Terms & Conditions
This competition ("Competition") is conducted by Pacific Magazines Pty Ltd, 8 Central Ave, Eveleigh NSW 2015 (ABN 16 097 410 896) ("Promoter").
Information on how to enter and prizes form part of the Terms and Conditions. Entry into this competition deems acceptance of these Terms and Conditions.
To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your information to the Promoter and not to Facebook.
Eligibility to Enter

Entry is open to residents of Australia aged 13 years or over as at the date of entry ("Eligible Entrants"), except employees and immediate families of the Promoter, associated companies and agencies and participating outlets. Immediate family means any of the following: spouse, ex spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.
All Eligible Entrants may only enter once per day per theme but only one Minor Prize will be awarded per person, however Minor Prize winners will also have a chance at winning the Major Prize.
All Eligible Entrants must obtain the prior permission of their legal parent or guardian over the age of 18 to enter. The parent or guardian may be called to verify consent and may be required to sign a release at the discretion of the Promoter. The release will also require the winner's parent or guardian to accept responsibility for the acts and forbearances of the winner. The release must include the full name, address and telephone number of the winner' legal parent or guardian. Failure to provide such proof, particulars or releases will immediately invalidate the winner's entitlement to the prize, subject to State and Territory legislation.
Where the prize involves driving, travel or an event, winners under the age of 18 must be accompanied by their legal parent or guardian at all times. The Major Prize winner's companion must be the Prize winner's legal parent or guardian.
The Competition commences on 21/05/2013 at 09:00hrs AEST and closes on 27/08/2013 at 17:00hrs AEST. All times and dates are stated using the 24 hour clock. 00:01hrs is the start of a day and 24:00hrs is the end of the day.
How to Enter

Entry can only be made via the internet.
To enter into the Competition via the internet and be eligible to win, Eligible Entrants must visit www.ubkexpressurself.com.au and navigate to the sign up now button to firstly register for an account if he/she has not done so already. If an Eligible Entrant has not previously registered for an account, he/she will be required to create an account by providing first name, last name, email address, username, password, date of birth, contact number, postcode and state. If an Eligible Entrant is under 18 years old, they must enter the contact name and contact number of their legal parent or guardian. An Eligible Entrant must not register more than once. Once registered, the Eligible Entrant must visit the Competition Website (if they are not already at the Competition Website) and, in accordance with the directions, during the Entry Period, provide: (a) the Eligible Entrant�s email address and password as established during registration; (b) upload a photo using one (1) of the themes ("Themes") of the month; and (c) write an appropriate photo description in twenty five (25) words or less that explains their chosen photo.
Multiple entries are permitted if each entry is submitted separately and in accordance with the entry requirements as detailed in clause 11 and these Terms and Conditions.
An Eligible Entrant must not use more than one (1) account to submit entries on the Competition Website.

Voting and Tie Breaker

This is a game of skill and chance plays no part in the winner selection process.
Winners of the Minor Prizes will be determined by the number of votes they receive for their entry by their peers.
Once a photo with an appropriate 25 words or less description has been submitted by an Eligible Entrant, it will be visible in an online gallery, subject to verification to ascertain appropriateness for publication (clause 23) as determined in the opinion of the Promoter.
During each Competition Period anyone will be able to vote on the entries that are displayed in the online gallery. Each person may submit a vote for an entry by selecting the "vote" button underneath each entry. There is no restriction on the amount of votes that can be submitted per entry.
Eligible Entrants that occupy the top three (3) places of the leaderboard ("The Leaderboard"), based on the number of votes received at the end of each Competition Period as indicated in the table (clause 14) will be awarded with a Minor Prize ("a Minor Prize"), subject to verification (clause 31).
In the event that more than three (3) Eligible Entrants occupy the top three (3) positions on the leaderboard based on number of votes, at the end of Competition Period, a tiebreaker will take place.
Any Eligible Entrants that are tied on votes will be judged based on the entry they have uploaded on:
                a. Literary merit;

                b. Creative merit;

                c. Originality; and

                d. Fit to the embodiment of the ultimate art of self expression as demonstrated by U by Kotex through their brand.

Judging if required, will take place at Pacific Magazines Pty Ltd, 8 Central Ave, Eveleigh NSW 2015 Australia, 2 days after the close of the Competition Period at 11:00hrs.

