Information on how to enter and prize information form part of these terms and conditions of entry (Conditions of Entry). 2. Entry into the promotion is deemed acceptance of these Conditions of Entry. 3. The entrant is responsible for ensuring his or her familiarity with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of that restriction or of the Conditions of Entry generally. 4. All entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a prize to the ineligible person. Return of the prize or payment of its equivalent value to the Promoter may be required by the Promoter if this occurs. 5. The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on every person who enters. No correspondence will be entered into. 6. The Promotion will commence at 00:01 AEST on 22/09/2014 and conclude at 23:59 AEDT on 19/11/2014 (Promotion Period). WHO CAN ENTER 8. Entry in the Promotion is only open to Australian residents aged 18 years and over, excluding: (a) management, employees, directors and contractors of the Promoter, its related entities and other agencies, firms or companies associated with the Promotion (including suppliers of the prizes); (b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 8(a) of these Conditions of Entry; (c) persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter, (Eligible Entrants). The persons referred to in paragraph 8(b) of these Conditions of Entry includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion. HOW TO ENTER 9. To enter and be eligible to win, Eligible Entrants must, during the Promotion Period: (a) visit www.fantasticmusicalchairs.com.au (Online Entry Site); and (b) fully complete and submit the online Promotion entry on the Online Entry Site (Online Entry Form), including: i. all details required on the Online Entry Form, including but not limited to their first name, last name, postal address, contact phone number, email address and date of birth; ii. agreeing to be contacted with regards to the Promoter’s future promotional and marketing initiatives; and Page 2 of 6 iii. indicating their acceptance of these Conditions of Entry, (Eligible Entry). 10. Any costs associated with accessing the Promotion website are the entrant’s sole responsibility and are solely dependent on the internet service provider used. Eligible Entrants must submit their entries manually using an internet browser. 11. The Promoter is not responsible for technical difficulties with the entry mechanism. 12. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means as invalid. 13. Incomplete, illegible, indecipherable or incorrect entries (as determined by the Promoter, in its absolute discretion) are not eligible to win. 14. Entries are deemed to be received at the time of receipt into the Promoter's database, not time of transmission by the entrant. VERIFICATION 15. If requested by the Promoter, Eligible Entrants must produce, within the time requested by the Promoter at its absolute discretion, appropriate photo identification or other documentation required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a prize (if won) and compliance with these Conditions of Entry; and 16. If the items required by the Promoter are not received or an entrant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the entry(s) submitted by the Eligible Entrant will be deemed invalid. 17. Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction. In the event that an Eligible Entrant cannot provide suitable validation or verification, the Eligible Entrant will forfeit their prize and no substitute will be offered. 18. If more than one person attempts to claim a prize, the Promoter has sole and absolute discretion to determine which of those persons the winning entrant is. DRAW INFORMATION 21. All random electronic prize draws will be conducted at Prime Focus, 403/62 Beach Street, Port Melbourne, Victoria 3207 (Draw Location) by a representative of the Promoter at 12 noon AEDT on 21/11/2014 (Prize Draw). 22. All Eligible Entries submitted by residents of New South Wales & Australian Capital Territory will be entered into a single draw (NSW & ACT Draw). The first ninety-one (91) Eligible Entrants with an Eligible Entry drawn in the NSW & ACT Draw will each win the opportunity to participate in the musical chairs game as detailed below. 23. All Eligible Entries submitted by residents of Australian States and Territories, excluding New South Wales & Australian Capital Territory, will be entered into a single draw (Interstate Draw). The first ten (10) Eligible Entrants with an Eligible Entry drawn in the Interstate Draw will each win the opportunity to participate in the musical chairs game as detailed below, in addition to: Page 3 of 6 (a) Return economy flights for the winner from the winner’s nearest Australian capital city to Sydney, departing 01/12/2014 and returning 02/12/14, valued up to $800; (b) One(1) night minimum four (4) star accommodation in Sydney, checking in on 01/12/2014 and checking out on 02/12/2014, valued up to $200; and (c) Airport/accommodation transfers in Sydney and transfers between the accommodation and the musical chairs game. MUSICAL CHAIRS GAME 24. The musical chairs game (Game) will take place at Martin Place, Sydney, New South Wales 2000 at 07:00 AEDT on 02/12/2014. Any Game participant not present and registered by 07:00 AEDT will forfeit their right to participate in the Game. 25. At the commencement of the Game there will be 100 chairs (arranged in an “H” shape, facing outwards) and 101 Game participants (91 NSW & ACT Draw winners, and 10 Interstate Draw winners).The Game participants will be required to form a line around the chairs. When the music starts the Game participants will be required to walk around the chairs in the direction denoted by the Game organisers. When the music stops the Game participants need to try to sit on a chair. One chair will be removed by the Game organisers each round. The Game participant in each round who is left standing with no remaining chair to sit on, will be eliminated. 