By entering the ‘West Gippsland Countryside Escape’ (‘the Competition’), you agree to the following terms and conditions of entry (the ‘Terms and Conditions’):

    Standard Terms
        Information on how to enter forms part of the Terms and Conditions.
    Who can enter?
        Subject to clauses 2a and 2b, entry is open to all residents of Australia.
        Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with the Competition are not eligible to enter.
        Entrants must be over the age of 18.
    How to enter
        The Competition commences on Wednesday 4 December at 12pm (AEDT) and concludes on Wednesday 5 February 2025 at 9:30am (AEDT)("the Competition Period").
        Entries must be received during the Competition Period. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment.
        To go into the Competition, entrants must subscribe to the Visit Gippsland database, thereby affording the party permission to send updates and information post promotion.
        Only one (1) entry is permitted per person.
        There is no cost to enter the Competition; however internet connection and usage rates may apply. Entrants should obtain details of such costs from their service providers. The Promoter is not and will not be liable for any such costs.
        The Promoter may reject an Entry if it reasonably forms the opinion that the Entry has been entered using false information or via automated entry means or by use of a competition entry service.
    Prize
        There is 1 prize on offer valued at $1,735. The prize includes:
            2 nights' accommodation at Stillwater including a bottle of wine on arrival and daily breakfast, valued at $1,360;
            A $175 gift voucher at Neeri Nuff Wine Bar & Kitchen, valued at $175;
            Entry for 2 adults to the garden at Broughton Hall, valued at $50;
            A grazing hamper valued at $150.
        Except as otherwise indicated, all amounts stated in these conditions are stated in Australian dollars.
        The winner must, on request by the Promoter, provide evidence which, to the reasonable satisfaction of the Promoter, demonstrates that the winner is an eligible entrant (as per clause 2a, 2b and 2c) and has complied with the Terms and Conditions.
        The Prize must be taken as stated and no compensation will be payable if a winner is unable to use the Prize as stated. If a winner is unable to satisfy the Terms and Conditions or the Prize is not utilised or able to be taken within the specified timeframe, the Prize will be forfeited by the winner and cash will not be awarded in lieu.
        The Prize is not transferable, exchangeable or redeemable for cash. If the Prize is unavailable, the Promoter reserves the right to substitute the Prize or an item (or items) of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the Prize are the sole responsibility of the winner.
        The Promoter does not cover any additional costs incurred by the winner including hotel room incidentals, transport, travel insurance and any other costs incurred that are not specified within the Terms and Conditions.
        Accommodation at Stillwater is for 2 nights, subject to availability. The booking must be redeemed prior to 15 Dec 2026. The accommodation is for 2 adults only. Additional guests, parties and pets are not permitted.
        The gift voucher for Neeri Nuff Wine Bar & Kitchen may be redeemed during normal opening hours (dinner Thursday – Saturday; lunch Friday - Sunday), subject to availability. Expires 31 Dec 2026.
        The garden at Broughton Hall is open seasonally, with windows in spring (Sep – Dec) and autumn (Apr – Jun). Specific dates are available at their website. Entry to the garden may only be redeemed during these periods.
        The prize winner is responsible for booking in all experiences directly with the participating businesses.
    How to win
        Each eligible entry received within the Competition Period will be entered into a random draw.
        The draw will be conducted by the Promoter on Wednesday 5 February 2025 at 9:30am AEDT at Destination Gippsland, 30 Ridgway St, Mirboo North, VIC 3871. The winner will be notified by email and their name will be published on visitgippsland.com.au/competitions
        The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result or any other decisions the Promoter makes in connection with the Promotion.
        Prizes will be awarded to the person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit the entry (e.g. mobile phone account holder).
        Should an entrant’s contact details change during the Competition Period, it is the entrant's responsibility to notify the Promoter.
        If the Prize remains unclaimed after 2 business days of notification being given, the Promoter may withdraw the Prize and award it to an alternative entrant by conducting an unclaimed prize draw on Friday 7 February 2025.
        If any draw is scheduled on a public holiday, the draw will be conducted on the following business day.
    Liability
        The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, misadventure, accident, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or accepting or using any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
        Subject to any restrictions at law, the liability of the Promoter however arising is limited to the total value of the Prize.
        The Promoter is not responsible for any technical error that may occur during the administration of this Competition including but not limited to any omission, interruption, deletion, defect, delay in operation or transmission, communications, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
        If, for any reason, this Competition is not capable of being conducted as planned, including but not limited to, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition.
    Privacy

The Promoter collects your contact details in accordance with the Privacy and Data Protection Act 2014 (Vic) (the Act) for the purposes of the Competition. As an entrant and participant, you agree to this collection and the Promoter acknowledges that it will not disclose such information to any third parties save where permitted by the Act. However, by entering the Competition you consent to, and acknowledge that the Promoter may send you further information and promotional material relating to tourism in Gippsland.

Without limiting any other paragraph, the Promoter may at its discretion amend any aspect of this Competition, subject to any applicable laws.
