TERMS AND CONDITIONS


ELIGIBILITY TO ENTER

1.    Entry is only open to Australian residents aged 18 years or over who register to participate in the promotion (“Eligible Entrants”). While individuals will be able to sign up online for the promotion from 10/01/2011, they will be unable to earn promotional points or participate on any point associated activities until 12noon AEDST on 22/03/2011.

To register via the promotional website, individuals must visit www.goldbunny.com.au follow the prompts to the registration page, input the requested details including their full name, date of birth, mobile phone number, valid deliverable email address, their State/Territory, opt in to receiving a daily promotional email, select whether they wish to opt in to receive a weekly promotional SMS and then submit the fully completed registration form between 12noon AEDST on 10/01/2011 and 11.59am AEST on 07/04/2011 (“Registration Period”).

Individuals can sign up via SMS between 12noon AEDST on 07/03/2011 and 11:59am AEST on 07/04/2011. To sign up via SMS, individuals must simply text their full name and valid deliverable email address (in that order, with a space between each item) to 0438066066. A confirmation SMS will be sent to the entrant’s phone with a link to the www.goldbunny.com.au microsite. The entrant must then visit the microsite link, follow the prompts to the registration page, input the requested details including their full name, date of birth, mobile phone number, valid deliverable email address, their State/Territory, opt in to receiving a daily promotional email, select whether they wish to opt in to receive a weekly promotional SMS and submit the fully completed registration form between 12noon AEDST on 07/03/2011 and 11:59am AEST on 07/04/2011. Standard SMS charges will be applicable for the SMS messages sent to the above number by the entrants. The exact SMS entry cost will vary dependent on the mobile network used but will not exceed 55c. No charge will be applicable for the message(s) received by the entrant from the Promoter. Individuals must have a mobile phone capable of accessing internet to access the promotional website via this method.

2.    Employees of the Promoter, their immediate families and agencies associated with this promotion are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 


DONATION WIDGET

3.    A donation widget for the Children’s Hospital in Westmead will also be featured on the promotional website. The Promoter will donate $1 to the Children’s Hospital in Westmead at the end of the promotion for each individual that registers for the promotion during the Promotional Period, up to a maximum donation of $20,000.

LEADERBOARD

4.    To be eligible to compete in the final Hunt for the Gold Bunny, Eligible Entrants must earn enough promotional points to finish in one of the top ten places on the leaderboard at the end of the Promotional Period (“Top Ten Finalists”). 

5.    Eligible Entrants can earn points by performing a variety of promotional activities, between 12noon AEDST 22/03/2011 and 12noon AEST on 07/04/2011 (“Promotional Period”), as follows:

a)    By solving/answering a series of clues, released daily throughout the Promotional Period (“Daily Clues”) on the promotional website. Daily Clues will be of varying levels of difficulty and carry a different number of points (as specified on each Daily Clue). All Eligible Entrants will also receive each Daily Clue, on the day the clue is released via email. Eligible Entrants who opt in to receive SMS messages from the Promoter will also receive a weekly promotional SMS message reminding Eligible Entrants to solve the relevant Daily Clues. Answers to the Daily Clues will be available through a number of channels including selected news websites, television, blogs, social profiles and the Lindt Australia website.   

Answers/solutions to the Daily Clues must be submitted by visiting www.goldbunny.com.au and following the prompts to submit the answers/solutions for the Daily Clues at any time during the Promotional Period (after a Daily Clue is released). Individuals can access the promotional website either via computer or via their mobile phone browser (provided that their mobile phone is compatible and has all of the software required to enable internet access to the promotional website).

Eligible Entrants can only submit an answer to each Daily Clue once. If an Eligible Entrant submits an incorrect answer/solution to a Daily Clue they will be unable to receive points associated with that particular Daily Clue. If an Eligible Entrant submits a correct answer/solution to a Daily Clue, they will be allocated the number of points associated with that Daily Clue. 

b)    By solving/answering a series of time sensitive bonus clues, released at random times throughout the Promotional Period (“Bonus Clues”). Bonus Clues will be of varying levels of difficulty and carry a different number of points (as specified on the Bonus Clue). Bonus Clues will be released via the Lindt Gold Bunny Facebook and Twitter profiles at various times throughout the Promotional Period. Answers to the Bonus Clues will be available through a number of channels including selected news websites, blogs, social profiles and the Lindt Australia website.

Bonus Clues will be time sensitive, and therefore must be answered in a certain time frame within the Promotional Period, as specified on the Bonus Clue when it is released.

Answers/solutions to the Bonus Clues must be submitted by visiting www.goldbunny.com.au and following the prompts to submit the Bonus Clue answer/solution during the specified time frame for that Bonus Clue. Individuals can access the promotional website either via computer or via their mobile phone browser (provided that their mobile phone is compatible and has all of the software required to enable internet access to the promotional website).

