TERMS & CONDITIONS:
This document sets out the terms of participation in Toga Hospitality "Pass the Cocktail" Competition (the "Competition").

1. The promoter of the Competition is MEDINA PROPERTY SERVICES PTY LIMITED T/As TOGA HOSPITALITY (the "Promoter") (ABN 36 062 326 176) of Level 5, 45 Jones Street Ultimo, Sydney, NSW, 2000. Postal Address: Same.

2. The Competition is open to all Australian residents. An entrant must be an individual and not a company or organisation. Employees of the Promoter and their immediate families and any organisation or individual associated with the provision of the prize(s) are not eligible to enter. Entrants under 18 will require the permission of a parent or guardian.

3. Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, each entrant agrees to be bound by these Terms and Conditions. The Promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. All relevant instructions on the Promoter's website form part of these Terms and Conditions.

4. Entry into the Competition is free.

5. The Competition opens at 12pm (AEST) on Monday 1 November 2010 and closes at 12pm (AEST) on Monday 29 November 2010 ("Competition Period"). Any entry received after the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or mirected entries.

6. To enter the Competition you must:
(a) enter in one friend's name and valid email address through the Pass the Cocktail promotion at www.vibepassthecocktail.com.au ("Website")
(b) submit your name, address, phone number and email through the Website to claim the prize.

7. You may enter the Competition more than once (limit one entry per day during the Competition Period) Entry is limited to one email per day.

8. All valid entries will go into the 'instant win' draw and are instantly advised if they are a randomly selected winner ("Prize Winners"). Winners of prizes over $250 will be published in the Australian on Monday 6 December.

11. The total maximum prize pool of the Competition is valued at up to AU $38,364.00

12. The Promoter takes no responsibility for any variation in prize value.

13. No component of an instant prize or weekly prize can be transferred or redeemed for cash. In the event that any of the prizes become unavailable due to circumstances beyond the Promoter's control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.

14. If you opt in to receive further information, you agree that the Promoter may use your entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee being paid to you.

15. Decisions of the Promoter are final and will be binding on each person who enters the Competition and no correspondence will be entered into. Please allow 28 days from date of notification for the delivery of the prizes. If a prize is not received within 28 days after the conclusion of the Competition a Prize Winner should contact Toga at sales@toga.com.au

16. In the event that any prizes are not allocated during the competition period unallocated prizes will be reallocated to competition entrants through a redraw.

17. In the event that an instant win Prize Winner is unable to be contacted, the Promoter will retain the prize for three (3) months from the date of the prize was allocated. If the prize is not claimed within three (3) months of the date of initial instant win, the Promoter will redraw another winner for the unclaimed prize. Should the prize be unclaimed, or the winner unable to claim the prize for whatever reason, a reallocation of the instant win prize by redraw will take place at 12:00 on Tuesday 1 March 2011 at Autumn 01 Pty Limited, Level 5, 88 Pitt Street, Sydney Australia. The winners from this draw will be notified by email. Any unclaimed draw winners of prizes over $250 will be published in the Australian on Wednesday 15 March 2011.

18. If there is any event that prevents or hinders the Promoter's conduct of the Competition or the Promoter's ability to deliver the prize to the Prize Winners, the Promoter may, in its discretion, cancel the Competition and recommence it at another time under the same conditions or select another winner, subject to written directions from state regulatory bodies.

19. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

20. To the full extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize and damage to any prize in transit.

21. The Promoter respects your personal information (PI). All PI collected by the Promoter will be dealt with under the privacy policy which can be viewed here or sent to any person on request. PI is collected to enable the Promoter to administer and promote this Competition and the winners. The Promoter may also use PI collected for future promotional, marketing and publicity purposes. PI collected will not be disclosed by the Promoter to any third parties. Any person is entitled to contact the Promoter and request access to any PI the Promoter holds about them, at any time. If an entrant does not truthfully provide the entire requested PI on the competition entry form they may not be eligible to enter this Competition or win any prize.

Did anyone have to sign a receipt for their prizes or were they just delivered?  My husband won a pattie maker on the 5th November and no sign of it yet.  A vibe cookbook won last week arrived today, cover detached though, so not even in good condition.  Does anyone have any contact details for them, I looked but couldn't find anything.
