Tourism WA 100,000 Posts Competition Terms and Conditions By entering the ‘Tourism WA 100,000 Posts’ competition you are agreeing to the following terms and conditions. 1. STANDARD TERMS 1.1 Instructions on how to enter, prize details and other information contained within the promotional advertisements and point of sale materials form part of these terms and conditions. By participating in this competition entrants agree to be bound by these terms and conditions. 2. WHO CAN ENTER? 2.1 Subject to Clause 2.2, entry into the competition is open to all residents of Western Australia aged 18 years or older. 2.2 Employees of Seven Network (Operations) Limited, West Australian Newspapers Ltd, Tourism WA, their subsidiaries, their advertising agencies, participating newsagents and resellers of The West Australian and The Weekend West newspapers, and their immediate families are ineligible to enter. For the purpose of this clause ‘immediate family’ means: spouse, ex-spouse, de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. 3. COMPETITION PERIOD 3.1 The entry period will be from 12.01am (WST) Wednesday, 4 January 2017 to 11.59 pm (WST) Tuesday, 17 January 2017. 4. HOW TO ENTER 4.1 To enter you must enter your details online at thewest.com.au/competitions. 5. PRIZE DETAILS Major Prize 5.1 The major prize consists of: a) $5,000 travel voucher for a holiday in Western Australia booked through Broome, Kimberley & Beyond. 5.2 Total maximum prize value is $5,000 inclusive of GST. Prize value is correct at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken. 5.3 Prize is not transferable or redeemable for cash 5.4 Prize is subject to availability at the time of booking. 5.5 The prize can be used for flights (up to 50% of total value) from any destination in Western Australia (economy class) to another destination in Western Australia and land costs of the itinerary (land costs can include vehicle hire, transfers, accommodation and tours). 5.6 All meals and items of a personal nature are not included and are at the expense of the prize winner. 5.7 A valid credit card will need to be provided on collection if a car is hired and if excess is to be reduced then this is the responsibility of the prize winner. 5.8 Booking to be made with Broome, Kimberley & Beyond and the reference number will be provided with voucher. 5.9 The prize voucher is valid for 12 months from the date of issue. 5.10 It is a condition of accepting the prize that the prize winner must comply with all the conditions of use of the Prize Sponsor’s requirements. The Prize is provided at the Prize Sponsor’s discretion and is subject to availability. 5.11 The prize cannot be transferred or exchanged for cash. 5.12 No compensation will be given for any unused portion of the prize i.e. flights, land stay or transportation. 5.13 The prize winner is responsible for providing their own transport to and from the airport departure and return point if applicable. 5.14 No compensation or alternative travel plans will be arranged should the prize winner and/or their guest miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the winner and travel partner. 5.15 Unless expressly stated in these terms and conditions, all other expenses become the responsibility of the major prize winners and their companions including but not limited to all meals, incidentals, mini-bar, laundry, tips, room service, telephone calls, transfer fees, excess baggage, government taxes, airport charges and all other ancillary and personal costs. A credit card imprint or cash deposit may be required from the prize winner at check-in to the hotel, for all incidental charges. 5.16 Tickets do not include excess luggage, luggage must be within the baggage guidelines of the airline. 5.17 Travel insurance is not included and strongly recommended. 5.18 The winner is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Prize is subject to the standard terms and conditions of individual prize and service providers. Itinerary to be determined by the Promoter in its absolute discretion. 5.19 As a condition of accepting the prize, the winner must sign any legal documentation in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 5.20 All costs associated with changes to flight and accommodation details once booked are the responsibility of the winner. 5.21 If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification. 5.22 In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify the prize, subject to any written directions from a relevant regulatory authority. 5.23 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize. 5.24 In accepting the prize, the winner agrees to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, with their name, suburb and photograph published. The winner grants the Promoters and Prize Sponsors a perpetual and non-exclusive license to use such photographs and information in all media worldwide and the winners will not be entitled to any fee for such use. 5.25 In accepting the prize, the winner agrees they will not sell or otherwise provide their story to any media or other organisations 5.26 The winner of any prize must be 18 years of age or older and must provide valid identification to the Promoter. All guests under 18 years of age must travel with their parent or legal guardian. 6. HOW TO WIN 6.1 The winner will be drawn at random Newspaper House, 50 Hasler Rd, Osborne Park WA on Wednesday 18 January 2017 from all valid entries. 6.2 The winner will be contacted via phone/email to notify them as well as acknowledge that they agree to the terms and conditions of the promotion. Only finalists who agree to the terms and conditions are eligible to win. 6.3 All reasonable attempts will made to contact the winner. If the Prize remains unclaimed by a winner or unallocated or forfeited for any reason, by Wednesday 25 January 2017, at 5pm WST, a new winner will be drawn at random. The winner of the Unclaimed Prize Determination will be notified by a message to their email address that was used to lodge the entry. 7. NO LIABILITY 7.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions. 7.2 West Australian Newspapers, Tourism WA and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail. 7.3 West Australian Newspapers, Tourism WA and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: a) during the judging; b) in the acceptance, participation or use of any element(s) of the prize; c) as a consequence of late, lost or misdirected mail; d) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; e) in relation to failure of an SMS entry message to be received by the Promoter on account of technical problems or traffic congestion; or f) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion. 7.4 West Australian Newspapers, Tourism WA, Prize Providers and associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available. 7.5 If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition. 7.6 The Promoter reserves the right to disqualify any individual who the promoter believes has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct.
