The promoter is Auto & General Services Pty Ltd ABN 61 003 617 909, AFSL 241 411 and Pet Health Insurance Services Pty Ltd ABN 59 638 910 675 (operating under the brand Budget Direct) of Level 13, Toowong Tower, 9 Sherwood Road, Toowong 4066 (Promoter) on behalf of the insurer, Auto & General Insurance Company Ltd ABN 42 111 586 353 (Insurer).
3. These Terms and Conditions apply to the promotion, “Your Pet Wins”. Customers will receive entries into the competition when they complete the online entry form on the Budget Direct website (see Eligibility and Participation section) (Promotion).
4. Information on how to enter and mechanics of entry and prizes form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
5. Subject to these Terms and Conditions, the Promoter is offering entrants the chance to win their choice of one of the following prizes (each a “Prize”):
    * Prize 1 - $500 PETstock gift card.
    * Prize 2 - 12 Month Olly’s Box subscription (valued at $588.00).
    * Prize 3 - $500 Pablo & Co gift card.
6. The Promotion will run for a total of three (3) months, each month a new winner will be selected from each Monthly Promotional Period (outlined in the table below). The total maximum prize pool is $1,764 – pending on the prize selected each month.

7.    19   Entries into each of the three (3) Monthly Promotion Periods will open at 11:00am (AEST) on the start date and finish at 11:00am (AEST) on the respective end date of each Monthly Promotional Period. For avoidance of doubt, entries in each Monthly Promotion Period will not automatically be entered into subsequent Monthly Promotion Periods. Entrants may enter each of the 3 Monthly Promotional Periods by following the Eligibility and Participation rules for each Monthly Promotional Period.
8. Eligibility and Participation
9. Customers must meet the following criteria to participate in the Promotion (Eligible Entrant):
    * Be 18 years or over and a permanent resident of Australia, or have resided in Australia continuously for six months or more on a temporary work visa at the time of participating in the Promotion; and
    * Not be an officer or employee of the Promotor or Insurer, its related entities or agents and service providers directly associated with the conduct of the Promotion, or their immediate family; and
    * During the Monthly Promotional Period, complete the online competition entry form located at www.budgetdirect.com.au/landingpages/pet-win providing responses to all questions.
10. Eligible Entrants will be awarded a maximum of one (1) entry per Monthly Promotional Period into the Promotion for completing page one of the online entry form.
11. An Entrant can win more than one Prize from the total Prize pool by entering into more than one (1) Monthly Promotional Period.
12. Any Eligible Entrant who provides incorrect, misleading or fraudulent information, or submits an entry that infringes any rights of any third party, or contravenes any law or is otherwise objectionable will render all entries submitted by that entrant invalid.
13. The Promoter may request the Eligible Entrant produce appropriate photo identification and other documentation to confirm, to the Promoter’s satisfaction, the Eligible Entrant’s eligibility to enter the Promotion and the validity of their entry, failing which all entries of that entrant will be deemed invalid.
14. Draw and Prizes
15. A total of three (3) monthly Prize draws will take place. There will be one Prize draw for each Monthly Promotional Period at 1:00pm (AEST) on the relevant Prize Draw Date (noted in the table below) at the Promoter’s Head Office at Level 13, Toowong Tower, 9 Sherwood Road, Toowong QLD 4066.

16.    40   A total of one (1) eligible winner will be selected on each relevant Prize Draw Date (Eligible Winner). Each Eligible Winner may select one Prize noted in clause 4 above.
17. The Eligible Winners will be notified via their nominated email address within two (2) business days of the applicable Prize Draw Date. The Eligible Winner’s name will be published on the Promoter’s website at www.budgetdirect.com.au/terms-conditions/pet-winners within twenty-one (21) days of the applicable Prize Draw Date and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken by the Promoter to notify the Eligible Winner.
18. The Promoter may draw five (5) additional reserve entries on each Prize Draw Date and record them (in order) in case of an invalid entry or the entrant is ineligible to accept the Prize. In the event of an invalid entry or an ineligible entrant, or if the entrant declines to accept a Prize, the Prize will be awarded to the first reserve entry drawn. If a Prize cannot be awarded to an entrant drawn, the Promoter will continue this process until the Prize is awarded. If after this process, a Prize has still not been awarded, or if an entrant drawn cannot be notified, the Promoter will hold an unclaimed prize draw (Unclaimed Prize Draw) in accordance with clause 17.
19. A Prize will be deemed unclaimed if the Promoter is not reasonably able to contact the Eligible Winner within three (3) months and one (1) day of the relevant Prize Draw Date via the contact details provided at the time of completing the competition entry form..
