The promoter is Auto & General Services Pty Ltd (ABN 61 003 617 909), AFSL 241 411 (operating under the brand Budget Direct) of Level 13, Toowong Tower, 9 Sherwood Road, Toowong 4066 (Promoter) on behalf of the insurer, Auto & General Insurance Company Ltd (ABN 42 111 586 353) (Insurer).
These Terms and Conditions apply to the promotion, “Win Home Dog Training”. Customers will receive entries into the competition when they complete the online entry form on the Budget Direct website (see Eligibility and Participation section) (Promotion).
Information on how to enter and mechanics of entry and prizes form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
The Promotion commences on 10.00am (AEST) on Thursday, 1 July 2021 and ends at 11.00am (AEST) on Friday 30 July 2021 (Promotion Period).
Subject to these Terms and Conditions, the Promoter is offering:
One (1) three-hour home dog training session provided by Bark Busters, plus Bark Busters unique “Life of the Dog Guarantee”. The “Life of the Dog Guarantee” entitles the holder to as many visits from a behaviour therapist as required, free of charge, for the life of the dog (as per the terms and conditions of the guarantee - https://barkbusters.com.au/dog-training-written-guarantee/) (Total prize value is $770, or $880 in WA).
Eligibility and Participation
Customers must meet the following criteria to participate in the Promotion (Eligible Entrant):
be 18 years or over and a permanent resident of Australia, or have resided in Australia continuously for six months or more on a temporary work visa at the time of participating in the Promotion; and
not be an officer or employee of the Promoter or Insurer, its related entities or agents and service providers directly associated with the conduct of the Promotion, or their immediate family; and
during the Promotion Period, complete the online competition entry form located at www.budgetdirect.com.au/landingpages/bottom-line-booster.html, providing responses to all questions.
Eligible Entrants will be awarded a maximum of:
one (1) entry into the Promotion for completing page one of the online entry form.
Three (3) additional entries into the Promotion for completing the bonus questions on page two of the entry form.
The maximum number of entries that will be awarded for form completion within the Promotional Period is four (4).
Any Eligible Entrant who provides incorrect, misleading or fraudulent information, or submits an Entry that infringes any rights of any third party, or contravenes any law or is otherwise objectionable will render all entries submitted by that entrant invalid.
The Promoter may request the Eligible Entrant produce appropriate photo identification and other documentation to confirm, to the Promoter’s satisfaction, the entrant’s eligibility to enter the Promotion and the validity of their entry, failing which all entries of that entrant will be deemed invalid.
Draw and Prizes
The draw will take place at 10:30am (AEST) on Tuesday, 10 August 2021 at the Promoter’s Head Office at Level 13, Toowong Tower, 9 Sherwood Road, Toowong QLD 4066.
The winner will receive one three-hour home dog training session provided by Bark Busters plus a "Life of the Dog Guarantee".
A total of one (1) Eligible Winner will be selected on the Draw Date. The Promotor may request evidence of their validity and eligibility of entry, including but not limited to photo identification.
The Eligible Winner will be notified via their nominated email address within two (2) business days of the Draw Date, or by 12 August 2021. The Eligible Winner’s name will be published on the Promoter’s website at https://www.budgetdirect.com.au/landingpages/bottom-line-booster-winners.html within twenty-one (21) days of the applicable prize draw and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken by the Promoter to notify the Eligible Winner.
The Promoter may draw five (5) additional reserve entries on the Draw Date and record them (in order) in case of an invalid entry or the entrant is ineligible to accept the prize. In the event of an invalid entry or an ineligible entrant, or if the entrant declines to accept a prize, the prize will be awarded to the first reserve entry drawn. If a prize cannot be awarded to an entrant drawn, the Promoter will continue this process until the prize is awarded. If after this process, a prize has still not been awarded, or if an entrant drawn cannot be notified, the Promoter will hold an unclaimed prize draw in accordance with Clause 18.
A prize will be deemed unclaimed if the Promoter is not reasonably able to contact the Eligible Winner within three (3) months and one (1) day of the Draw Date via the contact details provided at the time of completing the competition entry form.
An Unclaimed Prize Draw will be held in order to distribute any prizes that remain unclaimed, at the location in clause 10, subject to any written directions made under applicable State or Territory Legislation, at 10:00AM (AEST) on 11 November 2021.
Any Unclaimed Prize Draw winner(s) will be notified via their nominated email address, within two (2) business days of the Unclaimed Prize Draw or by 15 November 2021. The Unclaimed Prize Draw Eligible Winner’s name will be published on the Promoter’s website at https://www.budgetdirect.com.au/landingpages/bottom-line-booster-winners.html on 11 November 2021, and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken to notify the winners of the Unclaimed Prize Draw.
The Eligible Winner’s Home Dog Training is supplied by the Promoters’ preferred supplier, Bark Busters. The prize consists of one three-hour home dog training session plus a “Life of the Dog Guarantee” up to the value of AU$770 ($870 if the Eligible Winner is located in WA) and is valid for redemption for up to three 3 years from the completion of the competition. The Promoter will distribute the prize via email. The "Life of the Dog Guarantee" is subject to Bark Busters Terms and Conditions. The prize is not transferable, not exchangeable and cannot be redeemed as cash.
Privacy Statement and Marketing Consent
The Promoter is committed to protecting your Personal Information and agrees to be bound by the Privacy Act 1988 (Cth). The Promoter’s privacy policy is available on the website www.budgetdirect.com.au and further details of how the Promoter will collect, store, use and disclose personal information can be found there.
By entering the Promotion, entrants acknowledge that a further primary purpose for collection of the entrant’s Personal Information is to contact the entrant in the future with information about the Promoter, including special offers, market research or to provide marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
The Promoter will never sell an entrant’s Personal Information to other companies, however the Promoter may share an entrant’s Personal Information with its Australian and overseas related companies, promotional partners, servants, employees, agents and trusted third parties who may contact the entrant for their legitimate commercial purposes. By entering the Promotion, entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.
The Eligible Entrant agrees that, in the event they are an Eligible Winner, the Promoter may use their contact details for the purpose of facilitating the conduct of the Promotion and awarding any prize. The Eligible Entrant will participate in all reasonable promotional activities in relation to the Promotion, as requested by the Promoter and its agents. This may include the Eligible Winner’s name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media worldwide for whatever purpose and without notification, remuneration or compensation, for marketing and or promotional purposes, for an indefinite period.
General
The Promoter, its related entities, their officers and employers will not be liable for any loss or damage, whether direct, indirect or consequential which is suffered or sustained in connection with the Promotion, including through the use or operation of any prize, except to the extent of any liability which cannot be excluded by law (including any applicable consumer guarantee under the Australian Consumer Law).
If the Promotion cannot be conducted as intended for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or, if necessary, to provide an alternative prize to the same value as an original prize, subject to any written directions made under applicable State or Territory Legislation. The Promotor reserves the right or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw or cancel the Promotion at any time without notice.
The Promotor does not accept any responsibility whatsoever for any tax liability associated, connected with or arising from the Promotion, unless specified within these Terms and Conditions.
In these Terms and Conditions:
"Australian Consumer Law"
means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
"Personal Information"
means, for the purpose of the Privacy Act 1988 (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
