TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet only.

2. Entry is only open to residents of Australia aged 18 years or older (“Eligible Entrant”). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies (and immediate families) associated with this promotion are ineligible to enter the promotion.

3. The promotion commences at 09:00 am (AEDT) on Sunday 6th March 2011 and closes 11:59 pm (AEST) Saturday 30th April 2011 (“Promotional Period”). Instant Win Prize winners will be notified instantly on-screen on the Promotional Website and in writing. The names and localities of winners of Instant Win Prizes valued at $250.00 or more will be published in The Australian on Friday 6th May 2011. The Tell A Friend Prize Winner will be notified in writing, and their name and locality will be published in The Australian on Friday 6th May 2011. The Promoter’s decision is final and no correspondence will be entered into.

4. To participate in the promotion Eligible Entrants must, during the Promotional Period, log on to www.reflexdancer.com.au (“Promotional Website”), click on the competition link to ‘Play the Reflex Boombox’ and correctly complete and successfully submit the online registration form as required, which may include providing the Eligible Entrant’s full name, date of birth, gender, residential address, phone number and current and valid email address (“Registration”). Once an Eligible Entrant successfully completes Registration, the Eligible Entrant will be directed to play the online ‘instant win’ game (“Instant Win Game”) during the Promotional Period. Once an Eligible Entrant completes the Instant Win Game, a message will immediately appear on screen advising the Eligible Entrant whether or not they are an instant winner. Registered Eligible Entrants can play a maximum of one (1) Instant Win Game each day by logging back into the Promotional Website after initial Registration and entering their email address and date of birth that was nominated upon Registration.

5. Participation in the Instant Win game requires Internet access, and any one of the following operating system and Web browser combinations: PC Operating systems: Windows XP, Windows Vista, Windows 7 AND one of: IE version 6.0+, Firefox 2.0+, Google Chrome, AOL 9; MAC Operating systems: MacOS X AND one of: Firefox 2.0+, Safari.

6. Eligible Entrants who have completed Registration and completed the Instant Win Game will also be provided with an opportunity to invite friends or relatives to enter the promotion. To invite friends or relatives, Eligible Entrants must submit their friends’ or relatives’ names and email addresses (and any other required information) in the manner required and where indicated when they have completed the online game. Eligible Entrants who invite friends or relatives to enter the promotion will gain one (1) entry into the ‘Tell A Friend Prize Draw’ for each unique friend/relative they invite in the required manner. The referred friend or relative will then receive an email stating that the Eligible Entrant has recommended them and will be given the option to either complete Registration and play the Instant Win Game or unsubscribe. An Eligible Entrant may refer up to five (5) friends or relatives each day during the Promotional Period after playing the Instant Win Game to gain up to five (5) entries each day for themselves into the Tell A Friend Prize Draw’. The operation of this referral mechanic is subject to the Spam Act 2003. An Eligible Entrant may refer a particular friend or relative only once during the Promotional Period and Eligible Entrants who have already entered the promotion cannot be referred as friends or relatives by a subsequent Eligible Entrant. Each Eligible Entrant’s relative or friend nominated must be an Australian resident and be aged 18 years or older. Each Eligible Entrant warrants that any and each friend or relative that they nominate is known to them personally and that they have permission to send email communications to such persons.

7. Up to three (3) Registrations permitted per household, however only one (1) Registration permitted per Eligible Entrant. One (1) Instant Win Game play per day per Registration with up to a maximum of five (5) entries into the Tell A Friend Prize Draw per day via the online referral mechanic stated in Condition 6. For the purposes of this promotion a ‘household’ is deemed to be the residential address stated in an Eligible Entrant’s Registration.[/color]

8. Entries must be received by the Promoter during the Promotional Period. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission.

9. Costs associated with accessing the Promotional Website remain an Eligible Entrant’s responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly on the Promotional Website by an Eligible Entrant will deem an entry invalid.

10. INSTANT WIN PRIZES: A total of 200 instant win prizes may be won by playing the Instant Win Game (“Instant Win Prizes”). Eligible Entrants will be immediately notified on-screen and by email if they are an instant winner. Each winning message will contain details of the Instant Win Prize that has been won. Instant Win Prizes will be delivered to the Instant Win Prize winner’s address as nominated by the Eligible Entrant at time of Registration. Instant Win Prizes will be delivered only after the Promoter has conducted any verification necessary to determine the validity of the entry and/or Eligible Entrant. The total maximum value of the Instant Win Prizes is $24,000.00 (Recommended Retail Price including GST). The Instant Win Prizes are:

d. Forty (40) x Ticketek Gift Vouchers each valued at $250.00. Ticketek Gift Vouchers can only be redeemed at Ticketek Box Offices and Agencies in NSW, ACT, VIC, QLD, SA, WA and TAS. Ticketek does not have retail outlets in NT. Ticketek will not refund Gift Vouchers for winners drawn in NT. At the Promoter’s discretion, winners residing in NT will have the choice of a cheque in the sum of $250.00 in place of the Ticketek Gift Voucher. Ticketek Gift Vouchers are valid for 6 months from the date of purchase and must be redeemed within that period. Ticketek will not refund any Gift Vouchers which are lost or stolen. 11. Any vouchers issued by the Promoter as an Instant Win Prize are subject to prevailing terms and conditions of use and may have further time and use restrictions (including expiration dates). Vouchers are not replaceable if lost or stolen.