26. Game rules: Decisions of the Game officials are final. Officials will not tolerate over-aggression, which will result in elimination from the Game. No large bags or bulky items are permitted in the Game area. No food or beverages are permitted in the Game area. Game participants will start in a line and once the music begins, they will follow the shape of the chairs. Game participants must not use their hands, arms or shoulders to forcefully obtain a chair, save a chair, or force another player out of a chair. Game participants must not touch chairs while the music is playing. Game participants must not move any chair/s. The first occupant of a chair in a given round will be determined as the rightful occupant of that chair for that round. If two participants share a chair an official will determine which participant may remain on the chair and which participant is to be eliminated. Participants must keep pace with the person in front of them. Participants must not hover or slow the Game pace. Participants must keep their place in the line while the music is playing - no passing or cutting in line is permitted. When the music stops, participants will have seven (7) seconds to find a seat - anyone not seated when the clock expires will be eliminated. This time limit is subject to change. When eliminated, participants must exit the Game area immediately; no discussions will be entered into. Game participants will need to keep a moderate pace with no running. 27. The first 76 Game participants to be eliminated (26th Place to 101st Place) will each win a $500 Fantastic Furniture voucher. 28. The next 24 Game participants to be eliminated (2nd Place to 25th Place) will each win a $1000 Fantastic Furniture voucher. 29. At the conclusion of the Game there will be one (1) participant left who has sat on the last chair (Game winner). There will be a promotional message underneath all 100 chairs used in the Game. One (1) promotional message will represent a $250,000 prize, the other 99 promotional messages will represent a $25,000 consolation prize. The Game winner will need to remove the promotional message from underneath the last remaining chair to see whether they have won the $250,000 prize or a consolation prize. If the Game winner finds the promotional message representing the $250,000 prize, then, subject to verification by the judges, the Game winner will be awarded $250,000 in the form of a cheque (made payable to the Game winner or the Draw winner they have played the Game for as a proxy). If the Game winner finds a promotional message representing a consolation prize of $25,000, then the $250,000 prize will not be given away and, subject to verification by the judges, the Game winner will be awarded $25,000 cash in the form of a cheque (made payable to the Game winner or the Draw winner they have played the Game for as a proxy). If a Draw winner cannot attend the Game they may appoint a proxy over 18 years of age to play the Game on his/her behalf provided that they give the Promoter written, signed notice to that effect at least 24 hours before the start of the Game. 31. In the event that one (1) or more of the Draw winners (or appointed proxies) do not present themselves to be registered as required in these Conditions of Entry, the Promoter will select replacement participant/s from spectators at the Game by conducting a simple game of skill where the Promoter will ask prospective participants why they should be included in the Game and those who provide the best answer/s will win the chance to play the Game. 32. NSW & ACT Draw winners will be responsible for making their own way to the Game location at their own expense in order to participate in the Game. 33. Flights and accommodation for Interstate Draw winners are subject to availability. Spending money, meals, taxes (excluding airline and airport taxes if applicable), insurance, transport to and from departure point, additional transfers and all other ancillary costs are not included. 34. The total maximum potential value of prizes to be won in the Game is up to $312,000. The minimum value of the prizes to be won in the Game is $87,000. NOTIFICATION OF WINNERS 36. The Draw winners will be: (a) notified in writing; and (b) advertised on www.fantasticmusicalchairs.com.au from 24/11/2014. RE-DRAW 37. If a Draw winner does not claim their chance to play the Game or is not contactable on the email address provided in their drawn Eligible Entry by 12 noon AEDT on 27/11/2014, a random electronic re-draw will be conducted on that date and time at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the Promotion, subject to any directions from the State and/or Territory Gaming Departments (Re-Draw). NOTIFICATION OF RE-DRAW WINNER/S (IF ANY) 38. The Re-Draw winner/s, if any, will be: (a) notified in writing; and (b) advertised on www.fantasticmusicalchairs.com.au from 28/11/2014. GENERAL 39. The total maximum potential value of all prizes available to be won in the Promotion is $322,000. All values stated in these Conditions of Entry are in Australian Dollars, represent the RRP and include GST. 40. Eligible Entrants may enter the Promotion once (1) only. 41. Prizes are not transferable or exchangeable. Prizes must be taken as offered and may not be varied. 42. The Promoter accepts no responsibility whatsoever for any variation in the value of the prize from the time of printing Promotion materials. 43. If the Promoter is unable to provide a winner with a nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize, subject to Page 5 of 6 any directions given by State and/or Territory Gaming Departments. 44. The Promoter accepts no responsibility whatsoever for any entries not received for any reason during the Promotion Period. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry, draw mechanism or Game in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion or the Game, or who does not properly comply with these Conditions of Entry, will be ineligible to win. 47. The: (a) Promoter, the Promoter's related entities, and all agencies associated with the Promotion; and (b) the employees, agents, directors and contractors, of all entities referred to in paragraph 47(a), shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of a prize or participation in the Game, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law). 48. The Promoter accepts no responsibility whatsoever for any tax liabilities that may arise from winning or receiving the benefit of a prize. 49. Prize winners must, at the Promoter's request, participate in any Promotion activity (such as publicity and photography) relating to the winning of a prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material. 50. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. PERSONAL INFORMATION 51. Immediately upon submission by an entrant, their entry/entries become the sole property of the Promoter. 52. All information entrants provide (Personal Information) will be used by the Promoter for the purpose of administering this Promotion and contacting and verifying the winners. 53. Should an entrant's Personal Information change during the Promotion Period, it is the entrant's responsibility to notify the Promoter by contacting the Promoter using the ‘Contact Us’ form on the Online Entry Site. 54. The Promoter may disclose entrants' Personal Information to its contractors and agents to assist in conducting this Promotion and as required, to Australian regulatory authorities. 55.
