Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia Flight Centre Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry that does not comply with these Conditions of Entry will be deemed invalid. Entry into this Promotion and acceptance or receipt of the prize by the Prize Winner (“Winner”) is deemed as acceptance of these Conditions of Entry. 2. The Promoter is Commonwealth Bank of Australia (ABN 48 123 123 124) of Level 5, 201 Sussex Street, Sydney, NSW, 2000. Telephone: 13 16 61 (the "Promoter"). 3. This Promotion commences at 00.01 AEST on 1st October 2010 and closes at 23.59 AEDST on 30th November 2010 (the "Promotion Period"). All times stated in these Conditions of Entry refer to the time in Sydney, NSW. 4. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”): • the person must be over the age of 18 years and a resident of Australia; • the person is not an employee of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter) and their immediate family members (spouse, parent, sibling or child); • the person is not a director or employee of any of the companies involved in supplying prizes or its related entities directly involved in the Promotion (as determined by the Promoter) and their immediate family members (spouse, parent, sibling or child); and • the person must hold a valid Commonwealth Bank credit card (Standard, Gold or Platinum) which enables them to participate in the Commonwealth Bank Awards Program (the "Commonwealth Awards Card") at the time the prize is drawn. 5. Individuals who satisfy the Eligibility Requirements will be referred to as Eligible Entrants. To enter, Eligible Entrants must, during the Promotion Period, redeem 2,500 or more of their Commonwealth Award points in one (1) single booking at any of the following Flight Centre Limited retail brands: Flight Centre, Escape Travel, Student Flights, Travel Associates and CruiseAbout (“Eligible Redemption”). Eligible Redemptions can be made by either: (a) visiting a participating Flight Centre Limited store, making an Eligible Redemption and providing their Commonwealth Awards Card number, date of birth and phone number; (b) visiting the Commonwealth Awards website (accessible through netbank); or (c) calling a participating Flight Centre Limited brand consultant (Flight Centre on 133 133, Escape Travel on 131 927, Student Flights on 1800 069 063, Travel Associates on 1800 234 444, or Cruiseabout on 1300 745 344), making an Eligible Redemption and providing their Commonwealth Awards Card number, date of birth and phone number. 6. Eligible Entrants will receive one (1) entry in the draw for each Eligible Redemption made, via the Commonwealth Bank Awards Program during the Promotion Period. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified Eligible Redemption; and (b) each entry must be submitted separately and in accordance with entry requirements. 7. The draw will be conducted by a computerized drawing system at 15.00 on 15th December 2010 by a representative of Anisimoff Legal, Suite 1, Level 1, 34 Chandos Street, St Leonards, NSW 2065. 8. The Winner will be notified by telephone and mail within two (2) days of the draw date and by acceptance of the prize their name will be published in the public notices section of The Australian newspaper on 22nd December 2010. 9. There will be one (1) Winner. The first valid entry drawn will win two (2) return economy class airfares flying United Airlines to the Winner’s choice of either: Los Angeles, USA; San Francisco, USA; or Las Vegas, USA. Flights will depart from the Winner’s nearest capital city. Prize is valued at up to AUD$4,999 depending on date and point of departure. Flights are restricted to return "K" class economy airfares flying United Airlines and cannot be upgraded. Airfares are non-refundable and subject to availability. 10. Prize consists of airfares and airfare taxes only. Accommodation, spending money, meals, additional taxes, travel insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be booked through Flight Centre Limited by 31st March 2011 and travel must be completed by 30th June 2011. Prize is subject to the terms and conditions of Flight Centre Limited and United Airlines. Commonwealth Awards points or United Airline Miles cannot be earned from the prize. Change fees may be applicable to the airfares booked and, if so, are the responsibility of the Winner. 11. By accepting the prize, the Winner agrees that any other incidental costs including those associated with accepting or using the prize are not included. 12. The total prize value is up to AUD$4,999 based on the recommended retail value provided by the supplier and is correct at the time of printing. Prize is not transferable or exchangeable and cannot be taken as cash. The Winner accepts the prize ‘as is’ and acknowledges that the Promoter accepts no responsibility for any variation in the value of the prize or any tax implications that may arise from the prize. The Winner should seek their own independent financial advice. 13. Any Eligible Entrant whose Commonwealth Awards Card account is more than 30 days in arrears (that is, the minimum payment due on the Commonwealth Awards Card account is more than 30 days overdue) is not eligible to win the prize set out in Clause 9 above. 14. The Promoter’s decision is final and no correspondence will be entered into. 15. The Promoter accepts no responsibility for late, lost or misdirected entries. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Conditions of Entry. 16. The Promoter will use its best endeavours to provide the prize listed. If the prize is unavailable for whatever reason, the Promoter reserves the right to substitute for that prize or item for a prize or item of an equivalent value and/or specifications subject to any written directions given under applicable trade promotion laws and regulations. 17. In the event that for any reason whatsoever the Winner does not take the prize by the date stipulated then the prize will be forfeited by the Winner. 18. In the event that for any reason the prize is not accepted or claimed by 15.00 on 16th March 2011, the Promoter may conduct a further draw at the same place and time as the original draw as necessary on 15th March 2011 to award the unclaimed prize, subject to any written directions given under applicable trade promotion laws and regulations. In the case of a winner, their name will be published in the public notices section of The Australian newspaper on 29th March 2011. 19. If for any reason this Promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the relevant State and Territory regulators, to cancel, terminate, modify or suspend the Promotion. 20. Any cost associated with accessing the promotional website is the dependent on the Internet Service Provider used and is the responsibility of the Eligible Entrant. 21. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this Promotion. 22. To the extent permitted by law, the Promoter and its related entitles and its and their respective directors, officers, employees and agents, excludes all liability (including negligence) for any: a. loss or damage whatsoever which is suffered or sustained (including but not limited to direct, indirect, special or consequential, financial or other loss); b. personal injury suffered or sustained; c. technical difficulties or equipment malfunction (whether or not under the Promoter’s control); d. variation in prize value to that stated in these Terms and Conditions; e. theft, unauthorized access or third party interference; f. tax liability incurred by the Winner or Eligible Entrants in connection with participation in the Promotion or the receipt or use of the prize by the Winner. 23. By acceptance or receipt of the prize, the Winner consents to their name and photograph being used for promotional purposes by the Promoter without any further reference, payment or other compensation to them, including sending the Winner electronic messages. 24. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of benefit or interest to you. If you provide the Promoter with incomplete or inaccurate information or do not satisfy the Eligibility Requirements, your entry will be void.