12. TELL A FRIEND DRAW AND PRIZE: The Tell A Friend Prize Draw will take place at midday (AEST) on Monday 2nd May 2011 at Communicado, Level 1, 554 High St, Prahran VIC 3181. The first eligible entry randomly drawn from all entries received in the Tell A Friend Prize Draw will win $1,000.00 cash, awarded in the form of a cheque in the name of the winner (“Tell A Friend Prize”).

13. Total maximum prize pool value is $25,000.00. The Promoter accepts no responsibility for any variation in prize values. The prizes are non-transferable, non-refundable and non-redeemable for other goods or services. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Prize values are the recommended retail price including GST.

14. Prizes will only be awarded where the Instant Win Game fulfils all of the requirements of the Promoter's verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.

15. If any prize or element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable State or Territory legislation.

16. Eligible Entrants can only enter in their own name. Eligible Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of the household of an Eligible Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request an Eligible Entrant produce, within the requested time and before issuing a prize, appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) to verify an Eligible Entrant’s identity, age, residential address and email address, eligibility to enter and claim a prize and any information submitted by an Eligible Entrant in entering the promotion. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Eligible Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Eligible Entrant will be ineligible and deemed invalid.

17. If there remain unclaimed Instant Win prizes or the Tell A Friend Prize is unclaimed (“Unallocated Prizes”) as at 11:00 am (AEST) on Friday 12th August 2011 then:

a. the Unallocated Prizes will be deemed to be unclaimed prizes; and
b. the Unallocated Prizes will be distributed as follows: the Promoter will conduct such further draws as are necessary at the same time and location as the original draw on Friday 12th August 2011 in order to distribute any Unallocated Prizes as at that date subject to any written directions given under State or Territory legislation. The first eligible entry randomly drawn will be awarded the unclaimed Tell A Friend Prize and all other subsequent entries randomly drawn will be awarded any unclaimed Instant Win Prizes. In the event of any winner or winners in the unclaimed prize draw, the winner will be notified by telephone and in writing (mail or email) and the names and locality of winners of prizes valued at over $250.00 will be published in The Australian on Wednesday 17th August 2011.

18. If a dispute arises regarding who submitted an entry in the Instant Win Game, the game play will be deemed to be submitted by the authorised account holder of the current and valid email address provided at the time of entry. An authorised account holder is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organisation responsible for assigning email addresses for the domain associated with the relevant submitted email address.

19. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

20. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any Eligible Entrant for: (a) tampering with the entry process or game play; (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Eligible Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

21. Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or Game Website or the information on the Promotional Website or Game Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an Eligible Entrant, the Eligible Entrant agrees to indemnify the promoter for those losses, damages and costs.

22. The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to Eligible Entrant's or any other person's computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

23. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under applicable State or Territory legislation.

24. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.

25. The Promoter reserves the right, in its sole discretion to terminate, modify, cancel or suspend game play of the Instant Win Game for fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other causes that may corrupt the administration, security or proper participation of the Instant Win Game and if terminated, award the Instant Win Prize(s) from among all eligible, non-suspect entries received up to time of cancellation.

26. Game plays of the Instant Win Game generated by script, macro, robotic, programmed, or any automated or other means to manipulate or alter the normal functions of the Instant Win Game are prohibited and the Eligible Entrant and all entries from their household will be disqualified.

27. The use of any automated entry software or any other mechanical or electronic means or which otherwise allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant and all entries from their household invalid.

28. Proof of transmission (including but not limited to screenshots or captures of game plays etc) does not constitute proof of Instant Win. Proof of Instant Win or on-screen message will not be deemed to be proof of winning by the Promoter.

29. In the event of any conflict with any promotion details contained in these Conditions of Entry and in any other promotional materials (including but not limited to point of sale, television, and print advertising, promotional packaging and other promotional mediums), the details of the promotion contained in these Conditions of Entry shall prevail.

30. It is a condition of accepting a prize that a winner may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.

31. As a condition of entering this promotion, an Eligible Entrant consents to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Eligible Entrant agrees that, in the event they are a winner, the Eligible Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

32. An entry (including but not limited to materials submitted in connection with the Instant Win Game) and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. The Promoter collects personal information about an Eligible Entrant to include the Eligible Entrant in the promotion and where appropriate award prizes. If the personal information requested is not provided, the Eligible Entrant cannot participate in the promotion.

33. An Eligible Entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant State or Territory lottery legislation. Eligible Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter at the address below. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.

34. By participating in the promotion, an Eligible Entrant also acknowledges that a further primary purpose for collection of the Eligible Entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Eligible Entrant in the future with information on special offers or provide the Eligible Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the Eligible Entrant with special offers in this way.
