 TERMS & CONDITIONS

1. OVERVIEW

This Giveaway is run by The Salty Fox ABN 38 350 362 682 trading as The Salty Fox, based in Victoria, Australia (referred to in these terms as “The Salty Fox”, “we”, “us”, and “our”). Please take the time to read these Terms prior to entering our Giveaway. By submitting an entry, you (referred to in these terms as “Entrant”, “You” or “Your”) are deemed to accept these terms and conditions, including consenting to receive marketing communications from us and not opting out during the Promotional Period.

All instructions and other information published on our website or social media platforms in connection with this Giveaway will form part of these Terms.

2. PROMOTIONAL PERIOD

Entries will be open from 17 February 2025 at 12:00 AM AEDT until 2 March 2025 at 11:59 PM AEDT (Promotional Period). After the end date, no further entries will be permitted, and we take no responsibility for late, incomplete, or incorrectly submitted entries.

3. ENTRANT

Entry is open to all Australian and New Zealand residents over the age of 18 who are not directly associated with our business (e.g., employees, contractors, management or directors, or family members of any of these persons).

You understand that we may disqualify an Entrant or cancel the Giveaway at our sole discretion, subject to any applicable law.

4. VALID ENTRY REQUIREMENTS

To submit a valid entry, Entrants must:
a) Complete and submit the competition entry form; OR
b) Purchase from The Salty Fox during the Promotional Period.

The Entrant may submit one valid competition entry form throughout the Promotional Period.

The Entrant may also make an unlimited number of purchases from The Salty Fox during the Promotional Period, with each purchase from The Salty Fox counted as one Entry.

If you do not follow this process or if we deem that your entry is invalid, incomplete, fraudulent, or inappropriate, your entry will be considered void.

You agree that any costs associated with entering the Giveaway are the sole responsibility of the Entrant.

5. WINNER SELECTION & PRIZES

You acknowledge that the outcome of the competition Draw is final, and we will not enter into any communication with you regarding the administration, rules, or results of the Giveaway.

The Prize Winner will be drawn and announced as follows:

Winner selection will follow this process:

        Each Entrant’s name will be manually entered into a CSV and assigned a number based on the row they are in within the sheet.
        All row numbers will be entered into the Google Random Number Generator.
        A random number will be generated corresponding to one of the rows from the CSV.
        The name assigned to that row will be the Winner of the Draw.

6. WINNER NOTIFICATION

Winners will be notified via email within the timeframe outlined above. Winners must respond to us within 48 hours and provide the requested information, including:
a) Proof of identity;
b) Proof of age; and/or
c) Proof of residency.

Failure to provide proof within 7 days or accept the prize within this timeframe may result in forfeiture of the prize. In this case, the prize may be reallocated on the 8th day after the original winner was selected using the same random selection process.

7. PRIZE CONDITIONS

By participating in the Giveaway, you acknowledge that if you are a Winner, you:

    Will only be eligible to win one prize during the Promotional Period;
    Consent to us using your name, likeness, image, voice, and entry in any marketing or promotion related to the Giveaway and/or our business;
    Agree to comply with, and use the prize in accordance with, the supplier’s conditions and requirements;
    Agree that the prize is not transferable or exchangeable and cannot be taken as cash;
    Understand that if the prize is unavailable, we reserve the right to substitute it with another prize of similar value or specification.

8. INTELLECTUAL PROPERTY

By participating in this Giveaway and submitting user-generated content (such as photos, videos, or written entries), Entrants agree to grant to us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display the content for the purposes of the Giveaway, promotional materials, and related marketing activities and future promotions.

Entrants represent and warrant that they are the rightful owners of the submitted user-generated content or have obtained all necessary permissions, licenses, and consents from the relevant rights holders. Entrants further confirm that their content does not infringe upon any third-party intellectual property rights, privacy rights, or any other proprietary rights.

We acknowledge that Entrants retain their ownership rights to the user-generated content submitted for the Giveaway, subject to the granted license mentioned above. However, we shall have no obligation to display or use the content beyond the purposes of the Giveaway.

Entrants understand and agree that we may attribute their name or social media handle alongside their user-generated content when used in relation to the Giveaway or promotional materials.

We reserve the right to remove or disqualify any user-generated content that violates intellectual property rights, is deemed inappropriate, or does not comply with the Giveaway terms and conditions. In such cases, the Entrant may be disqualified from the Giveaway without prior notice.

Entrants acknowledge that we assume no responsibility for any unauthorised use or infringement of third-party intellectual property rights resulting from the submission or use of user-generated content.
