TERMS AND CONDITIONS:

Information on how to enter and the prize details form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these Terms and
Conditions.

If you are an eligible person and satisfy all entry requirements as set out below, then,
subject to these Terms and Conditions, you can enter the competition draw to win a
prize (Promotion). Entries into the Promotion open at 12:00am AEDT on 26th March
2026 and close at 11:59pm AEST on 8th April 2026 (Promotional Period).

Entrant Requirements
Entry to the Promotion is open to all Australian Residents who are at least eighteen (18)
years old at the time of entry, have a valid email address and mobile number, and
comply with the ‘Entry’ provisions set out below. An ‘Australian Resident’ means a
person who resides in Australia at the start of the Promotional Period and holds
Australian citizenship or holds an Australian permanent residency visa.
Employees, directors, officers, and their immediate family and respective household
members, of:
• the Promoter
• the related bodies corporate of the Promoter;
• any advertising or promotion agencies of the Promoter;
are not eligible to enter.
‘Immediate family’ means any of the following: spouse, ex-spouse, de-facto
spouse, child or stepchild (whether natural or by adoption), parent, stepparent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister,
stepbrother, stepsister, or first cousin.
It is the responsibility of all entrants to ensure they are eligible under all applicable laws
to accept the prize offered as part of the prize draw.
Entry into the competition is free, subject to the entry requirements.
Entry into the Promotion

To enter the Promotion and be eligible for the Prize Draw, entrants must, during the
Promotion Period:
a. Purchase any FUNDAY X Barbie Berry Kisses 50g gummies pack from a Chemist
Warehouse store in Australia displaying and stocking the promotional products
(including Chemist Warehouse Online) (Participating Store) and retain their receipt;
and
b. Visit https://www.fundaysweets.com/pages/funday-sweets-barbie-loll... select the tick-box to consent to receive marketing materials from the
Promoter, and complete the online entry form by providing their full name, valid email
address, proof of purchase (receipt upload) and, if desired, a contact phone number.
Each valid purchase and completed entry form equals one (1) entry. Multiple entries are
permitted, subject to one (1) entry per eligible purchase (regardless of number of
participating products purchased in one transaction).
The use of any automated entry software, mechanical, electronic or other devices that
allow an individual to automatically enter the Promotion is prohibited and will invalidate
all entries submitted by that individual.
Entries must be submitted in the entrant’s own name and must retain their proof of
purchase. The Promoter may request proof of purchase or entrant details (including an
entrant’s identity, age and place of residence) to verify valid entries. If an entrant fails to
produce the proof of purchase for a specific entry or each entry, as and when requested
by the Promoter, the Promoter has the right to invalidate the entrant's respective
entry/entries for which proof of purchase cannot be provided and/or all entries
submitted by that entrant and/or forfeit the entrant's right to a prize. Purchase receipt(s)
must clearly specify: (a) the store of purchase as an eligible store; (b) the required
product/s or service/s to be purchased for entry; and (c) that the purchase was made
during the Promotional Period and prior to entry.
Each entry must be made in accordance with these Terms and Conditions. By entering
the Promotion, each entrant agrees to be bound by these Terms and Conditions. The
Promoter may, at its discretion, refuse to award any prize to any entrant who fails to
comply with these Terms and Conditions.
Prize:
There will be one (1) winner, who will receive the following prize:
A trip for the winner and one (1) guest to Malibu, Los Angeles, USA, to enjoy a Barbiethemed experience.
Specific Barbie experiences included in the prize are subject to availability at the time of
travel.

The prize includes:
• Return economy class flights for two (2) people from the winner’s nearest
Australian capital city to Los Angeles, USA
• Accommodation for two (2) people in one shared room for five (5) nights at 4-5
star accommodation as selected by the Promoter
• A Barbie themed lifestyle experience, as determined by the Promoter, which may
include pink convertible car day hire, a styled VIP picnic or a Malibu sunset
dinner at a 5-star restaurant, subject to availability at the time of travel
• VIP transfers (Los Angeles airport to accommodation and return)
• A food and beverage allowance of up to AUD $200 per person per day for the
duration of the trip
• All applicable taxes and standard booking fees
Airline, flight routes, accommodation, and transfer providers will be determined by the
Promoter at its discretion.