20. An Unclaimed Prize Draw will be held in order to distribute any Prizes that remain unclaimed, at the location in clause 12, subject to any written directions made under applicable State or Territory Legislation, at 1:00PM (AEST) on 3 June 2022.
21. Any Unclaimed Prize Draw winner(s) will be notified via their nominated email address, within two (2) business days of the Unclaimed Prize Draw or by 5 June 2022. The Unclaimed Prize Draw Eligible winner’s name will be published on the Promoter’s website at www.budgetdirect.com.au/terms-conditions/pet-winners on 4 June 2022, and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken to notify the winners of the Unclaimed Prize Draw.
22. Privacy Statement and Marketing Consent
23. The Promoter is committed to protecting your personal information and is bound by the Privacy Act 1988 (Cth). The Promoter's privacy policy is available on the website www.budgetdirect.com.au and further details of how the Promoter will collect, store, use and disclose personal information can be found there.
24. By entering the Promotion, entrants acknowledge that a further primary purpose for collection of the entrant’s Personal Information is to contact the entrant in the future with information about the Promoter, including special offers, market research or to provide marketing materials via any medium including mail, telephone and commercial electronic messages SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
25. The Promoter will never sell an entrant’s Personal Information to other companies, however the Promoter may share an entrant’s Personal Information with its Australian and overseas related companies, promotional partners, servants, employees, agents and trusted third parties who may contact the entrant for their legitimate commercial purposes. By entering the Promotion, entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.
26. The Eligible Entrant agrees that, in the event they are an Eligible Winner, the Promoter may use their contact details for the purpose of facilitating the conduct of the Promotion and awarding any Prize. The Eligible Entrant will participate in all reasonable promotional activities in relation to the Promotion, as requested by the Promoter and its agents. This may include the Eligible Winner’s name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media worldwide for whatever purpose and without notification, remuneration or compensation, for marketing and or promotional purposes, for an indefinite period.
27. General
28. The Promoter reserves the right to disqualify any person from receiving the Prize if any of the following occurs:
    * If it suspects fraudulent activity; or
    * for a breach of these Terms and Conditions; or
    * if it decides the person has not acted in good faith; or
    * for any false or misleading conduct of any kind.
29. The Prizes are not reloadable, transferable or exchangeable and cannot be taken as cash. If a gift card or receipt of it incurs a tax liability, the relevant recipient of the gift card is liable for payment of such tax.
30. The issuers of the PETstock gift cards are not a part of the Promoter. Gift cards are issued by PETstock Pty Ltd ACN 098 394 588 (PETstock) and are subject to PETstock’s terms of use published at https://www.petstock.com.au/help/terms. The Promoter is not responsible for, or liable in respect of, products and services provided by PETStock.
31. The issuers of the Pablo & Co Gift Cards are not a part of the Promoter. Gift Cards are issued by Pablo & Co ABN 50 393 538 026, and maybe subject to any relevant terms and conditions of use made available from Pablo & Co.. The Promoter is not responsible for, or liable in respect of, products and services provided by Pablo & Co.
32. The issuers of the Olly’s Box 12 month subscription are not a part of the Promoter. Subscriptions are issued by Woof & Co Pty Ltd ACN 614 813 526 (t/as “Olly’s Box”) and maybe subject to any relevant terms and conditions of use made available by Olly’s Box. The Promoter is not responsible for, or liable in respect of, products and services provided by Olly’s Box.
33. Prize winners will receive an email from the Promotor within twenty-eight (28) days of the respective Prize Draw Date for details and instructions on how to redeem their Prize.
34. The Promoter, its related entities, their officers and employers will not be liable for any loss or damage, whether direct, indirect or consequential which is suffered or sustained in connection with the Promotion, including through the use or operation of any Prize, except to the extent of any liability which cannot be excluded by law (including any applicable consumer guarantee under the Australian Consumer Law).
35. If the Promotion cannot be conducted as intended for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or, if necessary, to provide an alternative Prize to the same value as an original Prize, subject to any written directions made under applicable State or Territory Legislation. The Promotor reserves the right or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw or cancel the Promotion at any time without notice.
36. If the offer of the Prize is withdrawn or the Promotion is terminated by the Promoter, you will only be eligible to participate if you were an Eligible Participant who entered into the Promotion prior to the date of withdrawal or termination of the Promotion.
37. The Promotor does not accept any responsibility whatsoever for any tax liability associated, connected with or arising from the Promotion, unless specified within these Terms and Conditions.
38. In these Terms and Conditions: "Australian Consumer Law"means Schedule 2 of the Competition and Consumer Act 2010 (Cth). "Personal Information"has the meaning given to it by the Privacy Act 1988 (Cth).
