All bookings for the New Zealand Stay Curious Tour Prize and the Australian Stay Curious Tour Prize will be made by the Promoter’s agencies. Date changes once booked are not permitted and any additional night accommodation is at the expense of the requesting winner. 22. Each winner must travel with the Partner depicted in the photo that was uploaded by the winner in accordance with clause 7 of these terms and conditions (“Travelling Companion”). 23. Each winner’s Travelling Companion must travel with the winner on the same itinerary (including, but not limited to, flights and transfers). The costs of any alternative travel will not be borne by the Promoter and any elements of the Prize not used will be forfeited. 24. Each winner must confirm his or her eligibility to be awarded the applicable Prize, and also attend the nominated date within 24 hours of being successfully notified by the Promoter, otherwise that winner’s entry will be deemed invalid. If the winner’s entry is deemed invalid, the Promoter will award the applicable Prize to the Registered Entrant whose video was chosen second by the Promoter’s judging panel. The Promoter will repeat this process until the relevant Prize is awarded to an eligible Registered Entrant. 25. A Prize must be taken on the dates nominated by the Promoter to coincide with the applicable redemption period/redemption date otherwise the entire Prize is forfeited. No extension or variation of the dates nominated by the Promoter will be permitted unless organised, arranged or agreed to by the Promoter in advance. All components of a Prize must be taken together. Any element of a Prize not taken will be deemed to be forfeited. 26. Acceptance of a Prize is subject to any prevailing terms and conditions of the accommodation/transport/services providers and, in particular, health, behaviour, age and safety requirements. No compensation will be payable if a winner or his or her Travelling Companion is unable to use any element of the relevant Prize as stated for whatever reason, including refusal of entry or ejection from the locations or participation in certain activities for health, age, behaviour or safety reasons. Any part of a Prize that is not taken for any reason is forfeited. 27. Each winner and his or her Travelling Companion must travel together and depart from and return to the same departure point. Winners and their Travelling Companions may not accrue frequent flyer points. Use of the travel component and any passes or vouchers issued as part of a Prize may be subject to prevailing terms and conditions of use of the suppliers of components of a Prize. The travel component cannot be used in conjunction with travel discounts or special offers. Travel and accommodation will be arranged and booked on each winner’s behalf by the Promoter or an agent of the Promoter’s choosing. Once booked, changes to travel times or arrangements will be at the expense of the winner and the winner’s Travelling Companion. Any transportation to/from the airport in the winner’s home country is the responsibility the winner. 28. All additional costs not expressly stated but which may be incurred in acceptance and use of a Prize is the responsibility of the relevant winner and his or her Travelling Companion. Such additional costs include, but are not limited to, meals, beverages, room service, telephone calls, laundry services, spending money, transport to and from airport departure point, other transfers, taxes including arrival and departure taxes (if applicable), insurance, travel insurance, passports and visas (if applicable). Winners and their Travelling Companions may be required to present a credit card at time of accommodation check-in. 29. A Registered Entrant must only enter this Promotion in his or her own name. The Promoter reserves the right to request a winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winner’s identity, age, residency, eligibility to enter and claim the applicable Prize and any information submitted by the Registered Entrant in entering this Promotion before issuing the applicable Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning Registered Entrant has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. Proof of identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. The applicable Prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion. In the event that a winner cannot provide suitable proof, the relevant Prize will be forfeited and no substitute will be offered. 30. Winners and their Travelling Companions must be available to travel for the full period of the Prize, which dates are on and from 01/10/2111 to 24/10/2011 or 30/09/11 to 25/10/11 if winners are outside of Auckland or Sydney. 31. Both winners must work with the Promoter to fulfil personal appearances throughout the duration of the Prizes. 32. As a condition of winning a Prize, each winner must share a daily video blog via the Brancott Estate Facebook page. Each winner will be provided with the means to record and send photographic/video content – for example a laptop and remote internet access. Also, If the IT equipment is damaged, lost or stolen during the Prize trip, the relevant winner will be responsible for refunding the Promoter for all costs to repair or replace the relevant equipment. 