These Terms & Conditions of Entry contain important information you need to know about your entry and the Promotion generally.  Make sure you read these Terms & Conditions of Entry carefully.

Information about how to enter and the prizes form part of these Terms & Conditions of Entry.  If you choose to participate in this Promotion, then you agree that these Terms & Conditions of Entry apply to your entry.

PROMOTION

Jacket Giveaway (Promotion).

PROMOTER

The Promoter is Joe Bananas Australia Pty Ltd (ABN 42 639 362 520), of 103 George St, The Rocks, NSW, 2000, Australia (we, our, us, Promoter).

PROMOTION PERIOD

The Promotion starts at 10:00am 10th September 2024 AEST and closes 11:59pm 6th of October 2024 AEDT (Promotion Period).  No entries will be accepted after this time.

WHO CAN ENTER

Entry is open to Australian and The United States Of America residents aged 13 years or older as at the commencement of the Promotion, who are currently residing in Australia or The United States Of America. If you are under 18 years of age, you must have permission from your parent or legal guardian to enter and if you win, the prize may be awarded to your parent/guardian. Employees of our company and its subsidiaries (and their immediate families) and the employees of any agencies associated with this Promotion are ineligible to enter.  When we say ‘immediate families’ we mean spouse (whether married or defacto), child, parent, grandparent, uncle, aunt, sibling, niece, nephew or cousin.

HOW TO ENTER

To enter, individuals must like & share any of the related competition posts on the @joebananas_au Instagram account, must be following the @joebananas_au Instagram account and complete any of the forms on the website relevant to the entrants region of entry to the Promotion [https://www.joebananas.com.au/pages/jacketgiveaway for Australian entrants and https://www.joebananas.com/pages/jacketgiveaway for The United States Of America entrants] or complete any of the online forms through paid advertising to go in the draw to win.

Entrants can only enter in their own individual capacity and from a social media account which they hold in their own name. Entering under a false name/s may invalidate all entries. Multiple entries under different names may also invalidate all entries at the Promoter’s discretion. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the Promotion is prohibited and may render all entries submitted by that individual invalid.

Entrants to the jacket giveaway are limited to one per-registered email address and associated Instagram account registered on the competition forms by the entrant.

At the discretion of The Promoter, terms of entry limitations and inclusions may change throughout the duration of the Promotion Period, including but not limited to liking digital promotional posts, sharing digital promotional posts, commenting on digital promotional posts and/or tagging friends on digital promotional posts.

The Promoter reserves the right to amend conditions of entry, within guidelines outlined in this/here/these terms and conditions, on promotional landing pages, promotional advertising captions and/or descriptions, promotional email marketing and/or all promotional digital placements.

Entries must be received during the Promotion Period and in accordance with these Terms & Conditions of Entry. Entries will not be accepted in any other way or form or at any other time.  Your entry is deemed to have been received when we actually receive it (not when you send it). Incomplete and ineligible entries will be deemed invalid. We’ll also invalidate any entry which (in our opinion) breaches these Terms & Conditions of Entry or any other content guidelines published by us as part of the entry process for the Promotion. Once submitted, you cannot alter or delete your entry.

AUSTRALASIAN REGION:

1 x Styling Experience. RRP: $500 AUD (included in value of the jacket)

NORTH AMERICAN REGION:

1 x Custom Tailored jacket - limited to the list found on website https://joebananas.com/collections/jacketgiveaway for The United States Of America Residents RRP: up-to $3,800 USD ex CA Sales Tax

1 x Styling Experience. RRP: $500 USD (included in value of the jacket)

Prizes are limited to one per person. Prizes are not transferable or exchangeable and cannot be redeemed for cash or any other form of consideration. The value of each prize is accurate as at the time of preparation of these Terms & Conditions of Entry. We accept no responsibility for any variation in the value of a prize after that date. If a prize is unavailable for any reason, we may substitute it for another item of equal or higher value, subject to any written directions of a regulatory authority. If a winner does not take an element of a prize by the time stipulated by us, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. We accept no other liability or responsibility for any loss incurred by a winner or any other party if any prize (or any part of a prize) is unavailable for any reason.

If any person taking or participating in the prize is under 18 years of age, a parent or legal guardian of that person must be present for the duration of the Styling Experience, as one of the participants.

PRIZE POOL

The total prize pool is $4,800 AUD RRP including GST for Australian Residents.

The total prize pool is $3,800 AUD RRP ex CA Sales Tax (tax payable in store at time of redemption if applicable)

Any costs not expressly included in the prize description are the responsibility of the winner.