The Judging

All nine (9) Minor Prize winners will be contacted, verified (clause 31) and informed of their win two (2) days after the close of each Competition Period, and entered into a final round of judging to win a Major Prize ("a Major Prize").
All nine (9) Minor Prize winners will be judged based on:
        a. Literary merit;

        b. Creative merit;

        c. Originality; and

        d. Fit to the embodiment of the ultimate art of self expression as demonstrated by U by Kotex through their brand.

The Promoter in its sole discretion, reserves the right to disqualify any entries that are deemed to be defamatory, indecent, vulgar, obscene, sexually explicit, offensive, discriminatory or threatening in anyway.

A panel of judges will be appointed by the Promoter.
Judging for this final round will take place at Pacific Magazines Pty Ltd, 8 Central Ave, Eveleigh NSW 2015 Australia on 29.08.13 at 11:00hrs AEST.
Subject to the Promoter's verification process (clause 31), the best three (3) valid entries, as determined by the judges, will win a Major Prize ("a Major Prize").
The Promoter reserves the right to select reserves in order of merit, in the event that the original individual selected to win a Major Prize is deemed ineligible/invalid.
In order to receive a Major Prize, the Eligible Entrants selected to receive a Major Prize (and legal parent or guardian where applicable), must sign and return in the time nominated by the Promoter, as relevant (a) a participation agreement confirming their compliance with these Conditions and eligibility to take a Major Prize on the dates nominated by the Promoter; and (b) a statutory declaration. Notwithstanding, receiving the above documents, the Promoter, may in its absolute discretion, not award a Major Prize, because of a failure to comply with these Conditions.
The Promoter will attempt to contact each original person selected to win a Major Prize on at least five (5) attempts by telephone or email. The original individuals selected must be confirmed by 11:00hrs on 31.08.13. If the original individuals selected to win the Major Prize confirm that he or she can attend the Prize by 11:00hrs on 31.08.13, then subject to complying with the requirements of clause 27, he or she will be deemed a winner. If the original individuals selected to win the Major Prize cannot confirm that he or she can attend the Prize by 11:00hrs on 31.08.13, he or she may be deemed, in the absolute discretion of the Promoter, invalid and the Promoter may contact a reserve as a replacement.
Minor Prize winners will be notified from 27.06.13 and their names will also be published on www.ubkexpressurself.com.au from 01.07.13, providing winners have been verified. The Major Prize winners will be notified on 30.08.13.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Entrant�s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter's decision is final and no correspondence will be entered into.
Prizes

Total prize pool value is up to $8,688.30.
There are nine (9) x Minor Prizes in total that will be available to be won across the Competition Periods as indicated in the table within clause 13.

Each Prize Pack is valued at $275.70. All Minor Prizes will be sent within 60 days of verification. Total minor prize value is $2,481.30.

There are three (3) x Major Prizes. The Major Prize is a trip for the winner and their legal parent or guardian (where applicable) to attend a photoshoot in Sydney on 23.09.13. Each Major Prize is valued at $2,069.00 and consists of:
                a. Return economy flights for the winner and their legal parent or guardian (where applicable) from the winner�s nearest Australian capital city to Sydney, NSW (if necessary) to visit the Girlfriend headquarters. Flights are not available to those winners that are NSW residents, valued up to $1,200;

                b. Photoshoot with hair and makeup styling session and wardrobe, valued up to $500;

                c. iPad mini, valued at $369; and

                d. The opportunity to have their photo featured on the Girlfriend split cover on sale 30th October 2013 plus a feature of their photos from their Girlfriend visit within the UbK advertorial in magazine.

                e. The opportunity to meet Home and Away star Rhiannon Fish during the visit to Girlfriend Headquarters

Accommodation is not included in the overall Major Prize. Winners and their legal parent or guardian (where applicable) must arrive on the day of the photo shoot. Total Major Prize value is up to $6,207.00.

