Competition Period

12.01am (AEST) on 14/06/2023 to 11.59pm (AEST) on 26/07/2023.

Who can enter?

Only Australian residents who:

are aged 18 years or over; and

if are a winner of the major prize, can take the major prize in Sydney NSW on dates specified and determined by the Promoter within the month of September 2023 (as notified in advance by the Promoter with reasonable notice).

Who can't enter?

Directors, officers, management, employees and contractors (and their immediate families) of:

the Promoter; and

the agencies, companies or participating premises associated with this competition.

Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Where will the competition run?

The competition will run in all stores in Australia that stock and sell Cadbury Favourites packs (Store), including purchases made online from such Stores.

Entry instructions

There are 2 ways you can enter the competition, as set out below.

1) Entry Method 1 ( select stores only )

You must, during the Competition Period:

scan the QR code shown on select promotional material that is displayed in select Stores only to be directed to an online form;

confirm you are aged 18 years or over and provide and submit your mobile number and email address to receive an email from the Promoter containing a unique link (Promo Email);

you then need to make a Qualifying Purchase from a Store and collect your itemised purchase receipt; and

click on the unique link contained in the Promo Email to fill out and submit the online entry form including by uploading an image of the Qualifying Purchase receipt, and providing all other requested information to:

claim either

a $5 Woolworths Supermarket e-Gift Card (if your purchase was made at a participating Woolworths supermarket in Australia or Woolworths Metro store in Australia (excluding Ampol, Woolworths MetroGo, Metro60 and purchases via Everyday market and Woolworths Online). Woolworths Group Ltd (ABN 88 000 014 675) is the issuer of the Woolworths Supermarkets e-Gift Card, but is not the promoter of this offer, nor responsible for fulfillment of the offer terms. Woolworths Supermarkets e-Gift Cards are redeemable at participating stores only. For a list of participating stores and full Gift Card Terms and Conditions visit woolworths.com.au/giftcards. to see if you have provisionally won an instant win prize and to receive 1 entry into the major prize draw.

If you enter following the steps outlined in Entry Method 1 above, you will qualify to receive a Gift, subject to validation, and you will also have a chance to win an instant win prize and will be entered into the major prize draw.

Max 1 Gift per person only for the entire competition.

For clarity a Digital Vault Pays-enabled Prepaid Mastercard® will be your Gift if your purchase was not made at a participating Woolworths supermarket or Woolworths Metro store.

You must complete the steps in Entry Method 1 in the exact order as specified above, to qualify for a Gift. For example, if you do not scan the QR code before you make a Qualifying Purchase, you will not qualify for a Gift. Successful Gift recipients will be verified and notified within 7 business days of submitting their entry.

2) Entry Method 2

You must, during the Competition Period:

make a Qualifying Purchase from a Store and collect your itemised purchase receipt;

visit the Website and fully complete the online entry form, including by uploading an image of the Qualifying Purchase receipt and providing all other requested information to see if you have provisionally won an instant win prize and to receive 1 entry into the major prize draw.

If you enter following the steps outlined in Entry Method 2, you will have a chance to win an instant win prize and will be entered into the major prize draw. For the avoidance of doubt, if you enter via Entry Method 2, you will not qualify to receive a Gift.

For both Entry Method 1 and Entry Method 2, your purchase receipt must clearly identify where the Qualifying Purchase was made, the product/s purchased (which must be/comprise a Qualifying Purchase) and the date and time of purchase (which must be during the Competition Period). For the avoidance of doubt, if you are entering via Entry Method 2, your purchase must have been made before you submitted your entry).

The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting an entry, including having the requisite photograph capability.

How are instant win prize/s awarded?

There are 430 instant win prize/s (10 per day during the Competition Period) to be awarded based on pre-determined times selected by a computerised random system at Pilgrim Communications, 23 Norton Street, Suite 51A, Leichhardt, NSW 2040 (Pilgrim).

Each day during the Competition Period, the first valid entry received on or after the pre determined times for that day will win an instant win prize, subject to validation.

All instant win prize winners will be included in the major draw.

How many winners will there be and how will they be chosen?

There will be in total 442 winners determined in respect of this competition – 430 instant win prize winners and 12 major winners.

There will be 1 major draw conducted.

The major draw will be held at 12.00pm (AEST) on 31/07/2023 at Pilgrim.

