Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Entry is only open to Hoyts Rewards members who are residents of NSW, VIC, SA, WA, ACT, and QLD only. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. 3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion. 4. Promotion commences on Monday 5th August 2013, and closes 11:59pm AEST on Sunday 1st September 2013 (“Promotional Period”). 5. To enter, Hoyts Rewards members must, during the Promotional Period visit www.hoyts.com.au, purchase a movie ticket to the Hoyts screening of The Wiggles: Pumpkin Face online at www.hoyts.com.au, an automatic message will appear after the online transaction, follow the prompts and input the requested details and submit the fully completed entry form including answering a question in 25 words or less “What are the names of your two most favourite Wiggles, and why?” 6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 7. Incomplete or indecipherable entries will be deemed invalid. 8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per ticket purchased; (b) each entry must be submitted with a different email address; and (c) each entry must be submitted separately and in accordance with entry requirements. 9. Entrants must retain a copy of their purchase receipt(s), ticket stub or confirmation email (for online purchases) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. 10. Winners will be notified via phone and email on Friday, 6 September 2013. 11. The Promoter’s decision is final and no correspondence will be entered into. 12. Major Prizes valued at up to AU $11,599.84 RRP 14. If the Activity is varied for any reason beyond the control of the Promoter, it may not be rescheduled and no compensation will be offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant State and/or Territory regulatory authority. 15. Unless expressly stated, all other expenses, including spending money, meals, travel to and from the venues, transfers, travel insurance and all other ancillary costs become the responsibility of the winners. 16. The Promoter, prize provider and activity operators, in their absolute discretion, at all times reserve the right to: (a) prevent any winners and/or their companion from participating in the Activity if, at any time, they reasonably believe that they pose a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. (c) vary and/or substitute the prize (or part thereof) without notice with a prize to the equal value and/or specification, subject to any written directions from a State and/or Territory regulatory authority. 17. As a condition of accepting the prizes, the winners and companions must sign any legal documentation as and in the form required by the Promoter and/or Prize Providers in their absolute discretion, including but not limited to a legal release and indemnity form. 18. The winners and companions of the prizes acknowledge that elements of the prizes are dangerous and may result in injury or death, and participate at their own risk. To the full extent permitted by law neither the Promoter, and/or any of its employees, contractors and agents or employees of its contractors and agents, and/or companies providing prizes for the Promotion, will be liable for any liability / cost / loss / damage / expense / death / personal injury suffered or incurred or any dispute (including, but not limited to, direct/indirect/consequential loss) arising out of, or in connection with this Promotion. 19. In the event that any prize item is unavailable, the Promoter reserves the right, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value. 20. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 22. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. 23. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize. 24. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. 25. Selection of airline and accommodation venue is at Ardent Leisure Limited’s discretion upon time of booking. 2. The prize is subject to availability, cannot be taken during Australian school holidays (inclusive of all Australian States) or during Gold Coast 600 Event dates (25-27 October 2013), and is valid for a period of 6 months from the original draw date. Validity date of this prize cannot be extended. 3. Flight may only be taken from the winners nearest Australian major airport to the Gold Coast or Brisbane. 4. The prize winner will be required to provide at least 3 weeks’ notice of intent to travel. All components of prize are subject to availability at time of booking. 5. If the winner resides within a 3-hour drive or 240km from Dreamworld and WhiteWater World, airfares and car rental are not included in the prize. 6. Once booked, any changes made to the booking may incur a cancellation fee of amendment fee, at the cost of the winner. 7. The car hire vehicle will be available upon arrival at Queensland, for pick from the airport and drop off on departure. It is a condition that the hirer be 25 years and over, and hold a current Australian or New Zealand license. Provisional licenses and learner’s permits will not be accepted. The Promoter accepts no responsibility for damage, mistreatment or ill manor to the hire car caused by the hirer. The Promoter will not be liable for any additional expenses incurred by the hirer through mistreatment, illegal behaviors, or a violation of the car hire's terms and conditions of use. The car hire only covers the day rate hire of the car, all insurance, petrol and damage costs will be the responsibility of the prize-winner. Prize winner will need to present a current credit card for security purposes upon collection of the vehicle. 8. All components of the prize must be taken together. Travel Insurance is not included. Travel Prize does not include meals, spending money or transport to and from departure and arrival points. All other ancillary and travel costs are the winner’s responsibility. All additional costs incurred whereby the prize winner wishes to make variations to the travel are the winner’s responsibility and must be booked separately by the winner. All travel variations are subject to approval by Ardent Leisure Limited upon booking. Travel variations include, but are not limited to extension of travel duration, travellers outside of the age restriction and additional travellers. 9. Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. 10. The competition is open to Australian Residents. If the winner is under the age of 18 years the prize may be awarded, at the absolute discretion of the promoter, to their parent or legal guardian. In the event that the winner is under 18 years of age, the winner must be accompanied by an adult aged 21 years and over. 11. Any change in the value of the prize between publishing date and the date prize is claimed is not the responsibility of the promoter. |