Major Prize winners must be able to attend Girlfriend headquarters in Sydney on 23.09.13.
Each Major Prize winner and their legal parent or guardian (where applicable) must travel on the same flight together. The Major Prize winners and their legal parents or guardians (where applicable) are responsible for making their way to and from their home to the departure point. The Major Prize winners and their legal parents or guardians (where applicable) are responsible for any further costs associated with redeeming the Major Prize which are not otherwise specified in these Conditions, including but not limited to, food and beverage expenses, accommodation, additional entertainment and/or miscellaneous expenses. For the avoidance of doubt, no "spending money" is included in either the Major Prizes. The cost of any travel insurance is the responsibility of the Major Prize winners and their legal parents or guardians (where applicable). Flight itinerary to be determined by the Promoter in its absolute discretion. A credit card imprint or cash deposit may be required from the Major Prize winners at accommodation check-in, for all incidental charges. Flights are non-transferable and cannot be exchanged for cash. Major Prizes are subject to booking and flight availability. Major Prize winner is responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. It is the responsibility of the Major Prize winners and their legal parents or guardians (where applicable) to ensure they are checked in for their flights, and arrive at the airport, at the time specified by the relevant airline carrier. The Promoter is not responsible for any costs associated with the Major Prize winners or their legal parents or guardians (where applicable) missing any of their flights.
If any prize, or part of any prize, is unavailable, the Promoter, in its discretion, reserves the right to substitute a prize with a prize to the equal value and/or specification.
Prizes, including any unused portion, are not transferable or exchangeable and cannot be taken as cash, unless stipulated otherwise.
Travel arrangements to and from the winner's home and their nearest capital city airport do not form part of the prize unless expressly stated in these terms & conditions and are the responsibility of the winner and their travelling companions. Eligible Australian capital cities include, Melbourne, Brisbane, Adelaide, Darwin, Hobart, Canberra and Perth. The winner must travel on the same flights and itinerary as their travelling companions. The travel prize cannot be used as part payment for another airfare package. Frequent flyer miles cannot be accrued on this prize. Flights are subject to availability at the time of booking and cannot be exchanged for other destinations. Travel restrictions & blackout dates apply. Prizes cannot be taken during peak periods or school holidays, and winners must provide all suppliers with a minimum of 21 days advance notice of intention to travel. Embargo restrictions apply during certain periods. Bookings are subject to conditions & availability (including but not limited to capacity limitations and other restrictions).
By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.
During the visit the winner must abide by, and ensure his or her companions abide by all reasonable requests of the Promoter and program producer. Failure to comply may result in immediate and unconditional removal of the winner from the premises. All entrants agree that if they win the prize, they will not, and their legal parents or guardians will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the internet.
Photos that are copyrighted cannot be submitted unless you have permission from the photographer/owner. Photos cannot be returned. By entering the competition entrants agree and understand that their written entries and/or photos may be used for promotional purposes without any further reference, payment or other compensation to the entrant and/or owner of the photograph. Entrants under the age of 18 must seek a parent or adult/guardian's permission to send any photo to the Promoter to enter a promotion.
Each entrant warrants that the photograph is a genuine and accurate representation and that the photo has been taken within two years of the date of submission. The Promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. All photographs will be reviewed by the Promoter.
Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Major or Minor prize winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition.
The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (vi) any variation in prize value to that stated in these Conditions; or (vii) any tax liability incurred by a Major Prize or Minor Prize winner or Eligible Entrant. Individuals should obtain independent tax and financial advice.
CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
To the full extent permitted by law, the Promoter, its related companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant or companion in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these Conditions limits, excludes, or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection lawsin the States and Territories of Australia.
The Promoter makes no guarantee that the celebrities, actors and/or production staff associated with the Major Prize will be present during the visit. Even if those people are present, the winner and their legal parent or guardian (where applicable) will not necessarily meet with any of them. Travel must be taken to coincide with the timing of the Major Prize, on a date to be determined by the program producers/Promoter. During the visit the winner must abide by, and ensure their legal parent or guardian (where applicable) abides by all reasonable requests of the Promoter and program producer. Failure to comply may result in immediate and unconditional removal of the winner and their legal parent or guardian (where applicable) from the premises. All Eligible Entrants agree that if they win the Major Prize, they will not, and their legal parent or guardian (where applicable) will not, sell or otherwise provide their story and/or photographs to any media or other organisation, including the internet. Photographs will be allowed only at the discretion of the program producers and the celebrity.
All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. Pacific Magazines Pty Ltd ("Pacific") and its related entities collects entrants� personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and, if you consent, for the purpose of Pacific sending you promotional and direct marketing material in relation to its magazines and products and services available through Pacific and its business partners for related purposes which would reasonably be expected without your permission. For example, we may from time to time use your personal information to provide you with information about products and services which we expect may be of interest to you. However, we do respect your right to direct us not to do this if and when any future communication is sent to you by the Promoter. We do not sell personal information to other organisations. We may disclose personal information to essential service providers who provide services in connection with our products and services.
