15 Ways to Enter


These Terms and Conditions (the “Terms”) apply to the “Alienware Laptop Giveaway” (the “Giveaway”) in connection with the game SYNCED.  Residents of Germany and France are excluded from participating in this Giveaway.
The Giveaway is conducted by Proxima Beta Pte. Limited with its contact address at 10 Anson Road #21-07, International Plaza, Singapore 079903 (“we”, “us”, “our”, as appropriate) and powered by third-party company Crowd9 PTY Ltd (referred to herein as “Gleam”) via the Gleam website at www.gleam.io (the “Gleam Website”).  The Giveaway can be found on the Gleam Website at the following URL: https://gleam.io/AGMOe/synced-laptop-giveaway-powered-by-alienware-global (the “Giveaway Page”)
Please note, whilst the Giveaway itself is governed by these Terms, your use of the Gleam Website may be subject to Gleam’s own terms and conditions and/or any privacy policy.
No purchase or payment of any money is necessary to enter. A purchase will not improve the chances of winning.
1.      Agreement to the Terms. By participating in the Giveaway, you accept and agree to be bound by these Terms, and any decision we make regarding the Giveaway, which we shall make at our sole discretion. To the extent there is any conflict between these Terms and any terms and conditions specified outside of this page in connection with this Giveaway, the relevant conflicting terms found on this page shall prevail.
2.      Eligibility. Save where prohibited by law, this Giveaway is open on a global basis excluding residents of France and Germany. Furthermore, to be eligible to participate in this Giveaway, you:
·        must be 18 years old or older
·      must have signed up to the Gleam Platform. Please note, the Gleam Website is not operated by us. You must only sign up if you accept Gleam’s website terms and conditions, as well as any applicable privacy policy.
·        must not be an employee of ours or a relative of any employee of ours.
3.      Additional Conditions to Participation.  Participation in the Giveaway constitutes an entrant's full and unconditional agreement to be subject to the Terms and to comply with all applicable laws. Entrants must comply with all applicable rules, terms and policies, etc. as provided by the relevant social media platforms. Without limiting the foregoing, we explicitly reserve the right to void or disqualify any entrant or entry if it believes in good faith any entrant or entry does not comply with the Terms.
4.      Event Period.  The Giveaway begins on approximately August 14 at 5PM CET and ends on August 28 at 5PM CET
5.     How to enter: To participate in the Giveaway, you must comply with the instructions as specified on the Giveaway Page.  The entry must fulfil all requirements of the Giveaway, as specified, to be eligible to win a Prize.  Entries that are incomplete or do not adhere to the rules or specifications of the Giveaway may be disqualified at our sole discretion. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices, in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Giveaway, your submission may be disqualified at our sole discretion.
6.      Prize(s).  The prize(s) for winning the Giveaway consists exclusively of:
·        Alienware and SYNCED custom laptop (Approximate retail value: EUR 3500)
(the “Prize”).
              Please note, any hardware forming part of the Prize shall be QWERTY language versions (to the extent applicable).
No substitution, assignment or transfer of the Prize is permitted, except by us, who have the right to substitute a Prize with another of comparable or greater value. TAXES AND ANY OTHER COSTS, IF ANY, RELATED TO THE PRIZE ARE THE RESPONSIBILITY OF THE WINNER. WINNER(S) MAY ALSO BE REQUIRED TO FURNISH PROOF OF IDENTITY, ADDRESS AND BIRTH DATE IN ORDER TO RECEIVE A PRIZE. Winner may be required at our sole discretion to complete relevant tax forms as a condition to the delivery of the applicable Prize.
7.      Winner selection and notification. We will select a total number of one (1) winner (the  “Winner”) by random draw under our supervision. The Winner will be notified within 10 days of selection and shall, within 14 days of such notification, be required to provide a mailing address for delivery of the Prize. We shall have no liability for the Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for the Winner’s provision of incorrect or otherwise non-functioning contact information.  If the Winner cannot be contacted, is ineligible, fails to claim the Prize within 14 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release (to the extent required), the Prize may be forfeited and an alternative Winner may be selected. Receipt of the Prize by the Winner is conditioned upon compliance with any and all federal, state and local laws and regulations. Any violation of these Terms may at our discretion result in Winner’s disqualification as Winner and all privileges as Winner will be immediately terminated.
8.      Prize Delivery. We will endeavor to deliver the Prize to the Winner within 60 days of receiving a valid mailing address, however, delivery times may be longer based on the Winner’s location.
9.      Personal Information Notice. By submitting your entries, you understand that we will process your name and email address, and any other information disclosed during your communications with us, pursuant to the Terms. In particular, we may also collect your name and email address, and residential address, to send you your Prize if you win, as these are necessary to perform our contract with you to deliver your Prize.  Note, we may arrange for delivery via a third party, in which case we may share your contact information and residential address with such party solely to fulfill delivery of your Prize. Please refer to the Privacy Notice in the Annex to learn how we process your Personal Data.
