TERMS AND CONDITIONS:

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 16 years or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. This giveaway is a game of chance. The giveaway commences 13/01/2025 and closes 11:59pm on 20/01/2025 (“Promotional Period”). No purchase is necessary. Winners will not be required to pay to enter the competition.

4. Competition Rules:

a) To be eligible to enter, individuals must:
i. Follow @hariboau on Instagram.
ii. Simply tag a friend in the comments.
iii. Only one entry per person.
b) Send @HARIBOAU their contact and shipping details if determined to be a winner. If the competition winner(s) does not respond to their message notifying them that they are the confirmed winner by 11:59pm on 24/01/2025, they will forfeit their spot as a confirmed giveaway participant and the next eligible entrant will be selected.

Winner Selection:

5. The winner(s) will be selected at random from all eligible entries. The drawing will take place on 21/01/2025 at Co,Gency Group (Level 1, 186-188 Willoughby Road Crows Nest NSW 2065). The odds of winning depend on the number of eligible entries received.

6. The winners will be announced on 21/01/2025 via @HARIBOAU Instagram Direct Message by 4:30pm AEDT.

7. Entrants have the option to unfollow the @hariboau Instagram accounts at any moment. However, it is imperative to be a follower when the winners are notified to claim the prize. Failure to be a follower of the @hariboau , Instagram accounts at the time of winner notification will result in the forfeiture of the prizes.

Prize Information:

8. There will be 10 winners chosen. The 10 x winners, individually winning 1 x Haribo Umbrella and 3 x packs of Harbo Treats a RRP of $38 in total.

Further Conditions:

9. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.


10. Entrants consent to the Promoter using the entrant's name, likeness, image/video and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this giveaway (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

11. By entering the giveaway you consent to Haribo using your entry across any of Haribo’s social media platforms.

12. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

13. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

14. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. If the entrant opts-in at time of entry, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

15. The prize cannot be redeemed for cash or any other alternative.
