Prize:

1. A total of 98 prizes (Prizes) will be awarded among residents of Australia who satisfy the entry conditions.
2. Prizes cannot be exchanged and the constitution of the monetary value remains at the Promoter’s discretion. Prizes are not transferable.
3. Prizes shall be awarded during the Promotional Period.
4. Details of the 98 Prizes to give away included:

Duration of Promotion

6. This Promotion commences at 8.00am (AEST) 28 October 2024 and closes at 11.59pm (AEST) on 20 January 2025 (Promotional Period).

Eligibility

7. To be eligible to enter, individuals must be 18 years of age or older, reside in Australia and populate all mandatory fields in an electronic entry form, including by providing a valid e-mail address, mobile phone number, their name, physical address.

For the purposes of this Promotion, Participating Locations are Poolwerx franchisees who advertise this Promotion during the Promotional Period and are located within Australia.

8. No employee (or any immediate family member of that employee) of the Promoter or any of ‘related body corporate’ (as that term is defined in the Corporations Act 2001 (Cth)) of the Promoter or of any franchisee of the Promoter is eligible to enter this Promotion. The words ‘immediate family member’ includes any of the following relations: spouse, ex-spouse, de-facto spouse, child or stepchild, parent, stepparent, grandparent, uncle, aunt, niece, nephew, brother,
sister, stepbrother, step sister or cousin.

How to enter

9. Information on how to enter the Promotion forms part of the terms and conditions of entry.
Entry into the Promotion constitutes acceptance of these terms and conditions.
10. To enter, individuals must visit online to enter the required details and submit the fully completed entry form so it is received during the Promotional Period. Individuals can also enter by scanning the QR code contained within promotional material including instore posters and flyers.
11. Entries can also be made using the hashtag, giving an additional entry into the competition draw for each post tagged.
12. Entries to the prize draw are not restricted by purchases.
13. Any entries submitted outside of the Promotional Period will be disqualified by the Promoter.
14. Incomplete or indecipherable entries are invalid.
15. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion.
Errors and omissions may be excepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from any person who has tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion are fully reserved.
16. If there is a dispute about the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

17. The winners of the Game Tickets (double pass) will be drawn on the following dates with winners notified on the same day. There will be five double passes won per game WBBL and BBL game home game and 2 x double passes per WBBL and BBL away game, and for each test match game listed below.

Money Can’t Buy Experience

A ‘Money Can’t Buy Experience’ at the Big Bash League in Brisbane. The package includes:

1. Return economy flights from your city of residence in Australia for two people if winner resides outside of South-East Queensland
2. One night’s accommodation in Brisbane for two people in a 4-star hotel.
3. 2 x game tickets to a Brisbane Heat v Hobart Hurricanes at the Gabba, on Thursday 16 January including a behind the scenes tour experience.
4. Bookings for accommodation and flights and match entry to be booked and paid by Poolwerx. All other costs are at the expense of the winner.
Entries for all other prizes outside game tickets will be drawn at 10 Camford Street, Milton QLD 4064 at 3:00pm (AEST) on Thursday 23 January 2025 (Prize Draw).
18. Winning entries (“Winner”) will be drawn at random by a software application, using data from all entries received on and verified by Promoter and an equal chance of winning a Prize and the Winner will be determined totally by chance.
19. Each Winner will receive one Prize and each Prize awarded to a Winner shall be at the discretion of Poolwerx.
20. A Winner does not need to be present at the Prize Draw.
21. Each Winner (excluding winners of the Game Tickets) will be published on Poolwerx websites from 9.00am (AEST) on 31 January 2025, and the respective Winners will be notified in writing by email and by phone by no later than 5.00pm (AEST) on 31 January 2025 (AEST).
22. The Promoter reserves the right to request a Winner to provide proof of identity in order to claim a Prize. Proof of identification considered suitable for verification is at the discretion of the Promoter. If a Winner cannot provide proof, such person may forfeit their allocated Prize in whole and no substitute will be offered by the Promoter.
23. If any non-ticket Prizes (excluding the Game Tickets and Money Can’t Buy Experience) are unclaimed by 14 February 2025, an unclaimed Prize draw will be conducted at 10 Camford Street, Milton QLD 4064 at 10:00am (AEST) on 21 February 2025. (Unclaimed Prize Draw).

24. Each Winner of the Unclaimed Prize Draw will be published on Poolwerx websites by 9.00am (AEST) on 28 February 2025 and the respective winner (s) of the Unclaimed Prize Draw will be notified in writing by email and by phone by no later than 5.00pm (AEST) on 28 February 2025 (AEST).

No cost of entry

24. 25. No fees are payable by eligible entrants to enter this Promotion.

Use of Personal Information

26. All entries become the property of the Promoter.
27. The Promoter/Supplier collects, stores, processes and discloses ‘personal information’ (as that term is respectively defined in the Privacy Act 1988 (Cth)) in order to conduct the Promotion and may, for this purpose, disclose an entrant’s personal information to third parties, including but not limited to agents, contractors, service providers and Prize suppliers. Entry is conditional on each individual providing personal information in the manner described in paragraphs 7 and 10
above. All personal information supplied to the Promoter/Supplier in connection with this Promotion will be handled strictly in accordance with the Promoter’s privacy policy and Supplier’s Privacy Policy & Collection Statement, which can be viewed here: https://www.poolwerx.com.au/privacy-policy/
28. In addition, the Promoter/Supplier may use personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The privacy policy also contains information about how entrants may opt out, access, update or correct their personal information.
29. By entering this Promotion, each entrant acknowledges and agrees that their personal information provided on entry will be collected, stored, processed and disclosed by Poolwerx or its Related Entities or Consultants for the purposes described in these terms and conditions.
30. Each Winner grants to the Promoter an exclusive, perpetual, royalty-free, worldwide license (with the right to sublicense) to use their name, image, voice and likeness (the Licensed Rights) in media for the purpose of promoting the Promotion. No fee will be paid to any Prize Winner for
the Licensed Rights.
31. In consideration of the right to enter this Promotion, each entrant unconditionally and irrevocably assigns and transfers to the Promoter all right, title and interest in and to all copyright in any material created pursuant to that person’s participation in any aspect of this Promotion.

Limitation of liability

32. By entering this Promotion, each entrant accepts full responsibility for their decision to participate in the Promotion. Each entrant irrevocably and unconditionally releases, forever discharges and waives any right to make a claim against the Promoter and its directors, officers and personnel in respect of any loss, liability (including liability for negligence), cost or damage of any kind suffered or incurred by an entrant as a result of, or in connection, with the acceptance of, and participation in, the Promotion.
33. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, loss of data, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserve the right to take any action that may be available to it at law.
34. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to obtaining the prior consent of any relevant gaming authority.

Redeeming the Prize

35. Prizes will be sent to each Winner’s email (electronic tickets for Cricket events) or via postal address (merchandise), or arranged with the winner to collect from their local Poolwerx Store – distribution of prizes by post or courier will be sent either from Poolwerx Support Centre and/or the supplier. Each winner may be required to appear at a Poolwerx location for a promotional photograph.