WINNER SELECTION & NOTIFICATION

A random draw from all entries received during the Promotion Period will be conducted 103 George St, The Rocks, Sydney, Australia, 2000 on or around 10am 8th of October 2024 AEDT. The first complete, eligible entry drawn will win the prize. The Promoter reserves the right to draw 5 additional reserve entries and to record them (in order drawn) in case an invalid entry or ineligible entrant is drawn as a winner or the winner is unable or unwilling to accept the prize.

The winner will be notified by private Instagram message and direct email to the registered email address on the associated completed jacket giveaway competition form mentioned above within 2 business days of determination and will be provided with instructions which they must follow in order to verify their entry and claim their prize.

The winner’s name may be published on the @joebananas_au Instagram page on or around 10th of October 2024.

The Promoter’s decisions are final and no correspondence will be entered into.

CLAIMING YOUR PRIZE

Prizes must be claimed by 4pm on 20th of October 2024 AEDT. If you are a prize winner and don’t accept or claim your prize by this date, then your entry will be deemed invalid. An unclaimed prize draw (if required) will be held at the same address as the original draw on 8th of October 2024 at 4pm AEDT. Winners of any unclaimed prizes will be notified in writing within 2 business days of determination.

By entering the giveaway competition you agree to attend the Joe Bananas Styling Experience at 103 George St, The Rocks, Sydney, Australia, 2000 or Fashion Island, Newport Beach, SHOP 1035, 401 Newport Centre Drive, Newport Beach, CA 92660 USA. Entrants are responsible for all costs associated with attending the styling session, including but not limited to transportation, meals, and accommodation. The Promoter is not responsible for any accidents, injuries, or other losses that may occur during transportation to or from the styling session.

By entering the giveaway competition you agree the gift included of a Free Jacket is selected from the list outlined on the competition website [https://joebananas.com.au/collections/jacketgiveaway or https://joebananas.com/collections/jacketgiveaway].

To accept your prize, you must follow the instructions set out in the notification message we send to you telling you that you’re a winner. This includes providing verification information regarding your entry, if requested by us. We will make reasonable efforts to contact you, but if you’ve not claimed your prize by the prize claim date specified below, or we determine that your entry is not in accordance with these Terms & Conditions of Entry, then your entry will be declared invalid, and we may award the prize to the next complete and eligible entry drawn.

If a prize winner complies with these Terms & Conditions of Entry, and we verify and accept the entry in accordance with these Terms & Conditions of Entry, we will deliver the prize within 62 days of the winning entry being verified, to the address provided by you at the time of completing your entry or via the verification process.

ENTRY CONTENT

You must take full responsibility for the content of your entry, and for ensuring that your entry complies with these Terms & Conditions of Entry. When we talk about ‘entry content’, we mean things like text, photos, videos, email messages and anything else that you submit, upload, transmit, publish, communicate or use in connection with your entry into the Promotion.

Your entry must be via your own social platforms and registered email address. We reserve the right to verify, or to require you to verify, that the entry is your own submission. If you can’t verify your entry to our satisfaction, your entry will be deemed invalid.

Play nicely – you don’t want to be that guy. Your entry must not include:

(a) any written detail, image or voice of any other person without that person’s express consent. You warrant that if your entry contains any such content, you have obtained the express consent of the relevant person;

(b) any content that contravenes any law, infringes the rights of any person or is obscene, defamatory, discriminatory, offensive or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); or

(c) any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless you are entitled to do so. If you have any doubts about whether you have the right to include any content (for example, recorded music) then you must not include it. By including any such content in your entry, you warrant that you have the permission of the relevant copyright owner to do so and that this permission allows us to use your entry in accordance with these Terms & Conditions of Entry.

We may at any time, in our absolute discretion, edit, modify, delete, remove or take-down any part of your entry that is within our possession or control without notice to you, or require you by notice to take such action in respect of content within your possession or control.

By submitting an entry to the Promotion, you agree to give us a world-wide, perpetual, irrevocable, royalty-free, transferrable and fully sublicensable license to use your entry in connection with the Promotion (such as posting your Styling Experience on The Promoter’s associated digital platforms, for all the world to see and admire) and for related marketing and promotional purposes. You consent to us using your entry in any manner we wish (including modifying, adapting or publishing the entry, whether in original or modified form, in whole or in part or not at all), by way of all media, without payment to you (of royalties, compensation or otherwise). By submitting an entry, you consent to and waive any claim or right of action you may have in respect of any such dealings with the entry that might otherwise infringe your moral rights (including the rights of attribution and integrity or against false attribution) in respect of the entry or entry content. We may copy any content submitted as part of your entry, cause the content to be seen and/or heard in public, and communicate the content to the public, without notice or attribution to you. We may also allow third parties to do these things.
