Futureplan Property Pty Ltd (ACN 160 281 881) of B 3-4/320 Lorimer Street, Port Melbourne Victoria 3207 (“the Promoter”) is responsible for conducting the $5000 Giveaway (“the Competition”) 2. The Promoter will respond to queries, manage the entry and judging processes and award the Competition 3. By entering into the Competition each entrant warrants that they have read, understood and agree to be bound by these Terms and Conditions. 4. A copy of these Terms and Conditions can be read at www.futureplanproperty.com.au/termsandconditions. 5. The Competition commences at 12.00 pm on Monday 7th October 2013 and closes at 12.00 pm on July 2014 (“Competition Period”). 6. Entry to this Competition is available only to Australian residents aged 18 years and over who meet the criteria specified in point 9 7. The Promoter reserves the right to refuse a person entry to the Competition or to disqualify an entrant who has breached these terms and conditions. 8. Directors, officers, management and employees (including their immediate families) of the Promoter or any agencies or companies associated with the Promoter are not eligible to enter this competition. 9. To enter the Competition each entrant can do either the following: (a) Access their respective Facebook account and visit the Futureplan Property Facebook Page (“Futureplan FB Page”) found at www.facebook.com/futureplanproperty and click the ‘Like’ button to join the Futureplan FB Page and follow the directions to complete the entry form. (b) Telephone the Promoter’s designated Competition telephone line on 1800 856 869 (“the Competition Line”) and complete a survey with one of the Promoter’s consultants (c) Telephone the Promoter’s Competition Line on 1800 856 869 and book an appointment with one of the Promoter’s consultants to discuss the Promoter’s products and services (d) Purchase any of the Promoter’s products or services. For the avoidance of doubt purchase of any of the Promoter’s products or services means engaging the Promoter to provide property consulting services. All entries submitted via the Futureplan FB Page and the Website must contain a valid First Name, Last Name, Email Address, Residential post code and phone number 11. All entrants entering the Competition via the other methods will be required by the Promoter to give their First Name, Last Name, Email Address, Residential post code and phone number 12. The Promoter reserves the right at any time to verify the validity of the entries and entrants (including an entrant’s identity, age and place of residence and disqualify any entrant who enters more than once or who enters using multiple phone numbers, email addresses or aliases. 13. Any costs associated with accessing the Futureplan FB Page and the Website is dependent on the internet service provider used and there shall be no additional cost to the entrant to register his/her name other than the cost paid by the entrant to access the Futureplan FB Page and the Website via the internet 14. The cost associated with telephoning the Promoter’s Competition Line will not exceed 55 cents per call. 15. All valid entries received during the Competition period will be included in the prize draw. 16. The prize draw will be held at 5.00pm on 31st 4564. The first valid entry drawn will be awarded with a cash prize of $5,000 AUD payable by bank cheque or electronic funds transfer (“the Prize”) July 2014 at 14 Oceanic Court Twin Waters, Queensland Winning Entrant 17. The winning entrant (“the Winner”) will be notified by telephone and by email within two days (2) days of the prize draw. The notification will include instructions as to how the Prize is to be claimed. 18. The name of the Winner will be published on the Futureplan FB Page and on the Website on 2 2014. If the Prize is unclaimed with three (3) months of the first prize draw after all reasonable attempts by the Promoter to contact the Winner, an unclaimed prize draw will take place at 5.00 pm on 31st 2014 at14 Oceanic Court Twin Waters, Queensland 4564. The name of the winner in the unclaimed prize draw will be published in on the Futureplan FB Page and on the Website on 2nd 19. If there is a dispute as to the identity of the Winner the Promoter reserves the right in its sole discretion to determine the identity of the Winner and if requested by the Promoter agree to sign an eligibility form confirming their compliance with these terms and conditions and eligibility to accept the Prize. 20. The Promoter may request copies of certain documents from the Winner for the purpose of facilitating the transfer and/or deposit of the Prize. Copies of documents requested by the Promoter include but are not limited to a proof of identity (driver’s licence, passport, birth certificate), proof of residency, bank account details. Once the identity of the documents available are established the Winner must deliver requested copies within fourteen (14) days of being asked to do so. 21. The Winner acknowledges that complete delivery of the Prize may take more than fourteen (14) days and if requested by the Promoter agree to sign a liability release, waiver and/or indemnity form in favour of the Promoter and/or any person or other entity associated with this Competition. Special Conditions 22. Each entrant consents to the Promoter using their name, likeness, image and/or voice in the event that he/ she is the Winner (including photograph, film and/or recording of same) in any media (including Facebook) in perpetuity without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products and services manufactured, distributed and/or supplied by the Promoter. 23. All contact details provided by the entrants to the Promoter will be entered into the Promoter’s database and the Promoter may use the contact details for future promotional, marketing and publicity purposes. Entrants should direct any request to opt out, access, update or correct information to the Promoter. Do not enter this Competition if you do not want to receive promotional material or communications from the Promoter in relation to its products and services. 24. The Winner is advised that tax and legal implications may arise from the Prize winning and any independent tax and legal advice that the Winner seeks will be at his/her cost November 2014 Right to amend 25. The Promoter reserves the right to suspend, cancel or amend the Competition if the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to computer virus, bugs, equipment malfunction, technical difficulties or any act, omission, event, circumstances or any other causes beyond the control of the Promoter subject to approval from any relevant statutory authority. Release and Indemnity 26. (a) To the extent permitted by law the Promoter (including each of its officers, employees and agents) will not be liable for any loss, damage or personal injury (including liability in negligence) or any loss of opportunity whether direct, indirect, special or consequential arising in any way out of the entrants participation in the Competition or in connection with the arrangement for the supply of the goods and services by any person to the Winner and where applicable to any persons accompanying the Winner, except for any liability which cannot be excluded by law. (b) Each entrant shall indemnify each of the Promoter (and its respective directors, officers, employees and agents (each an “indemnified person”) for any loss, liability, cost, damage or expense suffered or incurred by any indemnified person as a result of (i) the entrant breaching any of these terms and conditions; (ii) a warranty given by the entrant proving to be untrue; and (iii) any personal injury arising from or related to any wrongful or negligent act or omission by the entrant in connection with this Competition. The entrant’s liability under the indemnity in this clause is reduced proportionately to the extent that the liability is caused or contributed to by the wrongful or negligent act or omission of any indemnified person. (c) The Promoter assume s no responsibility for any error, omission, interruption or delay in the operation or transmission of any communication sent to or by the Promoter or the entrant whether caused by problems with communication networks or lines, computer systems or other equipment used for the conduct of the Competition. (d) Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under any similar consumer protection laws in the State and Territories of Australia. Governing Jurisdiction 27. The laws of Victoria apply to this Competition to the exclusion of any other law and each entrant submits to the exclusive jurisdiction of the courts of Victoria. 28.
