TERMS AND CONDITIONS:
In these Terms and Conditions, the following words have these meanings, unless the context otherwise requires:
“Budget Direct Life Policy” means Budget Direct Life Insurance, Income Protection Insurance, Total Permanent Disability Insurance or Trauma Insurance Cover issued by NobleOak Life Limited.
“Commencement Date” means 1 June 2023.
“Draw Date” means 3 August 2023.
“End Date” means 31 July 2023.
“Gift Card Supplier” means Digital Glue Australia Pty Limited ABN 36 127 466 899.
“Gift Card Value” means $1,000 AUD.
“Unclaimed Draw Date” means 12 December 2023.
The promoter is Auto & General Services Pty Ltd (ABN 61 003 617 909), AFSL 241 411 (operating under the brand Budget Direct) of Level 13, Toowong Tower, 9 Sherwood Road, Toowong 4066 (Promoter).
Subject to these Terms and Conditions the Promoter is offering customers a chance to win one (1) digital gift card valued at the Gift Card Value (Gift Card) when they get a quote for a Budget Direct Life Policy as set out under the heading “Eligibility and Participation” (Promotion).
Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
The Promotion commences at 12:01am AEST on the Commencement Date and ends at 11:59pm AEST on the End Date (Promotion Period).
Eligibility and Participation
In order to enter the Promotion, the customer must meet all of the following criteria (Eligible Participant):
During the Promotion Period, get a quote for a Budget Direct Life Insurance, Income Protection Insurance, Total Permanent Disability Insurance or Trauma Insurance Policy online via the Budget Direct website or via telephone by calling 1300 220 627;
be an Australian resident aged 16 or over at time of entry;
provide a valid email address, full name and residential address;
not be an officer or employee of the Promoter, its related bodies corporate, or their immediate family; and
not be an officer or employee of any agents or service providers of the Promoter directly associated with the conduct of the Promotion, or their immediate family.
For avoidance of doubt, persons who obtains a quote for a Budget Direct Life Policy via third party aggregation platforms such as Compare the Market or iSelect are ineligible to participate in the Promotion.
Each Eligible Participant will be awarded a maximum of one (1) entry into the Promotion for completing a quote in the Promotion Period. Additional entries will not be awarded for additional quotes completed in the Promotion Period.
The Gift Card draw will take place at 9 Sherwood Road, Toowong Brisbane 4006 (Draw Location) at 10.30am (AEST) on the Draw Date.
The total maximum prize pool for the Promotion is the Gift Card Value. A total of one (1) Eligible Participant, who has provided evidence of their eligibility and the validity of their entry, upon request, to the reasonable satisfaction of the Promoter (Eligible Winner) will be selected on the Draw Date or Unclaimed Draw Date, as is relevant.
The Eligible Winner will be notified via their nominated email address within two (2) business days of the Draw Date. The Eligible Winner’s name will be published on the terms and conditions page of the Promoter’s website within 28 days of the Draw Date and will remain on the Promoter’s website for no less than 28 days. All reasonable steps will be taken by the Promotor to notify the Eligible Winner.
The Gift Card will be deemed unclaimed if the Promoter is not reasonably able to contact the Eligible Winner within three (3) months and one (1) day of the relevant Draw Date via the Eligible Winner’s contact details provided at the time of entry into the Promotion.
If the Gift Card remains unclaimed, an unclaimed prize draw (Unclaimed Gift Card Draw) will be held at the Draw Location, by no later than Unclaimed Draw Date, subject to any written directions made under applicable State or Territory Legislation.
The Unclaimed Gift Card Draw Eligible Winner will be notified via their nominated email address within two (2) business days of the Unclaimed Draw Date. The Unclaimed Gift Card Draw Eligible Winner’s name will be published on the terms and conditions page of the Promoter’s website following the draw and will remain on the Promoter’s website for no less than twenty-eight (28) days.