The first 12 valid entries drawn randomly from the entries received during the Competition Period (including instant win prize winning entries) will win each win the major prize.

The Promoter may draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants).

What can I win?

There are in total 442 prizes available – 430 instant win prizes and 12 major prizes.

Instant win prizes

Each instant win prize is a $100 Digital Vault Pays-enabled prepaid Mastercard®. See also clause 4.

Major prize

Each major prize is a Foosball game experience in Sydney NSW, in September 2023 (exact dates to be confirmed by the Promoter) where the winner will participate in a Giant (life size) Foosball game. Each major prize is valued at up to $1,500 depending on the winner's point of departure, and includes:

return economy airfares (including airfare taxes) valued up to $1,000 from your nearest Australian capital city to Sydney, NSW and return transfers between Sydney airport and the accommodation (flights and transfers are not included if you live in Sydney, and if so, you must make your own way to and from the hotel at your own cost. If you live in NSW, depending on your exact location, the Promoter may provide flights and transfers to Sydney, as appropriate);

1 night accommodation in a minimum 3 star hotel in Sydney (as determined by the Promoter) valued at up to $500; and

an opportunity to take part in a life size, giant Foosball game in Sydney to win a monetary prize. See 'Giant Foosball Game' section below for details.

Max 1 major prize per person (excluding SA residents).

The major prize is subject to any applicable law or guidelines including in relation to a pandemic, any travel/government restrictions/directives, border closures, health advice and the like.

Giant Foosball Game

Each major prize winner will have an opportunity to take part in the Promoter's Giant Foosball game in Sydney.

The 12 major prize winners will form 2 teams, with 6 players in each team. The teams will be as determined by the Promoter.

To play in the Giant Foosball game you must follow and agree to the Promoter’s instructions and full game rules (which will be provided to you for signing before the game event) including wearing any promotional items and or sporting/safety equipment as required by the Promoter. To play in the Giant Foosball game you will be required to sign a Disclaimer and Release Form prior to being allowed to play. You must not engage in unsportsmanlike conduct or interfere with other players (e.g. by making any contact with or distracting another player or acting in any manner which the Promoter considers reckless or inappropriate). You must not consume any alcohol, before competing in the game, and you must not use any performance enhancing device or drug. The Promoter may disqualify any player who fails to comply with the Promoter’s instructions, the game rules or these Terms and Conditions.


If you do not wish to take part in the game or cannot participate in the game for any reason, you may either:

at the time of being notified a winner, nominate a proxy to take the trip and your spot to participate in the game on your behalf. You must nominate a suitable proxy within the timeframe specified by the Promoter. If you nominate a proxy, you accept all decisions made by the proxy. For the purposes of these Terms and Conditions, all references to a major prize winner will also be deemed to apply to that winner's proxy, if relevant. The proxy must:

be aged 18 years or over and be able to take the major prize on the dates specified;

accept and agree to be bound by these Terms and Conditions and any additional conditions provided by the Promoter or prize supplier/s and must sign any document the Promoter requires for this purpose; and

accept that they will not receive or be entitled to any prize (other than the trip to Sydney, if applicable).

OR

at the time of accepting the prize, request that a representative from the Promoter or the Promoter's agency (as nominated by the Promoter) step in and play on your behalf. If you request for a representative to play on your behalf in the game, you accept all decisions made by the proxy. You may also choose whether or not you wish to take the trip to Sydney and attend the game. If you choose not to take the trip to Sydney and attend the game, you will forfeit this element of the prize (being the airfares, accommodation and opportunity to take party in a foosball game) and you will not be provided with any alternative prize or cash as a substitute, but you will still be entitled to any cash prize arising from the outcome of the game (as described below).

The Promoter may, in extenuating circumstances (and in its absolute discretion) provide a stand-in for a major prize winner/proxy in the game at any point before or during the game, in which case the stand-in will be a representative of the Promoter (as selected by the Promoter) who will play on that major prize winner's/proxy's behalf (and win for that relevant major prize winner any prize arising from the outcome of the game).

At the end of the game, the players in the winning team will each win $3,000, and the players in the losing team will each win $2,000. If at the end of the official full game the game if tied, the game will continue to be played until a clear winning team can be declared by the game referee/judges. All decisions of the referee/judges at the event are final.