Eligible Entrants can only submit an answer to each Bonus Clue once. If an Eligible Entrant submits an incorrect answer/solution to a Bonus Clue they will be unable to receive points associated with that particular Bonus Clue. If an Eligible Entrant submits a correct answer/solution to a Bonus Clue, they will be allocated the number of points associated with that Bonus Clue. 

c)    By following the prompts on the promotional website to sign up to the Lindt Australia database.

Eligible Entrants will receive the allocated number of points for sign up to the Lindt Australia database via the microsite only. If an entrant signs up to the Lindt database outside of the www.goldbunny.com.au microsite they will not receive any points. Eligible Entrants can only sign up to the database once.

d)    By following the prompts to play the online promotional games available on the promotional website. There will be a total of five online promotional games made available to play during the Promotional Period. Each game will have a capped number of points “top score”, as specified on the promotional website. The allocated number of points for each game will be awarded to the Eligible Entrants based upon how well they play the game, up to the maximum capped “top score”. Eligible Entrants can only receive one score for each of the five games (i.e. the Eligible Entrant’s highest score in that particular game), regardless of the number of times they play each game. Promotional games are not mobile compatible, therefore must be accessed and played via a compatible computer.

e)    By following the prompts on the promotional website to refer the promotion to a maximum of five friends. Eligible Entrants must provide a valid deliverable email address for each friend to be eligible to receive a point(s) via this method. A certain capped number of points (as specified on the promotional website) will be provided for each referred friend that signs up to the Lindt Gold Bunny Hunt database. Eligible Entrant’s cannot refer the same friend twice. The operation of the “refer a friend” mechanic is subject to the Spam Act 2003. Entrants should only refer friends, family, colleagues and other individuals who they have a direct relationship with, and who consent to receiving these types of messages.

More detailed instructions on how to obtain and solve Daily and Bonus Clues, play the online promotional games, sign up to the Lindt Australia database and refer friends will be available on the promotional website throughout the Promotional Period. Points will be tallied throughout the Promotional Period and a leaderboard of the Eligible Entrants scores will be featured on the promotional website. 

TOP TEN FINALISTS

Should multiple Eligible Entrants be tied for the tenth position on the leaderboard at the end of the Promotional Period, a draw will be conducted at Draft FCB, 4/520 Bourke Street, Melbourne VIC 3000 on 08/04/2011 at 3pm from the tied Eligible Entrants so that the remaining position(s) can be determined, and the Top Ten Finalists selected.

The Top Ten Finalists will be contacted by phone and in writing and their names will be published in The Australian on 13/04/2011.

THE HUNT

6.    The Top Ten Finalists will be given the opportunity to compete in the hunt for the $20,000 Lindt Gold Bunny prize in Central Sydney NSW 2000 (“Event Venue”) on 14/04/2011 between 6am and 3pm, local time (“the Hunt”). The Promoter will notify the Top Ten Finalists of the exact time/location the Hunt will take place, closer to the day of the actual Hunt. If a Top Ten Finalist cannot attend the Hunt, the Top Ten Finalist may appoint a proxy over 18 years of age to attend and participate in the Hunt on his/her behalf, provided that the Top Ten Finalist gives the Promoter written, signed notice to that effect before the start of the Hunt. If the Promoter has not been able to contact a Top Ten Finalist or if a Top Ten Finalist fails to nominate a proxy before the start of the Hunt, a representative of the Promoter will participate in the Hunt on the Top Ten Finalist’s behalf. There will be 10 Participants (“Participants”) at the Hunt, with each of the Top Ten Finalists represented.

7.    There will be a total of ten dig sites at the Event venue (“Dig Sites”). Only one of the ten Dig Sites will contain a Gold Bunny, which represents the Major Prize (as defined below). The remaining nine Dig Sites will represent the Consolation Prize (as defined below). Upon arrival at the Event venue the Participants will be randomly assigned a Dig Site  (i.e. the ten finalists’ names will be placed into a box and the first name drawn will be assigned Dig Site 1, second name drawn will be assigned Dig Site 2, and so on until all ten Participants have been drawn). The Participant must dig in the Dig Site allocated to them only and cannot interfere with the Dig Sites of the other Participants.  If a Participant is found to have breached this condition, he/she will be disqualified. The Participant who finds the Lindt Gold Bunny within their designated Dig Site will win the Major Prize. The other nine Participants will win the Consolation Prize. Prizes will be awarded to the respective Top Ten Finalist and not to a proxy taking part in the Hunt (in the event that a Top Ten Finalist is unable to take part in the Hunt).

TOP 10 FINALIST AND THE HUNT PRIZES

8.    To participate in the Hunt, any Participants from VIC, ACT, SA, WA, QLD, NT or TAS will receive return economy flights (including any applicable airfare taxes) to Sydney from their nearest capital city for the Finalist (or their proxy, as applicable) and one adult guest and one night’s twin share accommodation in Sydney at a minimum three star hotel for two adults (“Travel Prize”). Each Travel Prize is valued at up to $1,200, depending on the point of departure.

If the winner is from NSW, then the Travel Prize does not include airfares and the airfare component of the prize is not redeemable for cash. Spending money, meals, additional taxes, insurance, transport to and from departure point, additional transfers, items of a personal nature (including but not limited to in-room charges) and all other ancillary costs are not included. The Travel Prize must be taken to coincide with the Hunt and is subject to booking and flight availability.

