These terms and conditions apply when you make a booking with Inverted Downunder Pty Ltd (IDU) and Matt HallRacing (MHR): 12. Conditions for Flight · Passengers must be 16 years and older at the time of the flight · Passengers must weigh no more than 110kg* · Passengers must be no taller than 200cm* · Passengers must sign indemnity waiver that they are of good health · If flight is cancelled by Matt Hall Racing due to weather or mechanical issue, a makeup date will be offered · * Small excesses of these limits may be able to be accommodated if the passenger is prepared to undergo a “test fitting” and/or accept they may not be able to fly 13. Bookings If you have any queries (changes, rescheduling requests etc) in relation to the experience you have booked, you must contact us directly at joyflights@matthallracing.com. Bookings are non refundable however, we will make our best efforts to reschedule your experience at any time. You may change your flight date by contacting our office, this must be done at least 24 hours in advance of your flight time or a rebooking fee may be charged. 14. Cancellation If you do not attend on the agreed date, time and place you may not be entitled to a rebooking, especially if the booking is at a sight away from Maitland airport. 15. Lack of availability We do not guarantee a flight on any day published on the website. Issues out of our control such as weather, and maintenance may mean we have to cancel a day of flying at short notice. We will always endeavour to advise of cancellations as early as possible, and reschedule with the customer for the next available date that is mutually convenient. 16. Acceptance of Risk Your participation in each flight is conditional upon your acceptance of IDU/MHR terms and conditions and flight waiver signed prior to flight. 17. Copyright Copyright images and content on the IDU site are protected by copyright and must not be copied, saved or used in any format other than incidental to your permitted use of this site. 18. Liability IDU/MHR makes no warranty or representation regarding the experience to be provided on the website. IDU/MHR has no liability for any act, omission or default, whether negligent or otherwise caused by any flight or pilot. IDU/MHR is not liable to you or any other person for any injury, damage or loss however caused in connection with the use of this website or a linked website or occasioned by undertaking an event booked on this website. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that Matt Hall has to postpone, cancel, or reschedule the Aero/Flying Club visit for any reason whatsoever. Both the Matt Hall joyride and Aero Club/Flying Club visit are subject to the Matt Hall’s schedule and availability at the time of the arranged prize redemption. 23. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable, exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer. 24. If the winner of the Matt Hall joyride lives outside of NSW and requires Travel for the nominated day, the prize does not include travel insurance. The Promoter recommends that the winners take out travel insurance. 25. If a flight is required from outside of NSW for the joyride, this must be utilised at the same time, for the same travel dates, to the same destination as the joyride. 26. If the winner of the joyride is a resident of NSW, flights will not be included. QBE Airmanship Game of Skill August 2014 27. It is a condition of accepting the joyride prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay. 28. Unless specified otherwise, the winner (and their companions) are responsible for all expenses including, without limitation, spending money, meals , drinks, transfers, activities, incidentals, energy surcharges, gratuities, services charges, and all other ancillary costs. 29. Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter. 30. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal or greater recommended retail value. 31. If winner is unable to fulfil prize during time period, winner forfeits the prize package with no compensation or further liability of the promoter. Cash will not be awarded in lieu of the prize. 32. It is a condition of accepting the prize that the winner(s) must comply with all the conditions of use of the prize and the prize supplier’s requirements (as applicable). 33. It is a condition of accepting a prize that the winner agrees to participate in and cooperate with all reasonable media editorial requests, including but not limited to, being interviewed, photographed and filmed and the winner grants the Promoter a perpetual, non-exclusive license to use such footage and photographs in all media and the winner will not be entitled to any fee for such use. The inclusion of any such footage or photographs (including but not limited to creative control of the feature) will remain with the Promoter at all times. 34. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. JUDGING Each valid entry received during the Competition Period will be submitted for judging by a panel of judges appointed by the Promoter. Judging will commence at the Promoter’s premises on 29 September 2014. The top 12 entrant(s) whose entries are deemed to be the most original and relevant to Airmanship / air safety out of all valid entries received will be judged by Matt Hall. Of these top 12 entrants; Matt Hall will deem the winners of the MAJOR INDIVIDUAL PRIZE – Matt Hall joyride and MAJOR TEAM PRIZE – Matt Hall appearance at your Aero/Flying Club and the 10 winners of the RUNNER UP PRIZE PACKS. The Competition is a game of skill and chance plays no part in determining the winner. 35. The prize winner(s) will be notified by telephone or email using the contact details given in their entry on 3October 2014. 36. The judges’ decision in relation to any aspect of the Competition will be final and no correspondence will be entered into regarding the result. The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In such circumstances, an additional judging will be conducted. 37.
