Terms and Conditions:

1. Information on how to claim & entitlements forms part of these Terms & Conditions.

2. A claim under this offer constitutes acceptance of the above Terms and Conditions.

3. The offer is only open to “Eligible Claimants”, being individuals who:
I. are residents of Australia and
II. are not employees of the Promoter, or any of its related corporations or any of their agencies associated with the Promotion; and
III. are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee; and
IV. are not purchasing as part of a business or commercial venture.

4. Failure to enforce any clause of these Terms & Conditions shall not constitute a waiver of that or any other provision by the Promoter.

5. The Promotion commences at 12.01am on 1 March 2011 and concludes at 11.59pm on 31 July 2011. All claims must be received by 31 July 2011. ("Promotion Period").

6. No responsibility accepted for late, lost or misdirected claims.

7. Incomplete, indecipherable or illegible claims will be deemed invalid.

8. TO CLAIM: the claimant is required to log on to www.dilmah.com.au/sample (Promotion website) and fully complete the online claim form.

9. The first 1000 valid claims received will receive a Dilmah Exceptional Sample Pack. Claims will be fulfilled on a 'first received, first served' basis until stocks of the Sample Pack available for this Promotion run out or until 31 July 2011 (whichever occurs first).

10. The Sample Pack is not transferable or exchangeable and cannot be taken as cash.

11. Claims are limited to one (1) claim per household.

12. This offer cannot be used in conjunction with any other offer and/or promotion/advertised special and only applies to packs of Dilmah tea.

13. Any costs associated with accessing the Promotion website is the claimant’s responsibility and is dependent on the internet service provider used. Any contact details incorrectly entered on the website may invalidate the relevant claim, in the Promoter’s sole discretion.

14. Claimants must allow 4 weeks for delivery of their Sample Pack.

15. The Promoter reserves the right to verify the validity of claims at any time during or after the promotion, and to disqualify any claimant who tampers with the claim process or who submits a claim that is not in accordance with these Terms and Conditions.

16. The Promoter reserves the right to request Eligible Claimants to provide proof of identity and residency at the nominated delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

17. The Promoter’s decision is final and no correspondence will be entered into.

18. Confirmation of printing errors and other quality control matters will not be used as a reason for refusing payment of claims.

19. Where the Sample Pack is unavailable for reasons beyond the Promoter’s control, the Promoter retains the right to substitute the gift with a gift of equal or greater value.

20. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of participating in the offer, except for any liability which cannot be excluded by law.

21. If for any reason this Promotion is not capable of running as planned by the Promoter (which includes any matter beyond the control of the Promoter including but not limited to tampering, unauthorized intervention, fraud, or any other cause(s) which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion) then the Promoter reserves the right to disqualify any individual and to cancel, terminate or modify or suspend the Promotion.

22. All claims become and remain the property of the Promoter. The Promoter collects claimants’ personal information in order to conduct the Promotion. If the information requested is not provided, the claimant may not participate in the Promotion. By claiming under this offer, unless otherwise advised, each claimant also agrees that the Promoter may use this information to conduct the Promotion and may disclose it to organisations that provide it with administrative services in this regard. Claimants consent to the Promoter so using and disclosing personal information. If claimants tick the opt-in box on the Promotion claim form, claimants also agree that the Promoter may send future material for its future Promotional, marketing and publicity purposes. The Promoter is bound by the National Privacy Principles under the Privacy Act 1988. All personal information will be stored at the office of the Promoter. Claimants are entitled to access, update or correct this information. Any request to do so should be directed to the Promoter at its address set out below.

This offer may have ended already. The form loaded for me but when I submitted it although the url had "thank you" in it the actual page loaded with a message saying "Page not found". I think it's a developer's lazy way of removing the offer (it would have been better to amend the form page to remove the form and leave a message that the sample allocation had been exhausted).
