TERMS & CONDITIONS:

1.              These terms and conditions (terms) apply to the Promotion. Entry into the Promotion constitutes acceptance of these terms by the entrant.

3.              Information published by the Promoter about the Promotion (including information about how to enter and prize details) (promotional material) forms part of these terms. In the event of any inconsistency between the promotional material and these terms, these terms will prevail.


PROMOTIONAL PERIOD

4.              The Promotion commences at 12:00 AM AEST on Monday November 3rd and ends at 11:59 PM AEST on Sunday November 9th (Promotional Period).


ENTRANT ELIGIBILITY

5.              Entry is only open to all Australian residents aged 18 years or over.

6.              Bonus 5 Entires are only open to all Australian residents aged 18 years or over who hold an active subscription to the DailyMail+ subscription service provided by the Daily Mail at both the time of entry and the Draw Date.

7.              Employees and contractors (and their immediate families) of the Promoter (including the Promoter's related bodies corporate), are not eligible to enter the Promotion. Persons involved in the management of or responsible for conducting the Promotion, including determining the winners, cannot participate.


HOW TO ENTER

8.              To enter, entrants must, during the Promotion Period, complete an entry form within the article.

9.              To be eligible for the 5 additional Bonus Entries, the entrant’s email address included in the entry form must match the entrant’s Daily Mail+ subscription email address. Entries by persons who are not Daily Mail+ subscribers at the time of the Draw Date are invalid and will be disqualified.

10.           Entries in any other form are invalid and will not be accepted by the Promoter.
The Promoter reserves the right to verify the validity of entries, the identity, eligibility and other details of entrants, and may disqualify any entrant who submits an entry that is false, misleading or non-compliant or otherwise undermines the fair conduct of the Promotion, or any entrant in breach of these terms.

11.           The Promoter’s decision to disqualify an entry is final and no correspondence will be entered into. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. The Promoter is not responsible for late, lost, misdirected, incomplete, incorrectly submitted, illegible or corrupted entries, or for any technical malfunctions, delays, network failures, unauthorised access (including security breaches), or other errors that may affect the conduct of the Promotion, including submission, receipt or processing of entries.

12.            Automated entries and entries made in bulk or by third parties are not allowed and will be disqualified. Entries from email sources which are recognised by the Promoter as spam will also be disqualified.

13.           There is no cost to enter, other than where the entry requires a purchase of a particular good or service, or where entry can be by phone, then the cost of that phone call (if applicable).

14.           Entrants are responsible for ensuring that all information provided in their entry is correct, current, legible and complete. The Promoter is not responsible for any errors, omissions or outdated contact details that may affect entry validity or the delivery of a Prize.


PRIZE DETAILS

15.           The prize is a Lifespan Fitness ReGen8 Solo V2 - 1 Person Infrared Sauna valued at $2999.00 (Prize).

16.           The Prize is subject to any terms and conditions of Lifespan Fitness (supplier). The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner arising from, or in connection with, the Prize or the conduct of Lifespan Fitness.

17.           The Prize is valued at AUD $2999.00

18.           All other costs associated with the Prize are the sole responsibility of the winner. The Promoter will not be liable for costs or liability incurred by a winner in connection with participating in the Promotion or the receipt or use of any Prize.

19.           Prizes will be awarded to the entrant named in the entry. Prizes may not be resold, transferred, or exchanged for cash.

20.           Prizes must be taken by the date specified in the Prize, where applicable.

21.           In the event that the Prize (or any part of the prize) become unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to substitute a prize of equal or greater value.

22.           The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination or as part of a Prize.


WINNER SELECTION

23.           This is a game of chance and the winner will be drawn randomly from valid entries received. The draw will take place at the Daily Mail’s offices on Monday November 10th at 10:00am (Draw Date). Skill plays no part in deciding the winner(s).

24.           All entrants consent to the Promoter using their name, likeness, image and/or voice if they are a winner (including any photograph or recording) in any media worldwide for an unlimited period without remuneration for the purpose of promoting this Promotion, any Prizes, and/or the Promoter. Entrants agree to participate in any reasonable promotional activities reasonably requested by the Promoter in connection with the Promotion and awarding of the Prize, at no charge to the Promoter.


