The Competition is being conducted by The City of Norwood Payneham & St Peters, 175 The Parade, Norwood SA 5067 (ABN 11390194824) (“the Promoter”). 2. Information on how to enter and the Prize forms part of these Terms and Conditions of entry. 3. Entry into the Competition is deemed as agreement to and acceptance of these Terms and Conditions. 4. If there is any inconsistency between these Terms and Conditions and anything else that refers to the Competition, these Terms and Conditions will prevail. 5. The Competition commences at 9.00am ACST on Friday 1 June 2018 and closes at 5.00pm ACST on Saturday 30 June 2018 (“the Closing Date and Time”). All Competition entries must be received by the Promoter prior to the Closing Date and Time. The time of entry will, in each case, be the time of receipt by the Promoter and not the time of transmission by the Entrant. 6. The Promoter does not accept any responsibility for any late, lost or misdirected entries not received by the promoter or delays in delivery of an entry due to technical disruptions, network congestion or for any other reason. Eligibility 7. The Competition is open to all South Australian residents 18 years of age or older, with the exception of elected members, officers or employees of the Promoter and their immediate families and any of their associated companies and agencies. Immediate family includes the following: spouse, ex-spouse, defacto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. 8. The Promoter reserves the right to require the Winner to provide proof of identity and proof of residency at the nominated Prize delivery address in order to claim the Prize. Proof of identification and residency suitable for verification is at the discretion of the Promoter. In the event that the Winner cannot provide proof suitable to the Promoter, the Winner will forfeit the prize in whole and a substitute will not be offered. Entering 9. To enter the Competition, an Entrant must • * spend $25 or more in a single transaction at any participating business within The Norwood Parade Precinct and, • during the period of the Competition but before the Closing Date and Time, visit www.paradenorwood.com to submit their entry by completing the online entry form (and in doing so must complete all required fields) (“the Entrant”). 10. A participating business, café or food outlet means any business and/or service provider within The Norwood Parade Precinct between Portrush Road and Fullarton Road. There is no limit to the number of entries a person may submit, but only one entry may be submitted per transaction in satisfaction of these Terms and Conditions. A copy of the transaction or receipt will be required as proof of purchase and must be retained by the Entrant and provided to the Promoter upon request. 12. An entry that is made on behalf of an Entrant by a third party is invalid unless the Entrant requires the assistance of a third party to enter due to a disability. 13. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any Entrant for failing to comply with any of these Terms and Conditions or for tampering with the entry process, including but not limited to the utilisation of techniques designed to make multiple entries with a single purchase or for submitting an entry which is not in accordance with these Terms and Conditions. 14. Entrants accept full responsibility for the content of their entry and for ensuring that their conduct in entering the Competition and their entry complies with these Terms and Conditions. Prize 15. The Prize means $7,000 (inclusive of GST) in bathroom and plumbing product (“Prize”) available through Caroma, Norwood (“Supplier”) plus $2,500 cash to be used on the bathroom makeover and a $1,000 Outdoors on Parade voucher . The Prize does not include and is not inclusive of any additional products or services for the purposes of installing the chosen product(s) or generally including but not limited to, a master plumber, project management, consulting or Council application fees, nor trade labour or products that are not manufactured under the Caroma brand. 16. The Prize cannot be transferred, exchanged or redeemed for cash. The Prize can be limited to specific ranges at any time by the Supplier without notice. Extensions, alterations and upgrades to the Prize are subject to availability and at the Winner’s own expense. 17. The Promoter does not accept any responsibility for any changes in prize value between now and the Prize redemption date. Draw 18. The Prize will be drawn at 12.00 noon on Monday 9 July 2018 at the City of Norwood Payneham & St Peters, 175 The Parade, Norwood SA 5067. The Prize will be drawn at random in the presence of a Justice of the Peace and the Mayor and/or Presiding Member of the Norwood Parade Precinct Committee. 19. Only one Entrant shall receive the Prize (“Winner”). The Winner will be contacted by telephone in the first npsp0001_170254_037.docx v2 instance and notified in writing within five (5) working days of the draw. The Winner will be announced on The Parade website www.theparadenorwood.com and published online on Monday 16 July 2018 for a period of not less than twenty-eight (28) days. 20. The Winner must make contact with Nicole Staples at Caroma, Norwood on 8405 0202 by 5.00pm on Thursday 25 October 2018 to claim the Prize. If the Winner does not claim the Prize in accordance with these Terms and Conditions the Prize is forfeited without compensation. 21. If the Prize remains unclaimed, an unclaimed Prize draw from all non-winning entries will take place at 12.00 noon on Thursday 25 October 2018. The Winner will be notified by both telephone and in writing within five (5) days of the draw and published online at The Parade website www.theparadenorwood.com on Thursday 1 November 2018 for a period of not less than twenty-eight (28) days. If this stage of the Competition is reached, the Winner must make contact with Nicole Staples at Caroma, Norwood on 8405 0202 by 5:00pm on Thursday 1 November 2018 to claim the Prize. If the Winner does not claim the Prize in accordance with these Terms and Conditions the Prize is forfeited without compensation and no further Prize draws will occur Promotional material 22. All entries become the property of the Promoter. 23. As a condition of entering this Competition the Entrant agrees that, in the event they are the Winner, they provide unconditional consent to the Promoter and the Supplier to use their name, image and photographs for publicity and promotional purposes, without compensation and also agree that the Promoter will own the copyright of any such images and photographs and in all material incorporating the photographs for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this Competition (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Supplier. 24. As a condition of entering this Competition the Entrant agrees that, in the event they are the Winner, they will participate in all reasonable promotional activities in relation to the Promotion as requested by the Promoter and/or the Supplier. 25. By filling out an online entry form the Entrant consents to having the information on the entry form stored, retained and used by the Promoter and/or the Supplier. 26. Entrants acknowledge and agree that it is a condition of accepting the Prize that as the Winner, they will, if required by the Promoter, sign a legal release in a form determined by the Promoter. General 27. The Promoter’s decision is final and the Promoter will not enter into any correspondence regarding the result of the Competition. 28. To the extent permitted by law the Promoter shall not be liable for any loss, damage, injury or death (including but not limited to indirect or consequential loss) suffered or sustained by any person whether caused directly or indirectly by any act or omission of the Promoter or its servants or agents in connection with the Competition or the Prize. 29. The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 30. The Promoter reserves the right to substitute the Prize in whole (or any of its components), with another prize of equal or greater value. 31. If for any reason this Competition is not capable of running as planned; whether caused by infection of computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the control of the Promoter that corrupts or affects the administration, security, fairness or integrity of the Competition, subject to any written direction from any State Authority the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition without any liability to any Entrant. 32. The Promoter reserves the right in its sole discretion to disqualify any Entrant whom the Promoter has reason to believe has breached any of these Terms and Conditions or engaged in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of this Competition.
