MAX “TOP 1000 GOLD MEDAL CLASSICS” COMPETITION TERMS AND CONDITIONS ENTRY INTO THE COMPETITION 1. Entry into the MAX “TOP 1000 GOLD MEDAL CLASSICS” competition (the “Competition”) is open to all residents of Australia over the age of 13. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these Terms and Conditions. As a condition of entering this Competition, entrants that are under the age of 18 must first obtain the express permission from a parent or a legal guardian to enter this Competition in accordance with these Terms and Conditions. Entrants that are under the age of 18 and their parent or legal guardian have both read, understood and agree to the Terms and Conditions for this Competition. 2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter. 3. Competition begins at 9:00am (AEST) on Saturday 23 June 2012 and closes at 11:59pm (AEST) on Tuesday 24 July 2012. (the “Competition Period”). 4. To enter the Competition and be eligible to win, entrants must: (a) visit the MAX Facebook page www.facebook.com/MAXTVAustralia; (b) click on the http://apps.facebook.com/maxgoldmedal/ tab on the facebook page to enter the competition; (c) read and accept the application access permission requests and Competition Terms & Conditions; (d) nominate your Gold Medal Classic song; and (e) in 25 words or less answer the following question ““Why does your song deserve to win a Gold Medal?” (the “Competition Question”). 5. All entries must include all mandatory information as indicated on the form, which includes (not limited to the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth. All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, infringe the intellectual property rights of any third party, contain any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrant’s responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period. 6. Only one entry per person is permitted for this Competition. If an entrant enters the Competition more than once, the Promoter will, at its discretion, accept the first entry received by the Promoter from that entrant. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice. PRIZE 7. There is One (1) x prize in total which consists of the following; Return economy airfare flights for the Prize winner and one guest from the Prize winner’s nearest capital city to London, UK. (Flight bookings and itinerary will be confirmed with the Prize winner and guest) valued up to a maximum of $11000 inc GST; • Four (4) x consecutive nights’ twin-share accommodation for the Prize winner and their guest in London, valued up to a maximum of $2500 total inc GST; • Two (2) x VIP tickets to the BT London Live Closing Ceremony Celebration Concert to be held on Sunday 12 August 2012 in Hyde Park, London (NOTE: this event is not associated with the official London Olympics Closing Ceremony). Performing there will be Blur, New Order and The Specials; valued up to a maximum of $1000 including GST. The ticket entitles the Prize winner and guests to the following (subject to availability): Private entrance to concert site, Exclusive VIP chillout area with undercover facilities and garden seating (Chill out area is located to the side of the stage; you are unable to view the acts performing from this area)*, VIP grandstand seating (tiered and reserved)*, Luxury private restrooms, Resident DJ, BBQ with hot & cold food platters, Complimentary bar (excludes champagne), Olympic and Main Stage Screenings within VIP area, Event staff and hostesses in attendance throughout; and • Private return transfers in London including airport to hotel and from hotel to event; valued at a maximum of $700 including GST. 8. The total maximum Prize pool value is $15,200. The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars. 9. The Prize (or any element of it) is not transferable or redeemable for cash. The Prize or any element of it cannot be exchanged for any other Prizes under any circumstances. The contents of the Prizes will be at the Promoter’s sole discretion. The Prize is subject to availability and the terms and conditions of the entities supplying the Prize. 10. Any entry that is made on behalf of an entrant by a third party, or otherwise by proxy, will be invalid. Entrants are only permitted to enter this Competition using their own personal Facebook account and in their personal capacity (i.e. entrants are prohibited from entering on behalf of another person or organisation, group or page). The Prize will be awarded only to the person named in the entry (provided he/she meets the eligibility criteria). Entrants are not permitted to enter the Competition using multiple Facebook accounts or alias. If the Promoter reasonably believes that an entrant has breached this clause, the Promoter may immediately disqualify that entrant without notice. 11. It is a condition of accepting the Prize that the Prize winner and his/her guests must be available and able to travel on dates to be agreed between the Prize winner and the Prize supplier, and to coincide with the to coincide with the concert. JUDGING AND AWARD OF PRIZE 12. The Competition will be judged on the basis of originality and creativity at MAX, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Wednesday 25 July 2012 at 10:00am (AEST). Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via phone or email on Wednesday 25 July 2012 and their names published on the MAX websites from Wednesday 25 July 2012. The Prize must be claimed within 2 days of the publication of the Prize winners’ names. 13. If a Prize winner cannot be contacted or does not claim or use the Prize by the stipulated dates, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize. AGE 14. In the event that the Prize winner is less than 18 years of age, he/she must be accompanied by his/her parent or a legal guardian over the age of 25 and that parent or legal guardian will be considered the guest of the Prize winner and must accompany the Prize winner throughout the conduct of the Prize. 15. It is a condition of accepting the Prize that the Prize winner and his/her guests may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 16. The Prize winner and guest are responsible for ensuring that they are able to travel to the London, UK in taking the Prize. As a condition of entry, the Prize winner and or his/her guest must not be subject to any restrictions on their rights to travel to and from the UK. Entrants must have a valid passport with more than six months until expiry (from the date the Prize winner is judged) to be eligible for the Prize. 