NOTIFICATION OF WINNERS

25.           The winner(s) will be notified in writing using the contact details provided at the time of entry by email within 2 days of the Draw Date.

26.           The names of the winner(s) will be published on dailymail.com.au.

27.           The Prize will be delivered to the address nominated by the entrant in their email reply within 28 days of the winner claiming the prize.

28.           The Promoter will not be liable for any Prize or coupons for the Prize that have been lost, stolen, forged, damaged or tampered with in any way by third parties, including due to late, lost or misdirected mail.


UNCLAIMED PRIZES

29.           If a Prize is not accepted or claimed within 2 business days of the Draw Date, the relevant winner’s entry will be deemed invalid.

30.           The Promoter may in its absolute discretion conduct a redraw on Monday November 10th at Level 12, 207 Kent St Sydney, subject to any necessary regulatory approvals.


INTELLECTUAL PROPERTY RIGHTS

31.           All entrants consent to the Promoter using their name, likeness, image and/or voice if they are a winner (including any photograph or recording) in any media worldwide for an unlimited period without remuneration for the purpose of promoting this Promotion, any Prizes, and/or the Promoter. Entrants agree to participate in any reasonable promotional activities reasonably requested by the Promoter in connection with the Promotion and awarding of the Prize, at no charge to the Promoter.

 

32.           Entries must be the original work of the entrant. Entrants grant the Promoter a perpetual, royalty-free, irrevocable, non-exclusive licence (including the right to sublicense) to copy, use, adapt and communicate their entry content for the purpose of the Promotion and promoting this Promotion, any Prizes, and the Promoter. Entrants agree not to assert any moral rights in connection with such use.

33.           Entrants warrant that their entry is not in breach of any third party intellectual property rights. Entrants agree to indemnify the Promoter from and against all losses, damages, claims and costs arising out of, connected to, or resulting from, a breach of this warranty.

34.           Entrants must not include any content that is unlawful, offensive or inconsistent with community standards, including content that is defamatory, discriminatory or depicts others without their consent. The Promoter reserves the right to disqualify any entry that breaches copyright or contains inappropriate content.


PRIVACY

35.           The Promoter collects Entrant's personal information in order to conduct the Promotion, including communicating with entrants, verifying eligibility, awarding Prizes, and fulfilling legal and regulatory requirements. The Promoter also collects personal information to improve its products and services and for promotional, marketing, publicity, research and profiling purposes. This may include sending direct marketing communications to the entrant. Individuals who do not provide the required personal information will not be able to participate in the Promotion.

36.           The Promoter may use any disclose an entrant’s personal information for the purposes described above. This may include disclosing such personal information to third parties, including but not limited to co-Promoters, Prize sponsors, marketing agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Some of the Promoter’s third party suppliers are located overseas in the UK and the USA.  An entrant’s personal information may also be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation.

38.           This Promotion is in no way sponsored, endorsed or administered by or associated with any social media platform. Entrants release all such platforms from any liability arising from or in connection with this Promotion and agree to comply with the terms of use and community guidelines of the relevant platform when participating.

39.           By entering this Promotion, entrants consent to receiving electronic messages and direct marketing communications from the Promoter about the Promotion, and the goods and services of the Promoter, any co-promoter, sponsor or third party supplier of the Prize. GENERAL

40.           To the extent permitted by law, the Promoter (including its officers, directors, employees, agents, affiliates and subcontractors) is not liable for any direct or consequential loss, damage, delay, disappointment, or personal injury suffered by any entrant or winner in connection with entering the Promotion, participating in any activity in connection with the Promotion, or accepting or using the Prize. This includes any changes to the availability, schedule or nature of the Prize, or the winner’s inability to use it. This exclusion does not apply to any liability which cannot be excluded under the Australian Consumer Law or other relevant legislation.

41.           If for any reason the Promotion is not capable of running as planned (including for reasons of force majeure), the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to regulatory approval.

42.           Failure or delay by the Promoter to exercise a right or remedy created by these terms does not constitute a waiver of that right or remedy. A right or remedy for the Promoter cannot be waived except in writing signed by the Promoter.

43.           These terms are governed and interpreted according to the laws of New South Wales, Australia.

The Promoter reserves the right to modify these terms at any time. Any change will be effective immediately upon posting.
