To be eligible to enter the competition you must be a South Australian resident, over 18 years of age and hold a current South Australian motorcycle licence.

CONDITIONS OF ENTRY

Information on how to enter and the prize forms part of these Conditions of Entry.


Promoter
1. The Promoter is the Motor Accident Commission of Level 2, 121 King William Street, Adelaide, South Australia 5000.


Entry
2. Entry to this promotion is deemed acceptance of these Conditions of Entry by each entrant.
3. Entry is only open to residents of South Australia who are aged 18 years or over and who hold a current South Australian motorcycle learner’s permit or motorcycle licence at the time of submitting their entry.
4. To enter the Competition, entrants must, within the Promotional Period, register their details and successfully complete one or more of the Get the Edge, Mick’s Challenge exercises on the Promoter’s website (mac.sa.gov.au/gettheedge).
5. Multiple entries are permitted and entrants must only enter using their own name.
6. There is no cost to enter the promotion.
7. Employees of the Promoter (MAC) and their immediate families are ineligible to enter the Competition.
8. The Promotional Period commences at 9am CST on 3/11/12 and closes at midnight CST on 17/6/13.
9. Upon the conclusion of the Promotional Period all eligible entrants will be entered into the draw to win the Major Prize.
10. On 28/1/13, all eligible entrants who have completed the No Place to Race exercise will be entered into the draw to win a No Place to Race minor prize.
11. On 1/4/13, all eligible entrants who have completed the Gear Up exercise will be entered into the draw to win a Gear Up minor prize.
12. On 3/6/13, all eligible entrants who have completed the Black Spots exercise will be entered into the draw to win a Black Spots minor prize.
13. Entrants must be residents of South Australia and the winner must be a resident of South Australia at the time of claiming the Prize.


Prize and Prize Draws
14. There is one major prize and 36 minor prizes.
15. The prize draw to determine the prize winner for the major prize will be drawn on 18/6/13. The minor prize draw to determine the No Place to Race minor prizes will be drawn on 29/1/13. The minor prize draw to determine the Gear Up minor prizes will be drawn on 2/4/13. The minor prize draw to determine the Black Spots minor prizes will be drawn on 4/6/13. Each of the above draws will be a manual draw conducted at 9:30am CST on the relevant date or at such other time as the Promoter determines, and will take place at the offices of the Motor Accident Commission at Level 2, 121 King William Street, Adelaide, South Australia 5000.
16. The Promoter’s decision is final and no correspondence will be entered into.
17. Each winner will be notified by email. All reasonable steps to notify the winner of the draw will be taken by the Promoter.
18. In the event that any winner is unable to be contacted, and all methods of communication are unsuccessful by the date that is two weeks after the original draw, the Promoter shall conduct a further draw.
19. The prizes remain the property of the Promoter until claimed by the prize winners.
20. The total prize pool is valued at $7,582. The prize value is in Australian Dollars. The Promoter accepts no responsibility for any variation in the prize value.
21. The major prize consists of a trip for two people to attend two days of the 2013 Australian Motorcycle Grand Prix in Phillip Island, Victoria (Event) and an opportunity to meet Mick Doohan. The Prize includes return economy airfares from Adelaide to Melbourne departing on 18/10/13 and returning on 21/10/13 at times to be determined by the Promoter, an opportunity to meet Mick Doohan at a place and time during the 2013 Australian Motorcycle Grand Prix to be determined by the Promoter, three nights accommodation in a 3 star hotel, return coach transfers, and tickets to attend the Event on 19/10/13 and 20/10/13 in the Doohan Pavilion (provided that all dates for the major prize will vary if the Event is held on alternative dates).
22. The dates and times of the major prize cannot be altered by the Promoter. The Promoter accepts no responsibility in respect of any cancellation, variation or delay to any component of the major prize, or if the winner is unable to attend any component of the major prize (including as a result of any such cancellation, variation or delay, or any other circumstance).
23. There will be eleven No Place to Race minor prizes. One No Place to Race minor prize winner will win an Alpinestars GRP leather motorcycle jacket. Ten No Place to Race minor prize winners will win a poster signed by Mick Doohan.
24. The will be twelve Gear Up minor prizes. One Gear Up minor prize winner will win an Arai Isle of Man TT replica motorcycle helmet. One Gear Up minor prize winner will win an Alpinestars GPR leather motorcycle jacket. Ten Gear Up minor prize winners will win a poster signed by Mick Doohan.
25. There will be thirteen Black Spot minor prizes. One Black Spot minor prize winner will win an Alpinestars GPR leather motorcycle jacket. One Black Spot minor prize winner will win a Arai Isle of Man TT replica motorcycle helmet. One Black Spot minor prize winner will win a TW Steel Mick Doohan Special Edition watch. Ten Black Spot minor prize winners will win a poster signed by Mick Doohan.
26. The prizes are not transferable or exchangeable and cannot be taken as cash.
27. Tickets awarded as prizes are not replaceable if lost, damaged or stolen. The Promoter accepts no liability for a prize if lost or damaged in transit.
28. In the event that a prize becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide a similar product of the same or greater value as the original prize, subject to any applicable law.
29. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.