The Participant and any companion must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the Travel Prize. Travel Prize is subject to the standard terms and conditions of individual prize and service providers and the Travel Prize winner may be required to present a credit card at the accommodation check in.

In the event that a Top Ten Finalist is unable to travel and fails to nominate a proxy, the Travel Prize will not be awarded and will be forfeited.

9.    The Participant who finds the Lindt Gold Bunny hidden in their designated Dig Site will win $20,000 (awarded in the form of a cheque) and a Lindt product hamper (consisting of a selection of Lindt products determined by the Promoter in its absolute discretion) valued at $250 (“Major Prize”). The Major Prize will be given to the winner on the Hunt event day (or the winner’s proxy, to accept on behalf of the winner).

10.    The nine Participants whose Dig Site does not contain the Lindt Gold Bunny will each win a Lindt product hamper (consisting of a selection of Lindt products determined by the Promoter in its absolute discretion) valued at $250 (“Consolation Prize”). The Consolation Prizes will be given to the winners on the Hunt event day (or the winner’s proxy, to accept on behalf of the winner)

11.    The Major Prize winner and the Consolation Prize winners will be notified in person and in writing and their names will be published in The Australian on 21/04/2011.

12.    The total prize pool for this section of the promotion is up to $34,500.


MINOR PRIZE DRAWS AND PRIZES

13.    All individuals who register to participate in the promotion (as per clause 1) during the Registration Period will be automatically entered in to the minor prize draws.

14.    Entries close for each minor draw at 11.59am AEST/AEDST (as applicable in VIC) on the dates specified in the table below. All minor draws will take place at Anisimoff Legal, 448 St Kilda Road, Melbourne VIC at 12noon on the dates specified in the table below.  Entries in each minor draw will be entered into all subsequent minor draws. Minor prize winners will be notified in writing and their names will be published in The Australian on the dates specified in the table below.

15.    The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn in any draw.

GENERAL

18.    Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

19.    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

20.    Incomplete or indecipherable registrations will be deemed invalid.

21.    Individuals can only register to participate in the promotion once. Multiple registrations by the same individual will invalidate all registrations by that individual and will result in disqualification. All Eligible Entrants must work independently and cannot register jointly or work together to earn points. Any collusion (including but not limited to bonus code and clue/solutions sharing) of two or more individuals will result in disqualification. Individuals who are disqualified from the promotion at any stage are prohibited from re-registering and participating in the promotion.

22.    If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.

23.    Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the Eligible Entrant.

24.    The Promoter’s decision is final and no correspondence will be entered into.

25.    Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize or an element of a prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

26.    If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

27.    Total prize pool value is up to $37,200.

28.    Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

29.    A draw for any unclaimed minor prizes, Consolation Prizes or the Major Prize (if unclaimed) may take place on 14/07/2011 at 3pm at Anisimoff Legal, 448 St Kilda Road, Melbourne VIC, subject to any directions from a regulatory authority. Any winners will be notified in writing and their names will be published in the Australian on 28/07/2011.

30.    Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

31.    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

32.    Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

33.    The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter or earn points repeatedly (or in excess of the allocated number of points for the particular activity) is prohibited and will render all entries/points submitted/earned by that Eligible Entrant invalid.

34.    Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) use of/taking of a prize; or (g) participation in the Hunt.

35.    As a condition of accepting a prize, each winner/Finalist/Participant (and any companions, as applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 

36.    The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. I think that's because this is a good competition to cheat in. The top 5 have all got 3700 points. It's a pity the promoter doesn't stop it. The didn't last year, either. This is a good comp to waste time on if you don't won't to win anything.

How do I earn points?
Answer

You earn points through a number of activities and tasks that have been set up. By completing these tasks and answering bonus clues, you increase your point score which then could place you in the Top 10. To participate in the final dig for the Gold Bunny and $20,000 prize, you must make it into the Top 10 Leader board. You can achieve this by completing the following:

1. Sign up to the Lindt Gold Bunny Hunt. (150 points)
2. Access your daily email to help solve the daily clues. (points per clue vary on the level of difficulty of each clue)
3. Answer all of the daily clues as well as any bonus clues. (points per clue vary on the level of difficulty of each clue)
4. Follow us on Facebook and Twitter to keep track of bonus clues as they are released. (there are no points for following us on Facebook or Twitter - but you will have access to the bonus clues)
5. Play the addictively fun Lindt Gold Bunny Games for extra points. (each game is worth a capped maximum of 200 points, in total, playing all the games at your very best will earn you a total of 1,000 points)
6. Invite 5 friends to join the Hunt (but choose your friends wisely as you only get the points if they sign up with the email address you submit). (each friend that signs up using the email address that you invited them on will earn you an additional 300 points each)
7. Sign up to receive the Lindt Australia newsletter. (this is worth 800 points)

etc, etc, so it adds up to 3700

they are not cheating - its easily achievable
