‘New Caledonian Tropical Holiday” competition Terms and Conditions

    By entering the ‘New Caledonian Tropical Holiday” competition (competition), you acknowledge that you have read these terms and conditions and that you agree to be bound by them.  Information on how to enter forms part of these terms and conditions.
    This competition is being run by Australia Pacific Airports (Melbourne) Pty Ltd ABN 62 076 999 114 of APAM Management Office, Level 2, Terminal 4, Melbourne Airport, Tullamarine, Victoria 3043 (Promoter), in partnership with Air Caledonie International t/as AirCalin ABN 76 002 678 382 (Partner).

WHO CAN ENTER?

    To be eligible to enter the competition you must:
        reside in Victoria, Australia;
        be over 18 years of age; and
    Employees, directors or officers of the Promoter, any companies or agencies associated with this competition, or their immediate families, are ineligible to enter.
    All entrants should be aware that there are various requirements relating to departure from Melbourne, arrival in New Caledonia and upon re-entry into Australia. It is the winning entrant’s responsibility to fully inform themselves of these requirements, and obtain up to date advice from the appropriate authorities.

HOW TO ENTER

    The competition period commences at 06:00am AEDT on 10 October 2023 and ends at 11:59pm AEDT on 31 October 2023 (competition period), and the Promoter reserves the right to extend the competition period or bring forward the competition end date at any time (subject to regulatory approval).
    To enter the competition, you must complete an online entry via www.melbourneairport.com.au/win during the competition period.
    To qualify for entry, you must enter all relevant details on the competition landing page above.
    No late entries will be accepted.  Incomplete or incoherent entries will be invalid. Entries into this competition are deemed to be received at the time they are received by the Promoter, not the time at which they are sent.
    A limit of one entry to the competition per person applies.
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, employer, and residency status/location) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process.  In the event a winning entrant cannot provide proof of eligibility to the reasonable satisfaction of the Promoter, the winner will forfeit the prize in whole and no substitute will be offered. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

PRIZE

    The prize consists of:
    2 x Return Aircalin Premium Economy Class seats from Melbourne to Noumea
    5 x nights at Chateau Royal Beach Resort & Spa in a standard suite with daily breakfast valued at $2,800
    Transfer for 2 persons from Noumea Airport to the hotel.
    Day trip for 2 persons to Amedee Island including boat transfers, buffet lunch, and activities.
    Laneway Duty Free gift voucher to the value of $200.
    Total value of the prize pool is $7,100.
    All travel must be completed by 31 August 2024.
    The winner and their guest must travel together.
    Travel insurance is not included in the prize and is a requirement for travel to New Caledonia.
    The prize values referred to above are as at the publishing date of these terms and conditions and are subject to the market exchange rate and taxes.
    The winning entrant is responsible for ensuring that they, and any person travelling with them, are available to travel and hold valid passports, and any travel documents required.
    The Promoter makes no representation as to the safety, conditions or other issues that may exist in transit or at any destination.
    If for any reason the winner does not travel (or redeem any part of the prize) after making a booking, then the prize (or that element of the prize) will be forfeited.
    The prize does not include any costs associated with redeeming the prize such as; car hire, public transport, food and drink, spending money, or any other personal expenses of and incidental to your use of the prize and/or participation in the competition.
    The prize will not be transferable to another person.
    No part of a prize is exchangeable or redeemable for cash or any other prize.
    Aircalin tickets are for Premium Economy travel only. Flight reservations must be made in advance and are subject to availability at the time of booking.
    Availability of the flight component of this prize cannot be guaranteed during peak periods including but not limited to the Christmas period, school holidays or special event periods. Block out dates apply for the accommodation component from 20th December 2023 until 7th January 2024.
    Accommodation must be booked in advance to confirm the reservation.
    The prize is not negotiable and is not eligible for mileage accrual for any Frequent Flyer Programs.
    If a prize is not available for any reason, the Promoter reserves the right to substitute the prize with another item of equal or greater value if the winner agrees in writing and subject to any approvals from regulatory authorities.  If the winner does not agree despite reasonable attempts by the Promoter to reach an agreement and the prize is not available due to circumstances beyond the Promoter's control, the Promoter may substitute the prize with another item or items determined by the Promoter to be of equal or greater value.
    Additional terms and conditions apply to the respective components of the prize provided by the competition partners and are available directly from them. These terms and conditions may include rules and restrictions about the use and availability of fares, products and services, and conditions of carriage and may seek to limit or exclude the relevant partner’s liability to you for death, personal injury, delay and loss or damage to baggage. The terms and conditions are outlined in the Aircalin conditions of carriage (available via https://www.aircalin.com/en/general-terms-conditions-sale-transport), which provides general information related to booking and flying with the Partner.
    The Partner accepts no liability or responsibility in connection with any booking, product or supply from any of the competition partners.
    The prize may not be used in combination with any other ongoing offers/ promotions/ contests/ discounts.
    Lost prize award certificates/tickets will not be replaced.