33. Winners agree that they: o are acting as ambassadors for the Promoter and the Brancott Estate brand and will act in a manner consistent with this during the Prize trip; o will not make any statement either orally or in writing which is likely to cause detriment, damage, injury or loss to the Promoter and/or its brands; o will be punctual and not engage in any unreasonable behaviour that results in a delay or cost to the Promoter; o are free to enter into this Promotion and participate in all aspects of the Prize as set out in these Terms and Conditions; o have not entered into any other agreement, arrangement or understanding which would restrict or prevent them accepting a Prize; and o and their Travelling Companions will not engage in conduct of an immoral, scandalous or illegal nature (including the use of banned drugs and substances, criminal conviction or drink driving) or which brings the winners or their Travelling Companions into substantial ridicule, or which otherwise bring the Promoter into disrepute. Clauses specific to RWC 2011: o Winners will not over-state their support for just one team in the RWC, and will support the Tournament as a whole; o When talking about a particular team, winners will name them by country and not by team name e.g.: New Zealand vs. Australia NOT All Blacks v Wallabies; o Winners will not make any derogatory comment (either verbally or in writing) to any team/player/match official; and o Winners will not make any statement either orally or in writing which is likely to cause detriment, damage, injury or loss to the Tournament and/or its commercial stakeholders. 34. Where applicable, the winner of the Australian Stay Curious Tour Prize and his or her Travelling Companion are responsible for ensuring that they have valid passports with a minimum of 6 months validity upon date of return to Australia and any requisite visas, vaccinations and travel documentation. Compliance with any other applicable health or Government requirements is the responsibility of the winners and their Travelling Companions. 35. One person in each winner/Travelling Companion pair must hold a current driving licence that allows that person to drive in New Zealand. The Prizes are not transferable or exchangeable or redeemable for cash or credit, in part and/or in full or any other goods or services. The Promoter accepts no responsibility for any variation in the value, performance, or availability of the Prizes. The Promoter reserves the right to substitute the advertised Prize for a prize of equivalent or greater retail value if, for any reason beyond the Promoter's control, the Promoter is not able to give the winner the advertised Prize. 36. The Prizes must be claimed by 9.00am (AEDT) / 11.00am (NZ) on 30/08/2011. If any Prize remains unclaimed by this time, the Promoter will choose the Registered Entrant from the Shortlist with the next highest number of votes at 10.00am (AEDT) on 30/08/2011 (”Unclaimed Prize Draw”) at the same place and time as the original draw, subject to state regulation. A winner will be notified by phone and email within two (2) days of the draw. 37. All Rugby World Cup 2011 tickets are issued subject to the RWC 2011 Ticket General Terms and Conditions ("Ticket Conditions") which apply to the possession and use of Tickets. Tickets cannot be used for commercial or promotional purposes or resold for more than their original sale price. Except for any liability that cannot be excluded by law, the Promoter (including its related bodies corporate, officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these terms and conditions; (e) any tax liability incurred by a winner or Registered Entrant; or (f) use of a Prize. 39. The Promoter and the licensees are not liable for any tax implications (including any Fringe Benefits or Personal Income Tax) and winners should seek their own independent financial advice. 40. Where applicable, the Promoter reserves the right to refuse to allow a winner and/or his or her Travelling Companion to take part in any or all aspects of a Prize if the Promoter determines, in its absolute discretion, that the winner and/or his or her Travelling Companion is not in the mental or physical condition necessary to be able safely to participate in the applicable Prize. 41. No compensation will be payable if a winner and/or his or her Travelling Companion is unable to use any element of the applicable Prize as stated for whatever reason, including refusal of entry or ejection from the date locations or participation in certain activities for health, age, behaviour or safety reasons. Any part of an applicable Prize that is not taken for any reason is forfeited. 42. If for any reason a winner does not take up the Prize or an element of the Prize by the time stipulated by the Promoter, then the applicable Prize or that element of the Prize will be forfeited. 43. If a Prize or any part of the Prize cannot, in the option of the Promoter, be provided for any reason, then the Promoter reserves the right to provide an alternative prize to the same value, subject to any directions from a regulatory authority. 44. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel this Promotion, as appropriate. 45. The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this Promotion or the downloading of any materials related to this Promotion. 46. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter. 47. Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. Any photo or video that infringes the New Zealand Advertising Standards Code or the Australian Alcohol Beverages Advertising (and Packaging) Code (each a Code) will not be uploaded and will not be accepted as a valid entry in this Promotion. For example, any photo or video that promotes or markets alcohol and features a person who is under 25 years old will be in breach of a Code and will not be accepted as a valid entry in this Promotion. The Promoter may request proof of age and identity from any person featured in a photo or video that is submitted as an entry. Any Registered Entrant who uploads an image and/or video in association with this Promotion that is removed in accordance with clause 48 of these Terms and Conditions will be disqualified from any further participation in this Promotion and all entries submitted by the Registered Entrant will be deemed invalid. 50. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right (subject to any directions under relevant lottery legislation) to cancel, terminate, modify or suspend this Promotion. Registered Entrants consent to the Promoter using the Registered Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 51.