The Eligible Winner, or Unclaimed Gift Card Draw Eligible Winner, will receive an email with a link to access their Gift Card within twenty-eight (28) days of the Draw Date or Unclaimed Draw Date from the Gift Card Supplier who operates the redemption website. Each Eligible Winner, or Unclaimed Gift Card Draw Eligible Winner, will then be required to follow the instructions contained in the email and on the website of the Gift Card Supplier for the redemption of the Gift Card.
Privacy Statement and Marketing Consent
The Promoter is committed to protecting the privacy of individuals and their personal information pursuant to the Privacy Act 1988 (Cth) (Privacy Act).
Please read this statement carefully as it will have important consequences for the Eligible Participant in relation to the collection, use and disclosure of a customer’s personal information provided to the Promoter.
The customer understands that:
The Promoter is the party who is collecting your personal information and can be contacted at privacyquery@autogeneral.com.au or alternatively, you can write to the Promoter at PO Box 342 Toowong Qld 4066.
The purpose of the Promoter collecting the customer’s personal information is to:
process and validate a claim for the Gift card;
arrange delivery of the Gift card (if eligible);
contact customers in the future with information about the Promoter, including special offers and market research; and
provide marketing materials via any medium including mail or any other form of non-real time electronic, emerging, digital, or conventional communications channel whether existing now or in the future.
If the Promoter is unable to collect the personal information in connection with the above, then customers will not be eligible to enter the competition and/or the Promoter will be unable to facilitate delivery of the Gift card.
Your personal information may be disclosed to the following classes of people and organisations in connection with the purposes above:
Gift Card Supplier; and
the Promoter’s personnel, related bodies corporate, related bodies corporate personnel, service providers and marketing partners.
It is possible that some of the people and organisations above may be located outside of Australia. You consent to your information being disclosed to a destination outside of Australia for this purpose, including but not limited to Japan, Philippines, Singapore, South Africa, United Kingdom, Canada, Israel, and the United States of America and you understand and acknowledge that Australian Privacy Principal 8.1 will not apply to such disclosures of your personal information.
The Promoter’s privacy policy sets out the process as to how you can access and correct any of your personal information collected under this form as well as how you can make a complaint if the Provider has breached the Privacy Act in the handling of your personal information. The Promoter’s privacy policy is available at www.budgetdirect.com.au or can otherwise be provided by requesting a copy from the Promoter.
General
This Promotion is not available in conjunction with any other promotion or offer, and the Promoter reserves the right to disqualify any person from receiving the Gift Card if any of the following occurs:
If it suspects fraudulent activity; or
for a breach of these Terms and Conditions; or
if it decides the person has not acted in good faith; or
for any false or misleading conduct of any kind.
The Gift Card is not refundable, reloadable, transferable or exchangeable and cannot be taken as cash. Expired Gift Cards cannot be extended or replaced. If a Gift Card or receipt of it incurs a tax liability, the relevant recipient of the Gift Card is liable for payment of such tax.
Terms and Conditions of the individual gift card will be printed on the reward itself and/or be made available on the Gift Card Supplier's website. Check the Gift Card for usage instructions and expiry date.
The redemption website is operated and hosted by the Gift Card Supplier.  The Promoter is not responsible for, or liable in respect of, products and services provided by the Gift Card Supplier.
The Promoter reserves the right in its sole discretion, subject to any required consent from a regulatory authority, to modify, suspend, terminate, withdraw, or cancel the Promotion at any time without notice. The Terms and Conditions may be varied at any time without notice.
The Promoter reserves the right to request that an Eligible Participant provides supporting documentary evidence of their identity (e.g. driver’s licence, passport, birth certificate). If the Eligible Participant fails to do so, or the Promoter determines the policy does not meet the eligibility criteria of the offer, the Eligible Participant will not be eligible for the Gift Card.
The Promoter (including their officers, employees and agents) will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) including any theft, unauthorised access, third party interference, any technical difficulties or equipment malfunction, or personal injury (including loss of opportunity) suffered or sustained in connection with the Promotion, or the receipt, acceptance, or use of the Gift Card (whether negligent or not), except for any liability that cannot be excluded by law.
The Promoter reserves the right to substitute the Gift Card with another incentive of the same value.
