Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia Commonwealth Bank “‘GoalSaver Olympics” Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by the winner(s) is deemed as acceptance of these Conditions of Entry. 2. The Promotion commences at 9:00am AEST on 27/07/2012 and closes at 11:59pm AEST on 12/08/2012 (the “Promotion Period”). 4. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”): Individuals must be an Australian resident aged 18 years or over; Individuals must not be an employee (or a member of immediate family) of the Promoter or the Promoter’s related entities directly involved in the Promotion (as determined by the Promoter); Individual’s must not already have a GoalSaver Account; and Individual’s must not have already entered the Promotion. 5. To enter, individuals must satisfy the Eligibility Requirements and: Open a new GoalSaver Account during the Promotion Period; and Make a deposit of a minimum of $200 into their new GoalSaver Account and retain this deposit in their new GoalSaver Account as at 11.59pm AEST on 30/09/2012. 6. Upon completion of the above, individuals will receive one (1) entry into the draw. Joint accounts are excluded from this Promotion. 7. There will be one (1) draw conducted for this Promotion. The computerised draw will take place at Commonwealth Bank, Level 13, Darling Park Tower 1, 201 Sussex Street, Sydney, NSW 2000 at midday AEDST on 12/10/2012. The winners will be notified in writing and by phone within two (2) business days of the draw and their name and suburb will be published in the public notices section of The Australian newspaper on 26/10/2012. The number of entries drawn and deemed as winners will be dependent upon and directly linked to the official number of Gold Medals won by the Australian Olympic Team at the London 2012 Olympic Games, as per the official final tally in the London 2012 Olympic Games medal table provided by the International Olympic Committee. For the sake of reiteration, for every Gold Medal won by the Australian Olympic Team, the Promoter will draw one (1) winner for the Promotion. Notwithstanding the above, there will be a minimum of ten (10) and a maximum of seventeen (17) winners for the Promotion. For the sake of reiteration, this means that if the Australian Olympic Team at the London 2012 Olympic Games wins less than ten (10) Gold Medals (including no Gold Medals at all) as per the official final tally, the Promoter will still draw ten (10) winners, and conversely, if the Australian Olympic Team at the London 2012 Olympic Games wins more than seventeen (17) Gold Medals, as per the official final tally, the Promoter will still only draw seventeen (17) winners for the Promotion. Each winner will receive $10,000 cash directly credited into the GoalSaver Account opened during the Promotion Period and used for entry. The prize will be credited into the account by 31/10/2012. 8. If any winner closes or transfers their GoalSaver Account prior to receiving a prize, they will be deemed to have forfeited their right to receive the prize. . 9. Total maximum prize pool value is up to $170,000.00. 10. Prizes are not transferable or exchangeable. Each winner accepts the prize ‘as is’ and acknowledges that the Promoter accepts no responsibility for any tax implications that may arise from their prize. The winners should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser. 11. The Promoter’s decision is final and no correspondence will be entered into. 12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 13. A draw for any prizes that remain unclaimed, may take place on 14/01/2013 at the same time and place as the original draw, subject to any written directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their name(s) and suburb(s) will be published in the public notices section of The Australian newspaper on 25/01/2013. For the sake of clarity, the Promoter will only award prizes that remain unclaimed as based on the number of winners originally drawn as determined in accordance with clause 8. 14. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 15. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may, subject to the approval of all relevant State and Territory Lottery Departments, take any action that may be available including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process. 16. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion. 17. Any cost associated with accessing the promotional website (if applicable) is the entrant’s responsibility and is dependent on the Internet service provider used. 18. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