What is not included:
• Travel insurance
• Passports, visas, ESTA applications, or any other travel documentation
• Spending money beyond the stated food and beverage allowance
• Mini-bar, room service, laundry, additional meals, or incidentals
• Any activities, experiences, or costs not expressly listed as part of the prize
• Any costs incurred due to changes requested by the winner
Travel conditions:
• Travel is expected to be taken in June 2026, subject to availability
• Travel dates will be determined by the Promoter in consultation with the winner
• If the winner or their guest is unavailable to travel within the specified period, the
prize may be forfeited and an alternative winner selected
• The winner and guest must travel together on the same itinerary
• The winner and his/her travel companions are responsible for (at their own cost)
ensuring that they have valid passports, visas, satisfy immigration requirements,
vaccinations, travel insurance and travel documentation. Those without proper
citizenship documentation or travel insurance may be denied acceptance of the
prize, or participating in prize components. Winner is responsible for ensuring
that winner and his/her guests have proper citizenship documentation
• By accepting the prize, the winner and their nominated guest each represent and
warrant that they are fit, in good health, and able to travel and participate in all
elements of the prize. The winner and their guest acknowledge that it is their sole
responsibility to ensure they meet any health, fitness, or other requirements
necessary to undertake the travel and activities included in the prize. The
promoter accepts no responsibility if the winner or their guest is unable to travel
or participate due to health, fitness, or other personal circumstances.
• By accepting the prize, the winner and their guest agree to obtain travel
insurance.
• The Promoter will contribute up to $300 per person towards the cost of travel
insurance for the winner and their guest. Any additional costs associated with
travel insurance remain the responsibility of the winner and their guest.
Guest conditions:
• The winner must nominate one (1) travel companion
• The travel companion must be 18 years or over
• The winner is responsible for their guest’s conduct at all times during the trip
Prize Draw

The total retail value of the Promotion prize pool is valued up to AU$25,000 (including
GST), depending on point of departure and date of travel. For the sake of clarity, the
prize value have been calculated at the date of printing the T&Cs. The Promoter accepts
no responsibility for any change in currency or exchange rates after this date.

The draw will be conducted via a random number generator at 10:00am AEST on 9
th of
April 2026 at Suite 1 - 3, 107-111 High Street,
Prahran, VIC 3181. Eligible entrants are not required to be present at the draw to win.
If an invalid or ineligible entry is drawn, the promoter will redraw via a random number
generator at 10:30am AEST on 9th of April 2026 at Suite 1 - 3, 107-111 High Street,
Prahran, VIC 3181.
No component of the prize can be transferred or redeemed for cash or any other service
provided by the Promoter. In the event that the prize becomes unavailable, the Promoter
reserves the right to provide a similar product to the same or greater value as the
original prize, subject to any applicable laws or written directions of a relevant
regulatory authority. If a prize or part of the prize is provided to the Promoter by a third
party, the prize is subject to the terms and conditions of the third-party prize supplier.
If for any reason any aspect of this Promotion is not capable of running as planned,
including by reason of computer virus, communications network failure, bugs,
tampering, unauthorised intervention, fraud, technical failure, in the event of war,
terrorism, state of emergency or disaster, or any cause beyond the reasonable control
of the Promoter, the Promoter reserves the right to cancel, terminate, modify, or
suspend the Promotion or suspend or modify a prize, subject to any requirements of a
relevant regulatory authority.
Decisions of the Promoter are final and will be binding on each person who enters the
Promotion, and no correspondence will be entered into.
Prize Awarding

The winner will be notified in writing by direct email message through the email supplied
when entering the Promotion within 7 days of the draw and their last name, initial of
their first name and postcode published within 14 days of the draw at
www.fundaysweets.com.

Winners must respond to the Promoter’s notification message and provide details to
verify their identity in order to claim their prize. Each prize must be claimed within 2
months after the relevant publication date. Any unclaimed prize will be forfeited by the
winner.

If any winner does not satisfy these Terms and Conditions or cannot be contacted
within a reasonable timeframe in accordance with all requirements of all regulatory
authorities, the entry will be invalidated, and a further entry drawn via a random number
generator at 10:00am AEST on 23 June 2026 at Suite 1 - 3, 107-111 High Street, Prahran,
VIC 3181.All non-winning entries from the original draw will be included in the
unclaimed prize draw.

