Information on how to enter and prize details set out in all communications regarding the Educational Experience ‘Win a Family Holiday to Hawaii Competition (“Competition”) form part of these Terms and Conditions of Entry. 2. Any entry not complying with these Terms and Conditions of Entry is invalid. Entry in this Competition and the acceptance or receipt of a prize by the winner is deemed as acceptance of these Terms and Conditions of Entry. 3. The promoter is The Educational Experience Pty Limited, ABN 83 003 112 034, of Level 1, 136 Hunter Street, Newcastle NSW 2300, telephone number 1300 134 211 (“Educational Experience”/ “Promoter”). 4. The Competition commences at 9.00am AEDST on 1 August 2017 and closes at 11.59pm AEDST on3 3 December 2017 (“Promotion Period”). 5. Entry into the Competition is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”): (a) Individuals must be an Australian resident aged 18 years and over during the Promotional Period; (b) Individuals must not be an employee or contractor (or a member of immediate family of an employee or contractor) of the Promoter or the Promoter’s related entities directly involved in the Competition (as determined by the Promotor); (c) To enter, individuals must satisfy the Eligibility Requirements and make a purchase from the 2017/2018 Educational Experience Fundraising Catalogue and/or the Educational Experience Fundraising website located at www.edex.com.au/fundraising during the Promotion Period. Individuals will receive one (1) entry per completion of any of the above. 7. The computerised draw will take place at The Educational Experience Pty Limited, Level 1, 136 Hunter Street, Newcastle NSW 2300 at 9:00 AEDST on 6 December 2017. The winner will be notified in writing and by telephone within two (2) business days of the draw. The winner’s name and suburb will be published on the Educational Experience website www.edex.com.au on 6 December 2017. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn, or, if in the case the winner wishes to forfeit the prize. 8. The first valid entry drawn will win the prize (“Winner”) of a family holiday for two (2) adults and two (2) children (aged under twelve (12) years of age). as described in the details below valued up to AUD$10,000 (not redeemable for cash), depending on date and point of departure (“Prize”). 9. The Prize consists of a family holiday for two (2) adults and two (2) children (aged under twelve (12) years of age). The prize includes return flights from the winner’s nearest Australian capital city to Honolulu, Hawaii, USA; return airport transfers to hotel, seven (7) nights accommodation at the Hilton Hawaiian Village in a partial ocean view room; and a Paradise Cover Luau for two (2) adults and two (2) children operated by MC&A Inc. 10. Terms and conditions for all service providers apply. The Promoter or its affiliates will not be liable for any breach of any service providers Terms and Conditions by the Winner. 11. Items not included as part of the Prize which are the responsibility of the Winner include, but are not limited to: (a) additional spending money; (b) additional flights, tickets and accommodation for extra persons or flight legs other than those stated as included in the Terms and Conditions of Entry; (c) additional meals other than those specified; (d) other excursions not specified; (e) travel insurance; (f) laundry service; (g) alcoholic beverages; (h) local and long distance telephone calls; (i) other communication including internet; (j) merchandise and souvenirs; (k) incidental expenses; (l) tips and gratuities; (m) items of personal nature; (n) car, bike, buggy or other hire fees; and (o) in room charges p) travel and entry visas and all other costs and expenses not otherwise mentioned herein. 12. The vacation must be booked at Flight Centre Kotara within twelve (12) months of winning the Prize. Vacation fulfilment is subject to availability of all service providers. Travel dates are unrestrictive, however all package prices are based on an March 2018 travel period and any additional costs are at the Winners expense. All flight prices are based on departure from Sydney Kingsford Smith airport. The Winner may fly from their closest available airport however any additional costs incurred are at the Winners expense. Flight carriers may be varied at the time of booking due to costs and availability. Educational Experience will fund up to A$10,000 of the total cost. 13. In the event of war-terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Competition or suspend or modify the Prize, subject to written directions from a relevant regulatory authority. 14. Subject to the terms and conditions of the participating Prize provider(s), if for any reason the Winner does not take the Prize (or an element of the Prize) at the time stipulated, then the Prize (or that element of the prize) will be forfeited and will not be redeemable for cash. 15. If the Prize (or any element of the Prize) is unavailable for any reason, the Promoter, in its absolute discretion, reserves the right to substitute the Prize (or that element of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 16. Total prize pool is up to AUD$10,000. The prize is not transferable or exchangeable and cannot be taken as cash. The Promoter’s decision is final in relation to all aspects of this Competition. In the event that the chosen holiday by the Winner results in a value of less than AUD$10,000 due to service availabilities and cost fluctuations, the Winner will receive travel credit in the form of additional services and/or upgrades by the respective travel agent. If the chosen holiday by the Winner results in a value exceeding AUD$10,000 due to service availabilities and cost fluctuations, the additional monies is at the expense of the Winner. 17. The Winner accepts the Prize ‘as is’ and acknowledges that the Promoter accepts no responsibility for any tax implications that may arise from their Prize. The Winner should seek advice from the Australian Tax Office or taxation advisor or independent financial advisor. 18. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions of Entry, tampered with the entry or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 19. A draw for the Prize, if unclaimed, will take place on 6 March 2018 at the same time and place as the original draw, subject to any written directions from a regulatory authority. The Winner, if any, will be notified in writing within two (2) business days of the draw and their name and suburb will be published on the Educational Experience website on 6 March 2018 at www.edex.com.au. 20. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promoter (including any outcome), and for promoting any products manufactured, distributed and/or supplied by the Promoter. 21. If for any reason this Competition is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promoter, the Promoter may, subject to the approval of all relevant State and Territory Lottery Departments, take any action that may be available including cancelling, terminating, modifying or suspending the Competition. The Promoter reserves the right in its sole discretion to disqualify any individuals who tampers with the entry process. 22. The Promoter is not responsible for any problems of technical malfunction of any telephone networks or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any person’s computer related to or resulting from participating in or downloading any materials in this Competition. 23. Nothing in these Terms and Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("NonExcludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) any tax liability incurred by a winner, Prize Recipient or entrant; or (f) use/taking of the prize. 24. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Competition and contact you regarding information on products or services that may be of benefit or interest to you. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions, including contactors, prize suppliers, service providers and, as required, to Australian regulatory authorities. The Promoter will also use and handle your personal information as set out in its Privacy Policy, which can be viewed at www.edex.com.au. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
