any release form(s) as may be required by the Promoter (and its associated agencies and companies), and/or any other third party directly or indirectly involved in and with the prize and refusal to sign such form(s) shall result in the immediate forfeiture of the prize and that person shall have no claim, action or recourse at law or otherwise, against the Promoter in respect of the forfeiture.

A draw for any unclaimed prize will take place at the Promoters’ office 4 months after the initial draw. The winner(s) will be notified in the same manner as condition 6.3 and 6.4 on the applicable dates.

7 Method of Claiming Prize

The respective Winner are not required to be on-site at the draw. Once the Winner are announced, the Promoter will contact the Winner in the manner set out in condition 6.3 and 6.4 to make arrangements for claiming the prize.

If for any reason a winner does not take a prize at the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.

8 Database

All entries will be entered into a database for future advertisement and marketing and all entrants will create a user account with Eat Now.

The Promoter and its affiliated entities may use entrants' names and addresses for future marketing and promotional purposes unless notified otherwise in writing by the entrant.

Subject to clause 8.4, the Promoter will classify all entries as confidential and will not disclose any entrant’s details to any other parties (excluding entities affiliated with the Promoter), and by entering the competition the entrants to accept email communications from the Promoter and its affiliated entities until the entrant opts out to receive the email communications.

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.

9 General

Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

to disqualify any entrant; or

subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

All entries become the property of the Promoter.

The Promoter reserves the right to alter or amend these Terms and Conditions, and conditions of operation of the Promotion, subject to the approval of the gaming authorities in each State or Territory, where required.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

any technical difficulties or equipment malfunction (whether or not under the Promoter's control);

any theft, unauthorised access or third party interference;

any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

any variation in prize value to that stated in these Terms and Conditions;

any tax liability incurred by the winner or any entrant; or use of the prize.