Prize money in the game will be awarded to the major prize winners via bank transfer to their AU bank account. The major prize winners must ensure that they provide their correct AU bank account details to the Promoter. The Promoter is not liable if bank details are incorrect.

Total prize pool

The instant win prize pool is valued at $43,000.

The major prize pool is valued at up to $18,000.

The total prize pool money (awarded to major prize winners) in the Foosball Game is $30,000.

The overall total prize pool is up to $91,000.

How many times can I enter?

You can only enter once per day, and up to a maximum of 6 entries in total per household. Each entry must be based on a separate Qualifying Purchase and a separate receipt. Each entry must be submitted separately in accordance with these Terms and Conditions.

How and when will the winner/s be informed?

The major prize winners will be told by phone and by email within 5 business days of the draw, and their name and postcode of residence will be published on the Website on 08/08/2023 for a period of 28 days.

Instant win prize winners will be told on screen (at the time of entering) if they have provisionally won a prize and if so, will be issued their prize subject to entry validation. Allow 7 business days for validation.

Proof of purchase

You must keep your original itemised purchase receipt(s) as proof of purchase for all entries.

If you don't produce the above proof of purchase for all entries when asked the Promoter may disqualify all of your entries and you will lose any right to a prize.

Proof of purchase must be identical to that provided by you with your entry.

If, in the Promoter's opinion, you have shared any proof of purchase with another person, your entries will be invalid and you will lose any right to a prize.

Unclaimed prize/s

Prize claim date: 5pm (AEST) on 16/08/2023.

Unclaimed prize determination: 12pm (AEST) on 17/08/2023 at the same location as the original draw.

If any instant win prize or any major prize has not been won, accepted or claimed by the prize claim date above or if, after making all reasonable attempts, the Promoter can't contact a winner (or a winner does not contact the Promoter) by the prize claim date above, the relevant entry/ies will be discarded and the Promoter will re-award the relevant prize/s to Reserve Entrant/s and/or carry out an unclaimed prize draw at the date, time and place stated above to randomly distribute the prize/s in descending order of value amongst valid entrants who (if possible) have not already won an unclaimed prize. Any winner/s will be informed by phone and by email within 5 business days of determination and in the event of any major prize winners, they will also have their name and postcode published on the Website on 24/08/2023 for a period of 28 days.

If any prize remains un-won at the end of this competition, or if a prize winner cannot be found, that information will be published on the Website on 22/09/2023.

Collection and use of your personal information

If you are a major prize winner, a proxy, or a substitute player for a winner (if applicable), you must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You consent to the Promoter using your name and image in any promotional or advertising activity.

The Promoter may collect your personal information directly or through its agents or contractors. The Promoter will use your personal information to conduct and manage the competition. The Promoter may disclose your personal information to its related companies, agents and contractors to assist in conducting this competition, communicating with you or storing data. This may include disclosures to organisations outside Australia including in places such as New Zealand, Switzerland, Singapore, United Kingdom and the United States of America.

By entering or accepting to be a proxy or susbstitue player for a winner (if applicable), you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging provided that where required by the Spam Act 2003 (Cth), the Promoter includes a functional unsubscribe facility in each direct marketing communication it sends you that you may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth). By entering or accepting to be a proxy or susbstitue player for a winner (if applicable), you consent to receive email or SMS messages from the Promoter without any functional unsubscribe facility if they relate primarily to the conduct of this competition.

how to seek access to the personal information the Promoter holds about you and seek correction of the information; and

1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.

Entry

2. Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter. If you return a Qualifying Purchase your entry may be deemed invalid at the Promoter's discretion (unless the product is defective). You will receive a return message confirming your entry. The Promoter is not liable for any problems with communications networks and spam filters. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.

Prizes

3. Prizes and all elements of prizes must be taken as specified, as and when offered and cannot be altered or changed in any way by you or will be forfeited, and if forfeited, the Promoter will not be liable. If you forfeit the prize or any element of the prize for whatever reason, you will not be given cash or any alternative prize as a substitute. Prize/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, as relevant:

validity period/s;

booking and availability of flights, accommodation and events;

conditions of travel and conditions of entry into any event venues (including behaviour requirements, COVID safety requirements and applicable dress codes);

conditions of ticket validity and any restrictions on ticket on-sale or transfer;

travel dates and specified travel exclusion periods;

any additional fees (payable by you) relating to changes made by you/your companion to a travel/event prize after it has been booked; and

a requirement to present your credit card when checking in to accommodation.