Any winner of the unclaimed prize draw will be notified in writing (via the contact details
supplied when entering the Promotion) within two (2) working days of the relevant redraw and the winner’s last name, initial of their first name and postcode will be
published on www.fundaysweets.com within 14 days of the relevant re-draw. This will
continue until a valid winning entry is drawn for each prize draw.

Exclusion of liability
To the full extent permitted by the law, the Promoter, or Participating Store, will not be
liable for any injury, damages, expenses, or loss whatsoever (whether direct or
consequential) to persons or property as a result of any person entering into the
Promotion or accepting or using any prize.

The Promoter or Participating Store is not responsible for any incorrect or inaccurate
information, or for any of the equipment or programming associated with or utilised in
this competition, or for any technical error that may occur in the course of the
administration of the Promotion.
The Promoter and the Participating Store, assume no responsibility for any error,
omission, interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorised access to or alteration
of entries.

Data collection and privacy
The Promoter collects personal information (PI) in order to conduct the Promotion and
may, for this purpose, disclose such PI to other third parties, including but not limited to,
agents, contractors, service providers and prize suppliers as required in Australia. Entry
is conditional on providing this PI. The Promoter will also use, and handle PI as set out in
FUNDAY’s Privacy Policy available
at https://www.fundaysweets.com/pages/privacypolicy
In addition to any use that may be outlined in the Privacy Policies identified above, the
Promoter may, for an indefinite period, unless otherwise advised, use the PI for
promotional, marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning the entrant.
The Privacy Policies also contain information about how entrants may opt out, access,
update or correct their PI, how entrants may complain about a breach of the Australian
Privacy Principles or any other applicable law and how those complaints will be dealt
with.
All entries become the property of the Promoter. The Promoter may disclose entrant's PI
to any entity outside of Australia in accordance with their respective Privacy Policies.
General
For the purposes of public statements and advertisements, the Promoter may only
publish the winner's surname, initial and postcode of residence.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the
event they are a winner (including photograph, film and/or recording of the same) in any
media for a reasonable period without remuneration for the purpose of promoting the
Promotion (including any outcome), and promoting any products manufactured,
distributed and/or supplied by the Promoter in connection with the Promotion.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit,
exclude or modify the statutory consumer guarantees as provided under the
Competition and Consumer Act 2010 (Cth), as well as any other implied warranties
under the Australian Securities and Investments Commission Act 2001 (Cth) or similar
consumer protection laws in the States and Territories of Australia (Non-Excludable
Guarantees). Except for any liability that cannot by law be excluded, including the NonExcludable Guarantees, the Promoter and the Participating Store (including their
respective officers, employees and agents) exclude all liability (including negligence),
for any personal injury; or any loss or damage (including loss of opportunity); whether
direct, indirect, special or consequential, arising in any way out of the Promotion.
Except or any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter and the Participating Store (including their respective
officers, employees and agents) are not responsible for and excludes all liability
(including negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any way out
of:
• Any technical difficulties or equipment malfunction (whether or not under the
Promoter’s control);
• Any theft, unauthorised access or third-party interference;
• Any entry or prize claim that is late, lost, altered, damaged or misdirected
(whether or not after their receipt by the Promoter) due to any reason beyond the
reasonable control of the Promoter;
• Any variation in prize value to that stated in these Terms and Conditions;
• Any tax liability incurred by a winner or entrant;
• Any failure by the winner or their guest to obtain travel insurance; or
• Taking of the prize/attendance at the prize event.
This promotion is governed by the laws of the Australian States and Territories in which it
is conducted, and the parties submit to the non-exclusive jurisdiction of those courts.
The Promoter, Participating Store and entrants acknowledge that this Promotion is in no
way sponsored, endorsed, affiliated or administered by or associated with Instagram,
Facebook or TikTok.
The Promoter accepts no responsibility for any tax implications and the entrant must
seek their own independent financial advice in regards to the tax implications relating to
the prize or acceptance of the prize.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a
waiver of these rights.
