This promotion (“the Promotion”) is sponsored by Wanderful Holidays and TourRadar GmbH a company registered in Austria with company number 393496 x, whose registered office is situated Kärntner Ring 5-7 Top 201-203, Vienna 1010, Austria (“TourRadar”);  (together “the Sponsors”).


Prizes.

Sweepstakes Prize (“the Prize”):  $4,798 (2 people)


 

Travel Terms.

Prize must be accepted in writing by the Winner by 15.08.2024, including a confirmation of the names of all travelers. To be eligible to receive the Prize, the winner and invitees must all possess valid passports that expire earliest 6 months after the tour of the Prize ends.

The Winner and invitees must depart latest on 15.10.2024 or prize will be forfeited.

 

The final travel date must be confirmed to TourRadar and all necessary documentation and information needed for traveling, such as passport data needs to be submitted at least 45 days prior to the intended departure, otherwise the Prize is forfeit and the Sponsors might choose another winner. Travel and accommodations are subject to availability.


Once the trip is confirmed, it cannot be altered. Entrants agree to abide by the general Terms & Conditions as listed on the TourRadar website (https://www.tourradar.com/terms-conditions/).

Any/all air and/or ground transportation to the nearest major international airport from the winners residence will not be provided by Sponsors and will be Prize winner's sole responsibility. All airfares, accommodation and ticketed events are subject to availability at time of redemption. Travel must be round trip.  Winner and guests must travel together on the same itinerary, including the same departure date, destination and return date, and must have valid travel documents (e.g., valid government issued photo ID, visa, and passport as applicable) and any applicable inoculations prior to departure, and failure to do so may result in forfeiture of prize. The Sponsors will determine airline and flight itinerary in their sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight.  Travel is subject to the terms and conditions set forth in this Promotion, and those set forth by the Sponsors’ airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner.  Travel companions must execute liability/publicity releases prior to issuance of travel documents.  Travel restrictions, conditions and limitations may apply.  Sponsors will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.  Sponsors are not responsible if any aspect of the prize or trip is delayed, postponed or canceled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsors' sole discretion.

 

Actual value may vary based on airfare fluctuations and distance between departure and destination.  Winner will not receive the difference between actual and approximate retail value. The Prize is non-transferable and no substitution will be made except as provided herein at the Sponsors’ sole discretion. Prize is awarded "as is" with no warranty or guarantee, either expressed or implied by the Sponsors. The Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsors reserve the right, at their sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. All applicable federal, state and local taxes, if any, and all other costs and expenses associated with prize acceptance and use not specified herein as being provided, including without limitation additional ground transportation, meals, souvenirs, luggage fees, incidentals and gratuities, are the sole responsibility of the Prize winner.


It is compulsory that the winners and their invitees take out comprehensive travel insurance before they travel, which is not included in the Grand Prize. The Sponsors have the right to refuse passengers without the required insurance cover.

 

Entry Conditions and Release.

The Sweepstakes is open to individuals who are at least 18 years old at the time of entry. Employees of the Sponsors, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members are not eligible to participate.

Eligible persons may enter (‘Entrants’) the Sweepstakes by visiting www.tourradar.com/travel/sri-lanka-wanderful-holidays-contest.  Entrants must provide all requested information, including a valid email address, and accept these Terms and Conditions. By registering described above, Entrants enter the Sweepstakes. Any incomplete, inaccurate, or illegible entries will be disqualified.

 

 

LIMIT: One (1) Sweepstakes entry per person.

 


The Sweepstakes starts on 01.05.2024 and ends on 31.05.2024.

 

The drawing of the Sweepstakes will take place on 01.06.2024. Winners will be selected at random from all eligible entries received during the entry period.

 

 

The winner will be informed via the provided email by 15.06.2024.

 


THE ELIGIBILITY OF ALL POTENTIAL SWEEPSTAKES WINNERS IS SUBJECT TO VERIFICATION BY THE SPONSORS, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEPSTAKES.

 

General Conditions.

Sponsors’ decisions are final and binding in all matters relating to this Sweepstakes, including, but not limited to, interpretation and application of these Terms and Conditions. By entering the Promotion, Entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Sweepstakes.

By entering the Promotion each Entrant agrees to: (a) comply with and be bound by these Terms an Conditions and the decisions of the Sponsors, which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sponsors, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the  Sweepstakes, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a Entrant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant's participation in the Sweepstakes and/or entrant’s acceptance, use, non-use or misuse of the prize.

 

Data Protection, Image Rights & Publicity.

Sweepstakes Entrants agree that by providing their email address, they give permission to be added to TourRadar’s and Partner’s online newsletter lists and receive future correspondence via email. Entrants may remove their name from these lists at any time by clicking 'unsubscribe'.

Except where prohibited by law, participation in the Promotion constitutes the winner’s consent to the Partner’s and TourRadar's use of the Winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

 

State and Country Exceptions.

The Sweepstakes is not open to residents of India, Belgium, Sweden & Quebec.

 

Sweepstakes Cancellation.

The Sponsors reserve the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond the Sponsors reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by the Sponsors in their sole discretion. The Sponsors reserve the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Terms and Conditions or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law. The Sponsors failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision. If, for any reason, in the opinion of the Sponsors, this Sweepstakes or any supplier of the travel product is not capable of running as planned by reason of an Act of God, disease, epidemic, pandemic, quarantine, acts of government, infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures, system overload or any other causes, whether discovered or suspected by the Sponsors, which, in the opinion of the Sponsors, does or could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsors reserve the right to cancel, terminate, modify or suspend this Sweepstakes, and/or provide alternative means of entry or any other changes to these Sweepstakes rules that the Sponsors deem appropriate under the circumstances. In the event of termination, suspension or modification of this Sweepstakes, a notice will be posted online.

 

Disputes.

Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of the Winner, shall be resolved individually, without resort to any form of class action; disputes shall be governed by and construed in accordance with the laws of Austria. Any claims shall be brought in a court of competent jurisdiction located in 1010 Vienna, Austria.