SELECTION OF WINNER

    The winner will be chosen by a random draw which will take place on 1 November 2023 at 1:00pm at Level 2, Terminal 4, Melbourne Airport, Tullamarine, Victoria 3043.
    The first valid entry drawn will win the prize as described above.
    The winner will be personally notified via phone call and in writing by way of email to the email address and phone number provided in their entry. In order to redeem the prize, a winning entrant must fulfil the eligibility criteria set out in these terms and conditions to the satisfaction of the Promoter.

    The name of the winner will be published at www.melbourneairport.com.au/win on 1 November 2023 and will remain on the website for at least 28 days.

    The results of the draw will be final and binding and no correspondence will be entered into in relation to the results of the draw. This is a game of chance.
    The Promoter must distribute the prize to the winner within 14 days of the winner accepting the prize or such later time as is reasonably required given the circumstances.

SECOND CHANCE DRAW

    If a winner does not respond within 7 days of being notified that they have won the competition, that winner is not readily identified and reasonable efforts have been made by the Promoter to identify the winner were unsuccessful, they will automatically forfeit their prize and the Promoter reserves the right to select another winner through a second chance draw.
    If necessary, a second chance draw will be held on Friday, 8 September 2023 at the same time and place as the first draw. The first valid entry drawn will win any unclaimed prize.
    The results of any second chance draw will be final and binding and no correspondence will be entered into in relation to the results of the draw.
    The winner will be personally notified and the name of the winner will be published on the website www.melbourneairport.com.au/win.
    The Promoter must distribute the prize/s to the winner/s within 14 days of the winner accepting the prize or such later time as is reasonably required given the circumstances.

PROMOTION AND MARKETING

    By entering the competition, the winner agrees to participate in such promotional activity and material, all editorial activities relating to the promotion, including but not limited to being interviewed, filmed for broadcast and photographed, as the Promoter may require without remuneration. The winner agrees to grant the Promoter a perpetual and non-exclusive licence to use any such footage and photographs in all media worldwide and the winner (and their companion) will not be entitled to any fee for such use.
    Each winner also consents to the use and publication of their name, image and any other details provided by the winner in any marketing material without any further reference or payment to the winner.

DEPARTURE, ARRIVAL AND RE-ENTRY INFORMATION

The following information is current as at 10 October 2023. It is the winning entrant’s responsibility to check the information from the relevant authorities (including any changes to the requirements).

Melbourne - Departure requirements

All departure requirements and information need to be checked off as per the advice of the Department of Home Affairs. These include but are not limited to:

    Check the current travel and visa advice for all the countries you are transiting and travelling to. Please refer to the New Caledonian government website for more information https://www.newcaledonia.travel/au/passport-visa-customs
    Please refer to the relevant airline partner’s website to ensure that you meet their travel requirements prior to travel.

    It’s your responsibility to check well ahead of time what requirements you need to meet for your overseas travel.

Arrival requirements into Australia

    Arrival requirements into Australia need to be checked off as per the advice of the Department of Home Affairs. As these rules change regularly, please make sure that you are up to date on the latest advice.

