STANDARD TERMS

1.1 Information on how to enter forms part of the terms of entry.

1.2 By participating in the Competition, entrants accept and agree to be bound by these terms and conditions.

1.3 Entries must comply with these terms and conditions to be valid.

 

WHO CAN ENTER

2.1 Subject to clause 2.2 and 9.1, entry is open to Australian, 18+ years of age residents only.

2.2. Employees, franchisees, and their immediate families of We Are Explorers, Dometic, Reflections Holiday Parks, Merrell, Pirate Life Brewing or any related agencies, are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, or step-sister.

 

HOW TO ENTER

3.1 The Competition commences on 17/11/23 at 10:00 AM AEST and closes 13/12/23 at 11:59 PM AEST (“the Competition Period”).

3.2 In order to enter, the entrants must;

Enter their full name, email, and state into the form on the competition page.

3.3 By entering the Competition, each Entrant consents to and grants a royalty free perpetual licence to the Promoter and the Competition Partners to use the winning Entrant’s name, in accordance with clause 5.4 below.

 

PRIZES AND UNCLAIMED PRIZES

4.1 The winners will be chosen at random with a third party draw service.

4.2 The winners will be notified via email from We Are Explorers only.

4.2 Prizes cannot be exchanged or refunded in any way by the winner.

4.3 Prizes are valid for redemption until 14/12/2024.

4.4 Any prizes that remain unclaimed for 1 month after the end of the Competition Period will be awarded to another Entrant as determined by the Promoter.  If required, this will occur on 13/01/2024.

4.5 Prizes will be sent separately.

4.6 If a Prize is unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the Prize with a prize of equal or greater monetary value.

 

SELECTION OF PRIZE WINNERS

5.1 Each Entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 will be entered into the prize pool.

5.2 The winner will be selected through a third party draw service on the 14/12/2023 at 11:00AM AEST at the Promoter’ Premises at 2/10 Towers Drive, Mullumbimby NSW 2481.

5.3 The winner of the Competition, as determined by the Promoter, agrees to provide proof of age to We Are Explorers and any Competition Partners if deemed necessary by the Promoter.

5.4 The winner will be notified via email and will be announced on the Promoter’s social media platforms on 14/12/2023.

5.5 The Promoter’s decision is final.

 

NO LIABILITY

7.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoters may in their absolute discretion cancel the competition or other as subject to any State Legislation.

7.2 The Promoters and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

7.3 The Promoters and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

7.3.1 during the draw;

7.3.2 Whilst undertaking any travel won connected with their entry into the draw; or

7.3.3 in the participation in any prize

7.3.4 as a consequence of late, lost or misdirected mail;

7.3.5 due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;

7.3.6 due to circumstances outside the Promoter’s reasonable control.

7.4 The Promoters and its affiliates assume no responsibility for any error, omission, interruption, deletion, defect, theft or destruction or unauthorised access to, or alteration of, entries, and reserve the right to take any action that may be available.

7.5 If for any reason, this competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter’s which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter’s reserve the right, at their discretion, to disqualify any individual who tampers with the entry process or any other dishonest act, may take any action that may be available, and cancel, terminate, modify or suspend the competition, subject to State legislation.

 

 INSTAGRAM

8.1 If entry is via Instagram or if the Competition is promoted on Instagram, the Competition is in no way sponsored, endorsed, administered by or associated with Instagram and each entrant agrees to grant Instagram a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:

8.1.1 any information they provide in connection with the Competition is provided to the Promoter and not to Instagram or any other social network; and

8.1.2 any questions, comments, or complaints regarding the Competition will be directed to the Promoter, not to Instagram or any other social network.

RESOLVING DISPUTES

7.1 Any Entrant may email the Promoter (sian@weareexplorers.co or henry@weareexplorers.co) and state their dispute.

7.2 The Promoter will be required to respond within 30 days and set a time for questions and answers if desired by the Entrant.

7.3 From the date of response, a final written decision from the Promoter will be supplied containing concise, reasoned decisions.
