The Promoter is San Remo Macaroni Company Pty Ltd trading as San Remo, ABN 43 000 228 713 of 4 Boden Court, Windsor Gardens SA 5087 Australia, telephone number (08) 8334 8200 and facsimile number (08) 8261 0265. CONDITIONS OF ENTRY 2. Entering this promotion constitutes acceptance of these Terms and Conditions and any other terms and conditions appearing on http://www.facebook.com.au/SanRemoPasta (San Remo Facebook Page) specific to this promotion. 3. The promotional period will commence at 10.00am ACST on Monday, 14 July 2014 and closes at 5.00pm ACST on Sunday, 31 August 2014 (promotional period). WHO MAY ENTER 4. Entry is open to all Australian residents aged 18 and over. 5. Employees or contractors of the Promoter or its associated companies or agencies, or any suppliers of prizes, or the immediate family of such persons, are not eligible to enter this promotion. "Immediate family" means spouse, parent, child or sibling, whether or not they live in the same household. HOW TO ENTER 6. To enter the competition, entrants must: 6.1 Cook San Remo Pasta and take a photo of their 'winter warmer dish'. The photo must include both the San Remo Pasta and the entrant (Work); and 6.2 Post the photo on any social media channel (e.g. Facebook, Instagram or Twitter) during the promotional period along with the hashtag #SanRemoWinterWarmer. 295757ELC/4267563.1 7. Entries not submitted in accordance with these Terms and Conditions or submitted after the closing date will not be considered. 8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 9. By submitting the Work to the Promoter, entrants grant the Promoter and its licensees and assignees a non-exclusive, royalty free licence to exercise all rights in perpetuity throughout the world in the Work and all other material provided by the entrant to the Promoter pursuant to this promotion at any time. 10. Without limiting the rights granted to the Promoter under clause 9, entrants specifically agree that clause 9 grants to the Promoter the non-exclusive right to communicate the Work in whole or in part to the public throughout the world on any media platform and grants to the Promoter all associated rights necessary to exercise the above rights. 11. All entrants warrant that: 11.1 all details provided with entries are true and accurate; 11.2 the entrant has all necessary rights and licences to grant the rights set out in these Terms and Conditions; 11.3 the Work is the entrant's original work and has not been previously communicated to the public; 11.4 the exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties; and the entrant will indemnify the Promoter against any loss or damage resulting from any breach of these warranties. 295757ELC/4267563.1 SELECTION OF WEEKLY PRIZE WINNERS 12. For each week of the promotional period, the entrants who submit the three (3) best entries will be selected as weekly prize winners as follows: 12.1 Week One: the entrants who submit the three (3) best entries between Monday, 14 July 2014 at 10.00am ACST and Monday, 21 July 2014 at 9.59am ACST will be selected as the weekly prize winners for Week One of the promotional period. 12.2 Week Two: the entrants who submit the three (3) best entries between Monday, 21 July 2014 at 10.00am ACST and Monday, 28 July 2014 at 9.59am ACST will be selected as the weekly prize winners for Week Two of the promotional period. 12.3 Week Three: the entrants who submit the three (3) best entries between Monday, 28 July 2014 at 10.00am ACST and Monday, 4 August 2014 at 9.59am ACST will be selected as the weekly prize winners for Week Three of the promotional period. 12.4 Week Four: the entrants who submit the three (3) best entries between Monday, 4 August 2014 at 10.00am ACST and Monday, 11 August 2014 at 9.59am ACST will be selected as the weekly prize winners for Week Four of the promotional period. 12.5 Week Five: the entrants who submit the three (3) best entries between Monday, 11 August 2014 at 10.00am ACST and Monday, 18 August 2014 at 9.59am ACST will be selected as the weekly prize winners for Week Five of the promotional period. 12.6 Week Six: the entrants who submit the three (3) best entries between Monday, 18 August 2014 at 10.00am ACST and Monday, 25 August 2014 at 9.59am ACST will be selected as the weekly prize winners for Week Six of the promotional period. 12.7 Week Seven: the entrants who submit the three (3) best entries between Monday, 25 August 2014 at 10.00am ACST and Sunday, 31 August 2014 at 5.00pm ACST will be selected as the weekly prize winners for Week Seven of the promotional period. 295757ELC/4267563.1 13. Judging of the winning entries will be conducted at the Promoter's Head Office at 4 Boden Court, Windsor Gardens SA 5087 on the following dates: 13.1 Week One: Monday, 21 July 2014 at 10.00am ACST. 13.2 Week Two: Monday, 28 July 2014 at 10.00am ACST. 13.3 Week Three: Monday, 4 August 2014 at 10.00am ACST. 13.4 Week Four: Monday, 11 August 2014 at 10.00am ACST. 13.5 Week Five: Monday, 18 August 2014 at 10.00am ACST. 13.6 Week Six: Monday, 25 August 2014 at 10.00am ACST. 13.7 Week Seven: Monday, 1 September 2014 at 10.00am ACST. 14. Each weekly prize winner will receive: 14.1 a San Remo Pasta Pot prize pack valued at $108.68 containing: 14.1.1 a San Remo Pasta Pot valued at $55.00; 14.1.2 a San Remo grater valued at $10.00; 14.1.3 a San Remo apron valued at $15.00; 14.1.4 12 packets of San Remo pasta valued at $28.68; and 14.2 an Everyday Gourmet Recipe Book valued at $17.95. 15. All other costs associated with the prize are the responsibility of the winners 16. The Promoter will decide the winning entries in its absolute discretion. 17. Entries will be judged by representatives of the Promoter, based on the originality and creativity of the entry. There is no chance component to determining the winners. 18. The entrant who submits the best entry during the promotional period will be selected as the major prize winner and will receive a cooking lesson with Adam Swanson in the Barossa Valley. The major prize includes: 19.1 Qantas return airfares for two adults from the major prize winner's nearest capital city to Adelaide, South Australia with transport then provided to the Barossa Valley South Australia, valued at up to $3,730.00; 19.2 Accommodation for two nights at The Kirche @ Charles Melton for two adults valued at $1045.00; 19.3 A year's supply of San Remo pasta valued at $124.28 (52 packs of San Remo Pasta at RRP $2.39 per pack). 20. All other costs associated with the prize are the responsibility of the winners. 21. Judging of the winning entry will be conducted at the Promoter's Head Office at 4 Boden Court, Windsor Gardens SA 5087 at 10.00am ACST on Monday, 1 September 2014. 22. The Promoter will decide the winning entry in its absolute discretion. 23. Entries will be judged by representatives of the Promoter, based on the originality and creativity of the entry. There is no chance component to determining the winners. 24. The result of the competition, including the determination of the winners, is final, and the Promoter will not enter into any correspondence regarding the result. PRIZES 25. Prize values are GST inclusive and are in Australian dollars and represent the estimated retail value as provided by the supplier as at time of printing. The major prize winner will be notified on Facebook on Monday, 1 September 2014 from 10.00am ACST. 30. Winners will be asked to provide their name, telephone number and a postal address for prize delivery. 31. Winners may be asked for proof of identity, age or residence to confirm eligibility. 32. Subject to proof of eligibility, prizes will be sent by ordinary post. 33. The Promoter will make every reasonable effort to contact the winner(s). Winners agree to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agree that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s. PRIVACY 36. In order for entrants to participate in this promotion, the Promoter may collect the name, age, email, address and telephone number of each entrant (Personal Information). The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, 295757ELC/4267563.1 in connection with the arrangement for the supply of goods and services by any person to the prize winner or by use of the prizes. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again. 41. If for any reason the promotion does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter that corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion or disqualify any individual who tampers with the entry process.