DISCLAIMER

    It is the winning entrant’s responsibility to ensure that they and their travel companion (if any) have the requisite visas and valid documentation (including but not limited to valid passports and visas) which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the winning entrant’s sole responsibility.
    The winning entrant assumes all COVID-19 risks for themselves and their travelling guests. To the extent permitted by law, the winning entrant covenants not to sue the Promoter and shall fully indemnify the Promoter against any COVID-19 related claims. If the winning entrant is required to isolate pursuant to the New Caledonia Government’s guidelines they will be liable for any and all additional costs of isolation (including but not limited to, any additional costs for accommodation or hospital care).

STANDARD TERMS

    The Promoter reserves the right to amend the competition and its terms and conditions at any time and for any reason, subject to regulatory approval, and will notify entrants of any such amendments as soon as reasonably practicable on www.melbourneairport.com.au/win. It is the entrant's responsibility to regularly check the competition landing page for any amendments.
    In the case of an intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism and pandemics, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions at a time suitable to the Promoter, subject to any written direction given under State Regulation.
    Nothing in these terms and conditions limits, excludes or modifies or purports limit, exclude or modify the Promoter's liability in relation to the consumer guarantees under the Australian Consumer Law (Non-Excludable Guarantees Liability).
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees Liability, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the competition including:

    any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    any theft, unauthorised access or third party interference;
    any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    any variation in prize value to that stated in these terms and conditions;
    any tax liability incurred by the winner or entrant; or
    use of the prize.

    To the extent permitted by law including the Australian Consumer Law, if the competition is not capable of running as planned including by reason of technical failure, fraud or any cause beyond the Promoter's control, the Promoter may cancel or suspend the competition or invalidate any affected entries, subject to regulatory approval.
    Please read the Promoter's privacy policy available on the Promoter website at https://www.melbourneairport.com.au/Passengers/Privacy-policy which tells you how we use any personal information we may collect about you by entering a competition.
    The Promoter may, for an indefinite period, unless otherwise advised, collect personal information through the competition and use and disclose the information to conduct the promotion and for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant and any other purpose set out in the Promoter's Privacy Policy. Entrants should direct any request to opt out, access, update or correct information to the Promoter. Personal information collected through the competition includes first name, last name, contact phone number, email address, postcode and date of birth. The Promoter may disclose personal information to subsidiary and related companies, third parties or regulatory bodies, including but not limited to agents, contractors and service providers for the purposes set out in this clause.
    The Promoter may also disclose entrants’ personal information collected by the Promoter through the competition to the Partner in connection with the competition and for the Partner’s promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant and any other purpose set out in the Partner’s Privacy Policy. Please read the Partner’s privacy policy available on the Partner’s website at https://www.aircalin.com/en/confidentiality-policy which tells you how the Partner may use any personal information disclosed to them. If an Entrant wishes to withdraw their consent for the use and disclosure of their Personal Information by the Partner for the purposes outlined in this clause, they may do so by contacting the Partner in the ways set out in the Partner’s Privacy Policy. The Partner is not located in Australia and therefore may not be subject to any privacy obligations or to any principles similar to the Australian Privacy Principles (APPs). If an Entrant consents to disclosure to the Partner by agreeing to these terms and the Partner handles personal information in breach of the APPs, the Promoter will not be liable under the Privacy Act and you may not be able to seek redress under the Privacy Act. If an Entrant wishes to withdraw their consent for the use and disclosure of their Personal Information by the Partner for the purposes outlined in these terms and conditions, they may do so by contacting the Partner in the ways set out in the Partner’s Privacy Policy.
    By participating in this competition, entrants release and hold harmless Facebook and Instagram from any and all liability associated with this competition. The Promoter and entrants acknowledge that this competition is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. Entrants acknowledge that they are providing information to the Promoter and not to Facebook or Instagram.
    The Promoter is not liable for any tax implications arising from prize winnings, including fringe benefits tax.  Independent financial advice should be sought.
    The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these terms and conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this competition.  Any entrant disqualified under this clause is prohibited from any further participation in the competition.  The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
    The laws of Victoria, Australia apply to this competition. Entrants submit to the exclusive jurisdiction of the laws of Victoria.
