The Promoter may at any time, including after the Promotional Period, verify the validity of entries and entrants and disqualify any individual who the Promoter reasonably believes has breached these Terms & Conditions, engaged in unlawful or improper conduct, or provided false or misleading information. The Promoter and service provider accept no responsibility for any injury, loss, damage, delay or additional costs incurred as a result of participation in the Prize, except where liability cannot be excluded under Australian law. 17. Flights are return economy airfares from the winner’s nearest Australian capital city to the destination specified by the Promoter. The winner’s friend must also fly out from the same airport with the winner. 18. Flights are subject to airline availability, travel dates, routes, and booking class availability. 19. Blackout dates, including peak periods and public holidays, may apply. 20. Accommodation is twin-share for a specified duration as determined by the Promoter. 23. If a winner is unaccompanied, they may be paired with another winner or allocated a shared arrangement as determined by the provider. 25. Any additional room upgrades, incidentals, or personal expenses are the responsibility of the winner. 26. Check-in/out times and property-specific terms apply. 27. The prepaid Visa e-Gift Card is subject to the issuer’s standard terms and conditions, including expiry dates and usage restrictions. 28. Entrants may access, change and/or update their personal information by contacting the Promoter on 07 3107 7422 during office hours. 39. Entrants consent to the Promoters using their name if they are a Winner in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and any of the Promoter’s products. Miscellaneous 40. The Promoter encourages consumers to enjoy liquor responsibly. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason beyond the reasonable control of the Promoter, including technical difficulties, unauthorised intervention or fraud or any person, the Promoter may, to the extent permitted by law and subject to any written direction from a regulatory authority, modify, suspend, terminate or cancel the Promotion or modify the Prize, as appropriate. 42. Nothing in these terms limits, excludes or modifies (or purports to do so) any non-excludable guarantees or warranties under consumer law (Non-Excludable Guarantees). 43. Except for the Non-Excludable Guarantees and any other liability that cannot by law be excluded, the Promoter, it’s officers, employees and agents, and its Participating Stores will not be responsible of liable for any loss or damage including, without limitation, direct, indirect, special or consequential loss or damage, or loss of opportunity and whether relating to damage to or loss of property or personal injury or death of any person and however arising and relating directly or indirectly to: (a) the Promotion and/or the taking or use of the Prize; (b) any technical difficulties or equipment malfunction outside of the Promoter’s reasonable control; (c) any theft, unauthorised access or third party interference; (d) any late, lost, altered or misdirected entries due to any reason beyond the Promoter’s reasonable control; (e) any tax liability incurred by a Winner or entrant; and/or (f) any damage to, delay in transit of the Prize during delivery or any other delay in or cancellation of the prize; (g) any other matter beyond the Promoter’s control. 44. All Reasonable attempts will be made to contact each winner. If any winner chooses not to take their Prize (or is unable to) or does not take or claim a Prize by the time specified by the Promoter, or is unavailable, they forfeit the Prize and the Promoter is not obliged to substitute the Prize. 46. The value of the Prize is accurate and based upon the recommended retail value of the Prize (inclusive of GST) at the date of printing.
