Outback Equipment Boat Giveaway Terms and Conditions

1. Promotion Description: This promotion is sponsored by Outback Equipment (the “Sponsor”). The promotion begins on 1st June 2023 and ends at midnight on the 30th June 2023 (the "Promotion Period") (Time zone Brisbane, Australia). By participating in the Promotion, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects.

2. Eligibility: This Promotion is open only to those who are 18 years of age or older as of the date of entry and fill out the form on the Outback Equipment website accurately. The promotion is open to legal residents of Australia and is void where prohibited by law. Employees of Outback Equipment, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Promotion.

3. Entry: To enter the Promotion, participants must complete the online form available on the Outback Equipment website. Additional entries can be earned by making a purchase on the Outback Equipment website during the Promotion Period. Incomplete or inaccurate entries will be disqualified.

4. Prizes: The Winner of the Promotion (the “Winner”) will receive a 4.2m Bluefin Rogue Aluminum Boat, a selection of Boating & Fishing accessories, and a selection of alcoholic beverages from “Your Mates Brewing Co.”. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution shall be permitted except at Sponsor’s discretion. The prize is non-transferable.

5. Ownership Transfer: Ownership of the boat & trailer will be transferred to the Winner. Outback Equipment will cover any transfer of ownership/registration fees when the winner is collecting their prize.

6. Winner Selection and Notification: Winner will be selected by a random drawing under the supervision of the Sponsor. Winner will be notified by email within five (5) days following selection of Winner. Sponsor shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information.

7. Collection of prizes: The winner of the competition will be required to collect the winnings (prizes) from Outback Equipment 1 Murdoch Cct, Acacia Ridge QLD 4110 within 90 days of the conclusion of the competition time frame. Outback Equipment will not be liable for any transport or delivery costs of the prize to the winner. At the time of collection, the winner will be required to have photographs & video content created of them collecting the prizes.

8. Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that Sponsor, anyone acting on behalf of Sponsor, and Sponsor’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Promotion, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent.

9. Terms & Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Promotion. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Terms & Conditions. Outback Equipment reserve the right to update or change the terms of this giveaway at any point.

10. Limitation of Liability: By entering, You agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Promotion; (ii) such entrant’s acceptance, possession, use, or misuse of any prize or any portion thereof; (iii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, software, or other mechanical equipment; (iv) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (v) unauthorized human intervention in any part of the entry process or the Promotion; or (vi) electronic or human error in the administration of the Promotion or the processing of entries.

11. Disputes: This Promotion is governed by the laws of the location of the Sponsor without respect to conflict of law doctrines. As a condition of participating in this Promotion, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the location of the Sponsor having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Promotion). Participant further waives all rights to have damages multiplied or increased.

13. Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Outback Equipment, 1 Murdoch Cct, Acacia Ridge QLD 4110. Requests must be received no later than 01/09/2023.

14. Sponsor: The Sponsor of the Promotion is Outback Equipment, 1 Murdoch Cct, Acacia Ridge QLD 4110. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn or any other social networks that are used to share this Promotion. You understand that you are providing your information to the Sponsor and not to these social networks.
