Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Entry is only open to residents of Australia who are aged 18 years or over and who are available to be in Sydney, Australia on 11/04/11 between 12.30pm AEST – 3.30pm AEST. 3. Employees and their immediate families of the Promoter and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. To enter the competition, individuals must, during the Promotional Period, visit www.facebook.com/Triumphtriaction, follow the prompts to the competition entry page and: a) “like” the triaction® page; and b) follow the on-screen prompts to input all of the requested details, including an answer to the promotional question featured on the website. There is a strict limit of 25 words per answer. 7. Individuals must have a current Facebook membership to be able to “like” the triaction® page and be eligible. Individuals can only “like” the triaction® page once, however, individuals can submit subsequent entries by clicking the “Enter Now” tab on the triaction® page and following the on-screen prompts to input all of the requested details. 8. Incomplete, indecipherable or incomprehensible entries will be deemed invalid. 9. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements. 10. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on originality and the creative and literary merit of the answer/message. The best 20 valid entries, as determined by the judges, will each be invited to attend a group training session with celebrity personal trainer, Michelle Bridges. Each winner will also be entitled to invite one eligible friend to join them at the event. 16. The group training session event will take place on Monday 11th of April 2011, 12.30pm AEST – 3.30pm AEST, at Sydney’s Fitness First Bondi Platinum, Level 6, Bondi Junction Westfield. Winners are responsible for all costs associated with travel to and from the event, including flights (if required). 17. The event will include the following: - Motivation speech and fitness tips from Michelle Bridges; - One hour group fitness class instructed by Michelle Bridges; and - Meet and greet and autograph signing. The Promoter accepts no responsibility and will not offer any alternative in the event that one or more of these elements of the prize cannot be offered for any reason. 18. If for any reason a winner is not able to attend the event, he/she must advise the Promoter by the time stipulated by the Promoter and then the prize will be forfeited. The Promoter will then reallocate the prize to one of the reserve winners. 19. Prizes are not transferable or exchangeable and cannot be taken as cash. 20. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 22. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 28. As a condition of accepting the prize, each winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In addition, the winners may be required to sign a Talent Agreement, in a form determined by the Promoter in its absolute discretion setting out the entrant’s obligations with respect to participation in media interviews, photographic sessions, and other media related marketing, advertising, promotional and/or publicity activities as a winner. 30. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
