1. Information on how to claim and entitlements form part of these Terms and Conditions. By participating in this promotion, the claimant's understanding and acceptance of these Terms and Conditions is deemed.

2. Offer open to Australian residents only. Employees of the Promoter, participating retail outlets and their associated agencies, and their immediate family members are ineligible.

3. 4. To receive$75 cash back, claimants must complete the attached official claim form and send it, along with their original tax receipt, to “Bailey Ladders 2013 Cash Back Promotion” c/- Hills Holdings Limited, PO Box 322 Hindmarsh SA 5007. All cash back claims must be received by last mail on 31/07/13 to be valid. Cash back will be supplied in the form of a $75 Visa Debit Card, and the $75 cash back amount is GST inclusive. Incomplete, indecipherable or illegible claims may be deemed invalid; however the Promoter in its discretion may accept errors or omissions. The claimant agrees that if they have obtained the cash back, they will pay back the Promoter the value of the cash back, if they subsequently return the product to the place of purchase and seek a refund under any returns policy that the relevant retail outlet may have. The Promoter accepts no responsibility for any tax implications that may arise from this promotion, and independent financial advice should be sought by the claimant.

5. The original tax receipt will not be sent back to the claimant, and claimants should retain a copy for their records. Failure to provide an original tax receipt will result in an invalid claim, and the forfeiture of any right to the cash back. Limit of one claim for each participating Bailey branded ladder purchased. No responsibility is accepted for lost, late or misdirected claims. It is the responsibility of the claimant to provide correct name and address details. Delays and non-fulfillment of claims arising as a result of the supply of incorrect name or address are the sole responsibility of the claimant, and in no circumstances will the Promoter be liable. All claims will be subject to the Promoter’s validation and verification checks, and the Promoter reserves the right to disqualify any claimant who submits a claim not in accordance with these Terms and Conditions. The Promoter’s decision is final and no correspondence will be entered into. Claims are not transferable or exchangeable for other goods or services.

6. The Promoter collects personal information in order to conduct this promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, suppliers and as required, to regulatory authorities. Participation is conditional on providing this information. Further, by submitting a claim under this offer, unless otherwise advised by the claimant at the time of submission, each claimant consents to the information they submit with their claim being entered into the Promoter's database and being used in any media, or in any future promotional, marketing, and publicity purposes without any further permission or any payment or other compensation to the claimant. Claimants can at any time request that the Promoter remove their details from the Promoter's database. A request to access, update, correct or remove any information should be directed to the Promoter at its address set out below.

8. Failure by the Promoter to enforce any of its rights at any time does not constitute a waiver of such rights.

9. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any participant or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

10. All costs and risks associated with accessing the website associated with this promotion, or viewing these Terms and Conditions online, is the responsibility of participants, and is dependent upon the internet service provider/telecommunication provider used, amongst other factors. In no circumstances will the Promoter be liable for any claims, damages or other losses arising from the access or failure to access the website or online version of these Terms and Conditions.

11. Nothing in these Terms and Conditions limits, excludes, modifies or otherwise restricts any provisions implied by applicable law that cannot be excluded by law, including but not limited to the consumer guarantees set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and equivalent State and Territory legislation. Except for any liability that cannot legally be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion, including (without limitation) any claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or any use of the cash back.

12. These Terms and Conditions are governed by the laws in force in the State of South Australia, and the claimant and the Promoter submit to the non-exclusive jurisdiction of the courts of that State and the South Australian Registry of the Federal Court of Australia in respect of all proceedings arising in connection with these Terms and Conditions.
