MacBook Air Competition * MacBookAir Competition Terms

The Skimp MacBook Air competition (Competition) is offered by Skimp Pty Ltd ACN 139 915 281 (Promoter) pursuant to these Competition Terms and Conditions.  By submitting an entry in the Competition, the person making the entry (Entrant) agrees to be bound to the terms and conditions contained in this document (Competition Terms and Conditions).  Instructions on how to enter the Competition form part of these Competition Terms and Conditions.

1.1    The Prize
The Prize offered by the Promoter is one (1) x thirteen (13) inch 128GB MacBook Air (Prize):
(a)    the Prize value is $A1,449.00;
(b)    the Prize is not exchangeable or transferable, and cannot be redeemed for cash;
(c)    any expenses incurred by the Prize Winner in redeeming the Prize are the responsibility of the Prize Winner; and
(d)    Apple is not a participant or sponsor of the Competition.
(e)    The Promoter makes no representations or warranties as to the:
(i)    quality;
(ii)    suitability; or
(iii)    merchantability
of the Prize on offer.
(f)    If the Prize becomes unavailable due to unforseen circumstances before the Draw Date, the Promoter may substitute a Prize of equal value at its sole discretion.

1.2    Competition Rules
(a)    The Competition commences at 8am on 19 September 2011 and closes at 5pm on 18 October 2011 (Competition Period);
(b)    Each Entrant may only submit one (1) entry;
(c)    Entry in the Competition is Free;
(d)    If an Entrant enters the Competition more than once, all subsequent entries by the same Entrant other than the initial entry are excluded;
(e)    By entering this Competition, Entrants consent to information they provide being stored on the Promoter’s database for the purpose of internal statistical analysis relating to the Competitions; and
(f)    The Prize Winner consents to their name and suburb being published on Skimp’s website for thirty (30) days after the Draw Date.

1.3    Eligibility
To be eligible to enter the Competition, Entrants must:
(a)    be an Australian resident;
(b)    complete and submit the entry form on the website located at www.skimp.com.au during the Competition Period;
(c)    subscribe to the Skimp deals email newsletter;
(d)    not be an employee or contractor of the Promoter or an immediate family member of an employees or contractor of the Promoter; and
(e)    be at least eighteen (18) years of age (proof of age may be required to receive the Prize).
(f)    The Promoter accepts no responsibility whatsoever for:
(i)    entries submitted after the Competition Period;
(ii)    lost or corrupt entries;
(iii)    incomplete or otherwise;
(iv)    ineligible entries.
(g)    The Promoter may, at its sole discretion disqualify any Entrants where it can be established that the Entrant has interfered with the Entry process of benefitted from tampering with the Entry process.  The Promoters decision in relation to this matter is final.

1.4    Prize draw
(a)    An Entrant will be randomly drawn by Skimp at its Registered Office, at 10am on 20 October 2011 (Draw Date);
(b)    The first eligible entry drawn at random from the pool of entries wins the Prize and is the Prize Winner;
(c)    The decision of Skimp’s officer is final and no correspondence will be entered into.
(d)    The Prize Winner will be notified by:
(i)    telephone; or
(ii)    email; and
(iii)    their full name and suburb will be published at http://www.skimp.com.au as soon as possible after the prize draw.
(e)    The Prize Winner agrees to provide the Promoter with proof of age;
(f)    Collection of the Prize is the responsibility of the Prize Winner.

1.5    Unclaimed Prizes
If the Prize Winner does not claim the Prize or cannot be contacted within seven (7) days of the Draw Date:
(a)    the Promoter will redraw the Prize until a Prize Winner is located; and
(b)    the Prize is claimed.

1.6    Limitation of liability
To the extent permitted by law, the Promoter is not liable:
(a)    for any loss or damage whatsoever which is suffered (including direct or consequential loss);
(b)    for any personal injury sustained in connection with entering this Competition; or
(c)    as a result of the Prize Winner using the Prize.
(d)    This paragraph is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws.
(e)    Any such liability is limited to the resupply of the prize.

1.7    Technical fault
If for any reason this Competition does not run according to these Competition Terms and Conditions (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter), which corrupts or affects the:
(a)    administration;
(b)    security;
(c)    fairness;
(d)    integrity; or
(e)    proper conduct of the competition;
(f)    then the Promoter reserves the right, at its sole discretion, to take any actions that may be available to it to cancel, terminate, modify or suspend the Competition.

1.8    Force majeure
In the case of the intervention of any outside agent, or event which naturally changes the result, or prevents or hinders its determination, including but not limited to:
(a)    vandalism;
(b)    power failures;
(c)    tempests;
(d)    natural disasters;
(e)    acts of God;
(f)    civil unrest; or
(g)    strikes
the Promoter may at its absolute discretion cancel the Competition and recommence it from the start on the same conditions.  If an event of Force Majeur or Technical fault occurs, then the competition will, be restarted.

1.9    Promoters details