10.    Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our willful intent or negligence; (ii) fraud or fraudulent misrepresentation; (iii) damages caused by gross negligence or willful misconduct; (iv) liability for assuming a specific guarantee, and (v) any matter in respect of which it would be unlawful for us to exclude or restrict our liability, i.e. mandatory statutory liability.  Save for the foregoing our liability shall be limited as follows: we shall be liable only up to the amount of damages as typically foreseeable at the time of concluding the Terms in respect of damages caused by a slightly negligent breach of a material contractual obligation (i.e. a contractual duty the fulfilment of which is essential for the proper execution of the Terms, the breach of which endangers the purpose of the Terms and on the fulfillment of which you can regularly rely); and we shall not be liable for damages caused by a slightly negligent breach of a non-material contractual obligation. Unless otherwise explicitly provided under the Terms for the purpose of the Giveaway, you acknowledge and agree that we have no obligations related to your Gleam account or any social media account of yours, and your acts on Gleam or any social media platform shall be resolved exclusively by you and the relevant platform.
11.    General Provisions: If any provision of the Terms is held to be illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that the Terms otherwise remain in full force and effect and enforceable.  We reserve the right at our sole discretion to cancel, terminate, modify or suspend the Giveaway, including if for any reason it is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Giveaway.
12.    Governing Law.  These Terms and the Giveaway are governed by, and will be construed in accordance with, the laws of Singapore without reference to choice of law rules. Any dispute, controversy, difference or claim arising out of or relating to the Sweepstakes and Terms, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) under the Arbitration Rules of the SIAC in force at the time of delivery of the arbitration notice. The seat of this arbitration shall be Singapore. The arbitration proceeding shall be conducted in English. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
13.    No Affiliation with Social Media Channels. This Giveaway is in no way sponsored, endorsed or administered by, or associated with any social media platform, including without limitation, Twitter, Facebook, Instagram, YouTube.
14.    Translated Terms.  For accessibility purposes, we may have provided other language versions of these Terms.  Where there is any conflict between these Terms and the other language version(s), the English language version shall prevail. 
Annex: Privacy Notice
This Privacy Notice describes how we, Proxima Beta Pte. Limited, collect, use and disclose your Personal Data, as well as our legal bases for the processing. It also informs you about your rights in connection with your Personal Data, and other related information you need to know before you provide Personal Data to us.

‘Personal Data’ means any information relating to an identified or identifiable natural person (‘Data Subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
We will store your Personal Data (name, email address, mailing address, and any information disclosed during your communications with us,) for the purpose of performing the Giveaway as described in the Terms. The legal basis is the performance of a contract with you (Art. 6 para. 1 lit. b GDPR).
Only where necessary, we may share your data with third parties who act as service provider, companies within our corporate ground; regulators judicial authorities and law enforcement agencies, and other third parties for safety, security, or compliance with the law or third party that acquires all or substantially all of us or our business. You are not obliged to provide your Personal Data. However, if you do not provide your Personal Data, you may not be able to participate in the Giveaway.
We may onward transfer your Personal Data to entities located outside the European Economic Area. We will implement appropriate measures to ensure that third parties outside the European Economic Area, for which no adequacy decision exists, provide an adequate level of protection to your Personal Data as required by applicable law, e.g. by putting in place the EU Commission’s standard contractual clauses and supplementary measures. You can request a copy of these measures by contacting us under dpo@levelinfinite.com or the contact details set out in Section 1 of the Terms.
You have the following rights related to the processing of your Personal Data to the extent permitted by law:
•        Right to obtain from us confirmation as to whether or not we process your Personal Data and, where that is the case, access to the Personal Data and receive a copy of your Personal Data (Art. 15 GDPR);
•        Right of rectification of inaccurate Personal Data concerning you (Art. 16 GDPR);
•        Right to obtain from us the erasure of your Personal Data without undue delay (Art. 17 GDPR);
•        Right to obtain from us restriction of processing of your Personal Data (Art. 18 GDPR);
•        Right to receive your Personal Data, which you have provided to us, in a structured, commonly used and machine-readable format and to transmit it to another third party without hindrance from us (Art. 20 GDPR);
•        Right to object, on grounds relating to your particular situation, at any time to processing of your Personal which we process based on our legitimate interest or in the public interest, including profiling based on those provisions (Art. 21 GDPR).
Where the processing is based on your consent you have the right to with-draw your consent with effect for the future at any time. To exercise your rights please contact us under the above contact details. You may also file a complaint with the competent data protection authority.
We store your Personal Data until the end of the Giveaway. If you win, we will store your Personal Data until the settlement of the Giveaway. In certain cases, we may be legally obliged to store Personal Data for a longer period. We will delete such Personal Data as soon as the statutory retention period is expired.