General
30. The Promoter reserves the right to request the winner to produce proof of identity, proof of age, proof of residency at the nominated prize delivery address and proof of his or her motorcycle learner’s permit or motorcycle licence. Identification considered suitable for verification is at the discretion of the Promoter. If identification required by the Promoter is not received by the Promoter (or its nominated agent) the winner's entry will be deemed invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires.
31. The Promoter shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking or using the prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
32. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
33. If for any reason the Competition is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right to cancel, terminate, modify or suspend the Competition, subject to any written directions given under applicable law.
34. Entries in this Promotion are transmitted over the internet. Entrants acknowledge that although encrypting precautions are taken, the internet is not a secure medium and that the Promoter is not responsible for the security of entries.
35. The Promoter is not responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Competition if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
36. The Promoter reserves the right to vary these Conditions of Entry at any time during the Promotion Period. Any variation will be published at the Promotion Website.
37. The winner of the major prize agrees to comply, and will procure that their companion complies, with these Conditions of Entry, and any conditions of sale and conditions of entry to the Event (copies of which are displayed at entrances to the Event or available at www.motogp.com.au).
38. ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, AND IN PARTICULAR ATTENDANCE AT THE EVENT, ARE DANGEROUS AND ACCIDENTS CAN HAPPEN.
39. Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in a prize is at entrants’ own risk. Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of motor vehicles / motorcycles (or parts of them) colliding with other motor vehicles, motorcycles, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law hereby exclude, release and forever discharge the Promoter and the Crown in right of the State of South Australia from all liability for any present or future claim, loss, damage, cost or expense arising from any personal injury or death (whether arising from negligence or otherwise), arising from or connected with a prize awarded as part of the Competition.
40. The Promoter collects entrants’ personal information in order to conduct the Competition, as well as winners’ personal information in order to award the prizes. If the information requested is not provided, the entrant may not participate in the Competition.
41. If the entrant agrees to the use and disclosure of his or her personal information for marketing purposes by accepting the ‘tick the box’ option on the entrance form, the entrant also agrees that the Promoter may provide this information to the Australian Grand Prix Corporation (AGPC) and the Promoter and AGPC may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages, and telephoning the entrant for an indefinite period. Such personal information will be dealt with by the Promoter and AGPC in accordance with relevant privacy legislation and the Promoter’s and AGPC’s respective privacy policies. A request to access, update or correct any personal information, or to access the Promoter’s or the AGPC’s privacy policy, should be directed to the Promoter at the above listed address or the AGPC at Level 5, 616 St Kilda Road, Melbourne, VIC, 3004.
42. A term (or part or parts thereof) of these Conditions of Entry will not apply where the term is unenforceable under the law of the relevant jurisdiction under which any legal action is legitimately taken, however such terms (or part or parts thereof) are severable and do not invalidate the remaining terms.

Conditions imposed by the AGPC on major prize winners attending the Event

AGPC requires that each entrant accept the following conditions in respect of that entrants attendance at the Event, should that entrant win the major prize.

43. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular the Fair Trading Act 1999 (Vic) and the Competition and Consumer Act 2010 (Cth), hereby exclude, release and forever discharge the the AGPC, the Crown in right of the State of Victoria, the Minister administering the Australian Grand Prix Act 1994, Dorna Sports SL, the Federation Internationale de Motocyclisme, International Events Services SL, Promotor Special Events Worldwide SL, National Motorcycle Federation, PI Circuit Pty Ltd (ACN 108 623 052), PI Graydens Pty Ltd (ACN 108 623 070), PI Sunrise-McGuigan Pty Ltd (ACN 108 623 089), PI Visitor Centre Pty Ltd (ACN 108 623 043), PI Operations Pty Ltd (ACN 108 623 463), Linfox Property Group Pty Ltd (ACN 058 015 642), Fox Group Holdings Pty Ltd (ACN 058 015 777), International Road Racing Teams Association, Motorcycling Australia Ltd and Motorcycling Victoria, and their respective officers, employees, servants, agents, contractors, sponsors, successors and assigns, and all other persons involved in the organisation, conduct and promotion of the Event or the prizes (Associated Entities) from all liability for any present or future claim, loss, damage, cost or expense arising from any personal injury or death (whether arising from negligence or otherwise), arising from or connected with participation in Recreational Services (as defined below) at the Event.

To the extent permitted by law (in particular the Fair Trading Act 1999 (Vic) and the Competition and Consumer Act 2010 (Cth)), entrants acknowledge that, to the extent to which they participate at the Event in:
(a) a sporting activity or similar leisure time pursuit; or
(b) an activity that:
(i) involves a significant degree of physical exertion or physical risk; and
(ii) is undertaken for the purposes of recreation, enjoyment or leisure,
(Recreational Services),
including, without limitation, participation in a prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.

WARNING: If you participate in these activities your rights to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in this clause 44.

NOTE: The change to your rights as set out in this clause 43, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Fair Trading (Recreational Services) Regulations 2004 (Vic).

For the purpose of this clause 43 “the supplier” will mean and include the Associated Entities.

Without limiting any other release or limitation of liability contained in the Conditions, the Associated Entities will not be liable for any indirect or consequential loss suffered by any entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Event.

Nothing in this Condition 43 or in these Conditions generally affects your rights under the Competition and Consumer Act 2010 (Cth), Fair Trading Act 1999 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions and warranties cannot be excluded by law.
