TERMS & CONDITIONS OF ENTRY
Information on how to enter the NIVEA Facebook Promotion (Promotion) and prizes form part of these terms and conditions of entry. By participating in this Promotion you accept these terms and conditions. Entries not made in accordance with these terms and conditions will be disqualified.
The Promotion is open to Australian residents only. All entrants under the age of 18 acknowledge the winning prize will be registered in the name of their parent or legal guardian. The Promoter’s employees and their immediate families and the Promoter’s agencies associated with this Promotion are not eligible to enter.
Promotion commences 9.00am AEST on 15/05/2011 and entries close at 11.59pm AEST on 30/06/2011 (Promotion Period). This Promotion is a game of chance and skill plays no part in determining the winner.
How to Enter:
To enter, entrants must during the Promotion Period:
(a) visit the NIVEA Australian application on the NIVEA Australia Facebook page www.facebook.com/niveaaustralia; and
(b) allow the mood meter application and send a ”virtual message” to a Facebook friend.
Entries not completed in accordance with these terms and conditions or received after the Promotion Period ends will not be considered. Incomplete or incomprehensible entries will be disregarded. No responsibility is accepted for late, lost or misdirected entries.
There will be a total of 548 instant prizes that are available to be won. Prizes are detailed as per the below table.

200 x Universal Pictures "Ultimate Night In" DVD packs, includes 5 films: IT'S COMPLICATED, MAMMA MIA, THE BOAT THAT ROCKED, THE HOLIDAY and LOVE ACTUALLY, valued at RRP: $49.95. 
150 x Universal Pictures In-season double passes – BRIDESMAIDS, valued at RRP: $36.
53 x 3 Month Subscription to Better Homes & Gardens, valued at RRP: $18.60.
39 x 3 Month Subscription to Marie Claire, valued at RRP: $25.20.
40 x 3 Month Subscription to InStyle, valued at RRP: $24.60.
48 x 3 Month Subscription to Women’s Health, valued at RRP: $20.70.
18 x 12 Week Subscription to WHO, valued at RRP: $53.27.

Any ancillary costs associated with redeeming the vouchers are not included. Any unused balance of the vouchers will not be awarded as cash. Redemption of the vouchers is subject to any terms and conditions of the issuer including those specified on the vouchers.
The total prize value is $20,295
Prizes are not transferable or exchangeable and cannot be taken as cash. Where a prize (or part of a prize) is unavailable for any reason, the Promoter reserves the right to substitute that prize (or part of that prize) with another prize of equal value and/or specification, subject to any necessary approval of the relevant gaming authorities and the winner will be notified accordingly. The Promoter shall not be liable for any changes to the value or make up of products offered as the prize.
The winners will be selected randomly and will be required to complete the online instant win form, upon instant win notification, including name, postal address and email address.
Prize winners will be notified instantly online if they have won
There will be a re-draw for any unclaimed prizes conducted at 11:00am on 29/08/2011 at Orchard Marketing, Suite 1, 285a Crown Street, Surry Hills subject to any directions from a regulatory authority. The draw winner(s) will be notified by email within 2 days of the draw.
In the event that for any reason whatsoever a winner does not take a prize (or part of a prize) as stipulated by the Promoter then that prize (or part of a prize) will be forfeited by the winner and cash will not be awarded in lieu of that prize (or part of a prize).
Prize winners should allow 28 days for their prize to be delivered. All prizes will be sent by either email or mail, depending on prize, to prize winners to the email address/postal address provided on the online instant win form.
The Promoter and its agencies and companies associated with this Promotion will take no responsibility for prizes damaged, lost or stolen in transit.
All other costs or requirements associated with the prizes are the sole responsibility of the winners.
Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these terms and conditions or if the number of entries received is less than the number of prizes available, all prize claims in excess of the advertised prize pool will be honoured.
Instant win game materials void if stolen, forged, mutilated or tampered with in any way.
There will be a total of 548 instant win notifications sent for this Promotion.
The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
The Promoter reserves the right to refuse to allow a prize winner or their guests to take part in any or all aspects of the prize if the Promoter determines, in their absolute discretion, that the prize winner or their guests are not in the mental or physical condition necessary to be able to safely participate in the prize.
The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant:
(a) fails to establish their entitlement to enter the Promotion; or
(b) tampers with the entry process or benefits from such tampering; or
(c) submits an entry which is not in accordance with these terms and conditions.
The Promoter also reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and address). Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Facebook (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Further, to the fullest extent permitted by law, the Promoter and Facebook excludes liability for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, or traffic congestion on the Internet or any website, smartphone carriers or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to entrants’ or any other person’s computer related or resulting from participation in or downloading or uploading any materials in this Promotion
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

Yes its worth it  :P It only needs to have your friends so you can send cards to them. Joining any FB page usually asks for the same thing, Ive found....allowing access to your info I mean .

do you get more chances to win the more messages you send, how active do you need to be on it?

You get 10 cards to send per day. Its random prizes and different times, just depends if you send one at a winning time!!

I sent msjules one of these saying I give up I hate this competition...It was freezing on me. I hit sent and won BHG 3 month Subscription. Keep trying :)

So essentially, is there no point if none of your friends are using the app? I don't think any of my friends are but ohwell... the feedback on the wall suggests that most people are having trouble getting their prizes?

I dont think it matters...you can still send them the cards!! And we have a few ACCers that just post them to each other in the hope of a win!!

No your friend does not need to have the mood meter app or even be a liker of Nivea to send them a gift and win. I have won a few things in it.  Also the comments on the wall are from the 20,000 free bottle of Nivea giveaway not from the mood meter comp. Some havent got theirs yet but 20,000 to send out will probably take a while I got mine a while ago but I entered when it first showed up. Id keep entering all your entries every day at different times I remember I won once about 10:10 am and another time won 12:27pm so its pretty random. They're are alot of people entering it so its not the easiest to win on the 20,000 bottle promo was advertised on TV and gained alot of peoples interest for the page which im sure flowed onto the Mood Meter Competition... does the instant win come up on the screen once you have sent the msg??? How do you know if you have won??

Once you have sent your greeting and click CLOSE on the message box that says "Your gift has been sent"....if you are an instant winner, there is a big pop up window telling you what you've won and asking you to fill in your details for postage.
 You CANT miss it  :lol:

I just got some letters in the mail confirming my magazine subs wins from Mood Meter...so things are definitely fine with the comp. Some were wondering if prizes were going to be honoured.  :)

Doglet, get another facebook page using your maiden name and only use it for comping. There are quite a few of us from ACC that do this so we can FB comp to our hearts content and not bother non compers!

I won quite a few times at the beginning & all prize were honored , I have won a DVD I this time round & I think they have cut off dates when they send them out .

I also agree about getting a separate page for comping . That way you are only annoying ppl who annoy you right back lol .

I had an instant win today - mag subscription - I enetered a few times at the start then forgot until I saw this thread -  so it was a lovely thrill!

Does anyone know how you post your own mood status?  I can't figure it out, but it can't be that hard as most of my friends have their smileys/comments, etc, on their photo.  How do I add mine?

Moodmeter works it out by whatever your FB status is. If you write something "good" it must pick up on key words...same with the "bad" status!!

I haven't won anything on this promotion - but I have noticed that I have lost two Facebook "friends" because of it. :(

They must have got fed up with me sending them all those Nivea messages.  :)