17. The Prize winner and guest must travel at the same time and depart from the same capital city and are responsible for transport from their respective residence to the airport at their nearest capital city for the flights (Sydney, Melbourne, Brisbane, Adelaide or Perth). If the travel destination is international and the Prize the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be included in the prize package for the winner and guest only. 18. It is the sole responsibility of the Prize winner and guest to ensure that their personal travel documentation is valid and to check with all government travel advisory and immigration authorities regarding travel requirements and eligibility. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements are the sole responsibility of the Prize winner and his/her guest. Travel insurance is advisable for the Prize winner and guests to protect against the additional costs incurred in the event of unforeseen circumstances, however, such arrangements are the sole responsibility of the Prize winner and his/her guest. 19. Airfare tickets are available on the regular scheduled services of each airline. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline. 20. A credit card imprint or cash deposit may be required from the Prize winner at check in to the hotel for any incidental charges. 21. The Prize winner is advised that tax implications may arise as a result of accepting the Prize and he/she should seek independent financial advice prior to acceptance of their prize. 22. It is a condition of accepting the Prize that the Prize winner and his/her guest may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 23. The Promoter and the associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the Prize winner and guest to first check with all government travel advisory information regarding the safety and situation of the destination of their chosen destination/event. 24. The Promoter is not responsible for any cancellation, postponement, and delay or rescheduling of transport and any costs incurred as a result. Including, without limitation, any accommodation costs will be the sole responsibility of the Prize winner. 25. The Prize winner and his/her guest are advised to consult their healthcare professional regarding recommended immunisations and/or health checks prior to travelling and to check for travel warnings and any perceived hazards with appropriate authorities, including www.dfat.gov.au. 26. The Promoter reserves the right to refuse to allow the Prize winner or one or more of his/her guests to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or one or more of his/ her guests are not in the mental or physical condition necessary to be able safely to participate in the Prize. GENERAL 27. Entrants release Facebook and its associated companies from all liability arising in respect of the Competition and acknowledge that: (a) the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook; (b) any information provided by the entrant in connection with the Competition is provided to the Promoter and not to Facebook; and (c) any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Facebook. 28. Any costs of using and accessing Facebook via a mobile phone, tablet or other devices will be dependent on the entrant’s individual mobile and internet service provider. The Promoter is not responsible for any costs associated with any mobile, telephony, internet, or Facebook access and usage. The Promoter is not responsible for any other costs associated or incurred as a result of the entrant’s entry into the Competition. 29. Entry and continued participation in the Promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php 30. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof, that Prize winner will forfeit the Prize in whole and no substitute will be offered. 31. By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights (including copyright) in their entry. Each entrant indemnifies the Promoter for any costs or loss incurred by the Promoter as a result of this warranty being false or incorrect. 32. No responsibility will be taken by the Promoter, MAX, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes. 33. The Promoter reserves the right, in its absolute discretion, to disqualify at any time: a) any entry (including those judged as a winning entry) which, in the opinion of the Promoter, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; or b) any individual who tampers with the entry process, submits an entry (including those judged as a winning entry) that is not in accordance with these Terms and Conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter. 34. The Promoter reserves the right, in its absolute discretion, to at any time, cancel or vary the Competition or to cancel or vary the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion): a) a Prize winner does not satisfy the Competition entry requirements; or b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control. 35. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not: a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or b) be required to conduct the Competition at any other time. 36. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates. 37. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into. 38. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition. 39. The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions. 40. By entering the Competition, all entrants agree that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and audio-visual recordings) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants, subject to the Promoter’s privacy policy which is available at www.maxtv.com.au; for this purpose, each entrant grants to the Promoter a non-exclusive, irrevocable, perpetual, worldwide, transferable and royalty-free licence in any such written answers, photographs /images and audio-visual recordings. Each entrant consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
