PROMOTION DESCRIPTION:
The BABOR Advent Calendar Giveaway ("Sweepstakes") begins on 2024-10-14 and ends on 2024-10-31 (the "Promotion Period").

The sponsor of this Sweepstakes is BABOR Cosmetics Australia ("Sponsor"). By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects. The Sponsor is responsible for the collection, submission, or processing of entries and the overall administration of the Sweepstakes. Entrants should direct any questions, comments, or problems related to the Sweepstakes solely to the Sponsor. The Sponsor may be contacted by email at social@tsmn.com.au during the Promotion Period.

ELIGIBILITY:
This Sweepstakes is open to legal residents of Australia who are 18 years of age or older (the "Entrant"). Sponsor and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies, and each of their respective officers, directors, and employees (the "Promotion Entities") are ineligible to enter the Sweepstakes or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. "Household Members" are people who share the same residence for at least three months a year. "Immediate Family Members" include parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law.

HOW TO ENTER:
Enter the Sweepstakes during the Promotion Period online by visiting the entry form, which can be found at https://competitionsandgiveaways.com.au/adventcalendargiveaway. Automated or robotic entries submitted by individuals or organisations will be disqualified. Internet entry must be made by the Entrant. Any attempt by the Entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins, or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void the Entrant's entries, and the Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All entries must be posted by the end of the Promotion Period to participate. The Sponsor's database clock will be the official timekeeper for this Sweepstakes.

WINNER SELECTION:
The Winner(s) of the Sweepstakes will be selected in a random drawing from among all eligible entries received throughout the Promotion Period. The random drawing will be conducted within approximately 7 days after the Promotion Period by the Sponsor or its designated representatives, whose decisions are final. Odds of winning will vary depending on the number of eligible entries received.

WINNER NOTIFICATION:
Winner(s) will be notified by email at the email address provided in the entry information approximately within 7 days after the random drawing. The potential winner must accept the prize by email as directed by the Sponsor within 7 days of notification. The Sponsor is not responsible for any delay or failure to receive the notification for any reason, including inactive email accounts, technical difficulties, or the winner's failure to adequately monitor their email account.

Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility, release of liability, and a publicity release (collectively "the Prize Claim Documents"). No substitution or transfer of a prize is permitted except by the Sponsor.

PRIVACY:
Any personal information supplied by you will be subject to the privacy policy of the Sponsor, posted on the Sponsor's website. By entering the Sweepstakes, you grant the Sponsor permission to share your email address and any other personally identifiable information with third parties for the purpose of administration and prize fulfilment, including the use in a publicly available winner list.

LIMITATION OF LIABILITY:
By entering, you agree to release and hold harmless BABOR Cosmetics Australia and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) your participation in the Sweepstakes and/or acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorised human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

DISPUTES:
This Sweepstakes is governed by the laws of Australia, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, the participant agrees that any disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Australia having jurisdiction. Further, in any such dispute, under no circumstances shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees. The participant further waives all rights to have damages multiplied or increased.

To obtain a copy of the Winner List, send your request along with a stamped, self-addressed envelope to BABOR Cosmetics Australia, cc: BABOR Advent Calendar Giveaway, Unit F/255 Rawson Street, Auburn NSW 2144. Requests for the names of the winners must be received no later than 30 days after the Promotion Period has ended.
