Terms: By entering the "Win 1 of 4 $1,000 IKEA Gift Cards" (Promotion), you acknowledge that you have read and understand these Terms & Conditions (Terms) and that your entry in the Promotion is deemed to be an acceptance of these Terms. Information and material used to market the Promotion or to explain how to enter the Promotion forms part of these Terms (except that, if there is an inconsistency between that information and material and these Terms, these Terms prevail). This is a game of skill and chance plays no part in determining the winners. 2. Promoter: The Promoter is IKEA Pty Limited (ABN 84 006 270 757) of 630 Princes Highway, Tempe NSW 2044 (Promoter). 3. Eligible Participant: Entry is open to Australian residents who are: (a) 18 years of age or over; and (b) not directors, management, contractors and employees of the Promoter and its related companies. Whilst directors, management, contractors or employees of the Promoter cannot enter, their immediate family are eligible to enter if they satisfy the criteria in this paragraph 3. 4. Promotion Period: The Promotion commences at 09.00am (Sydney Time) on Wednesday, 22 March 2023 and closes at 09.00pm (Sydney Time) on Wednesday, 12 April 2023 5. Entry process: To enter the Promotion, an Eligible Participant must, during the Promotion Period: (a) sign up to become an IKEA Family member or have an existing IKEA Family membership; (b) share a photo of an IKEA product which brings happiness to their home and in 25 words or less, explain why. (c) ensure that the entry otherwise complies with these Terms, (referred to as an Entry). 6. Entrant: Each Eligible Participant who submits an Entry in accordance with paragraph 5 is an Entrant in the Promotion. 7. Verification and disqualification: Any entry not complying with these Terms is invalid. The Promoter reserve the right, in its sole discretion to: (a) deem invalid any Entry that is otherwise incomprehensible, offensive or incomplete, or which includes defamatory, insulting, inflammatory, objectionable or profane material, or which breaches any law, or which does not comply with these Terms; (b) verify that each entry is a valid Entry; and (c) disqualify any entry that is not a valid Entry. A failure by the Promoter to exercise its rights under this paragraph 7 does not constitute a waiver of these rights. 8. Selection Criteria: The 4 most creative and interesting entries as determined by the judges in their sole discretion will win the Prize (Decision). 2 9. Judging: Judging of all Entries received during the Promotion Period will take place from 3pm (Sydney Time) on Tuesday, 18 April 2023 (Judging Date) at 630 Princes Highway, Tempe NSW 2044. 10. Judging process: Judging will be conducted on the Judging Date by two members of the Marketing team. The judges will assess all Entries received during the Promotion Period against the Selection Criteria and make the Decision. The judges' Decision in relation to any aspect of this Promotion is final and binding on the Entrant and is not subject to appeal, review or redetermination. This is a game of skill and chance plays no part in determining the winners. 11. Prize: Each Prize in the Promotion is an IKEA e-gift card valued at $1,000 (Prize). There are for Prizes in total, and so the total prize pool is valued at $4,000. Additional terms and conditions apply to the use of IKEA Gift Cards (viewable here). 12. Notification: The Prize winners will be notified by email to the account which they used to enter the Promotion (Notification). If the Entrant's contact details change, the Entrant must notify the Promoter prior to the Judging Date. The Notification will be sent within 5 business days of the Judging Date. 13. Publication: The winner’s details will be published on IKEA.com.au from Wednesday, 26 April 2023 for 24 hours. 14. Delivery of Prize: The Prize winners will be asked to provide their email address upon Notification, and may also request proof of identity, proof of age and/or proof of residency. The Promoter will send the Prize after all such details are provided to the email address provided. 15. Unclaimed Prizes: If a Prize winner fails to respond to the Promoter's Notification, or fails to provide an email address and other proof of identity, proof of age and/or proof of residency as requested by the Promoter, within 7 days of Notification, the Prize winner will forfeit the Prize. The Promoter will re-assess the Entries received during the Promotion Period against the Selection Criteria and make the Decision again to select another winner. For the avoidance of doubt, the new Judging Date will be at 3pm (Sydney Time) on Thursday, 4 May 2023. The Promoter will follow the same judging process and notification process as set out in paragraphs 10 and 12 respectively. 16. Not transferrable or convertible to cash: The Prize is not transferable and cannot be taken, refunded, exchanged or transferred as cash. 17. No compensation: The Prize must be taken as described and no compensation will be payable if the winner is unable to use the Prize or if the Prize does not operate as the Entrant expected. 18. No Representations: To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied by statute, custom or the common law are excluded from the Promotion and these Terms. If any supply under these Terms is a supply of goods or services to a consumer within the meaning of the Australian Consumer Law, nothing contained in these Terms excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law, provided that, to the extent that the Australian Consumer Law permits the Promoter to limit its liability, then the Promoter's liability will be limited to: (i) in the case of services, the cost of supplying the services again or payment of the cost of having the services supplied again; and (ii) in the case of goods, the cost of replacing the goods, supplying equivalent goods or having the goods repaired, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired. 3 19. Limitation of Liability: Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity or profit); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms; (e) any tax liability incurred by the winner or Entrant; or (f) use of the prize. 20. Tax: Any tax liability arising as a result of accepting the Prize is the responsibility of the winner. 21. Final decision: The Promoter’s Decision is final and no correspondence will be entered into with any person in relation to any disputes about the Promoter's Decision as to the winner. 22. Licence to publication and marketing: The winner agrees that the Promoter may use their personal information and their user-generated content for the Promotion (including words, images, illustrations, photographs, data, information) for publicity, promotional, marketing, communication, research, profiling or commercial purposes, without compensation. For the avoidance of doubt, the Promoter may redesign, archive, reproduce, disseminate, display, publicly perform and/or replay and make publicly accessible, as well as to cut and edit, adapt and modify the content or any part of it in all formats on all Promoter or its related entities mobile applications, websites, social media or other marketing channels. 23. Force majeure: If for any reason this Promotion is not capable of running as planned (whether caused by infection by computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion), the Promoter reserves the right in its sole discretion and subject to any written direction given by a relevant regulatory authority, to cancel, terminate, modify or suspend the Promotion and no compensation will be payable to the Eligible Participant. 24. Personal Information and Privacy: The Promoter collects personal information (including each winning Entrant’s contact details to arrange delivery of the Prize) in order to conduct the Promotion and may for this purpose: (a) send electronic messages or telephoning the Entrant; (b) disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers; (c) disclose to Australian regulatory authorities as required; (d) disclose such information to State and Territory lottery departments; and/or (e) publish such information on any media.