4. Any ancillary costs associated with redeeming the digital Vault Pays-enabled Prepaid Mastercard are not included. The digital Vault Pays-enabled Prepaid Mastercard must be activated within 2 months of issue and is valid for 12 months after activation. At expiry of the digital Vault Pays-enabled Mastercard any unused balance will be forfeited and you will not be given notice prior to expiry. Card expiry and balance can be found on your mobile device in your digital wallet. The digital Vault Pays-enabled Prepaid Mastercard is issued by EML Payment Solutions Limited (ABN 30 131 436 532) AFSL 404131 pursuant to license by Mastercard. See www.vaultps.com.au/terms for terms and conditions. Mastercard and the circles design are registered trademarks of Mastercard International Incorporated. Upon verification, the digital Vault Pays-enabled Prepaid Mastercard will be sent to the winners by SMS (to the mobile phone number specified on the winner's entry form). Winners then need to activate the card using the Vault app – activation code will be provided in SMS. Once activated, the card can be added to the winner's phone’s digital wallet (e.g. Apple Pay, Google Pay or Samsung Pay) and can be used for purchasing goods and services where the card is accepted for electronic transactions (excluding transactions at ATMs or over the counter at financial institutions). The card cannot be used as a credit card and cannot be linked to any deposit account.

5. You are responsible for all other unspecified costs related to the prize, including meals, transport, insurance (including excesses), in-room charges, additional taxes, or costs associated with ongoing use of the prize, etc. Event tickets can only be used once and will be deemed invalid if copied. The Promoter does not control entry to the relevant event location. The winner/s must keep their tickets safe and the Promoter will not replace lost or stolen tickets.

6. The Promoter is not responsible for any dispute between you and any person (including a proxy or substitute player for a winner) with whom you choose to, or choose not to, share a prize.

7. The Promoter accepts no responsibility if one or more of the events or activities awarded as part of the prize are abandoned, called off or postponed for any reason. In that case you forfeit your entitlement to that event/activity. Similarly, while the Promoter will make all reasonable efforts to ensure the participation of any specified celebrity/ies in the prize element/s, the Promoter and prize suppliers exclude, so far as legally permissible, all liability if for any reason the celebrity/ies do not attend the prize element/s due to circumstances beyond the reasonable control of the Promoter and prize suppliers (e.g. illness). Unless otherwise specified by the Promoter, you will not be given cash or any alternative prize as a substitute for this altered prize element.

General

8. Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).

9. For event-based/travel prizes, you accept that some aspects of the prize may be inherently risky and that the prize may involve dangerous activities.

10. In order to participate in the activity/activities awarded as part of the major prize, you must comply with any applicable conditions (e.g. height, weight, health and fitness requirements). You must ensure that you are healthy and fit enough to take the major prize. You must follow all requirements of the people responsible for managing the relevant activity/ies.

11. You must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the major prize. If you do not sign, your entry will be deemed invalid and you will lose any entitlement to the major prize.

12. If you or your entry are deemed by the Promoter to breach these Terms and Conditions including if the prize is on set dates and you are unable to take the prize on the relevant date/s, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries and/or verifying your identity (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

13. You must not:

tamper with the entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the entry process);

engage in any conduct that may jeopardise the fair and proper conduct of the competition;

act in a disruptive, annoying, threatening, abusive or harassing manner;

do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;

breach any law; or

behave in a way that is otherwise inappropriate.

14. If you, in the opinion of the Promoter (and/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you from participating in any elements of the prize, at its discretion.

15. The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.

16. If any dispute arises between you and the Promoter concerning the conduct of this competition or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter’s decision in connection with all aspects of this competition is final.

17. Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.

18. By entering, you request that your full address not be published.

19. Printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid instant win prize claim. Every instant win prize claim in excess of the advertised prize pool will be honoured, unless the claim is rejected due to fraud or ineligibility under these Terms and Conditions.

20. If this competition cannot run as planned for any reason beyond the Promoter's control (for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, a pandemic, public health orders and the like), the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.

21. The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

Liability

22. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).

23. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).

24. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant). Unless otherwise specified, prize/s will only be delivered to addresses in Australia.

25. This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
