In fact, a bucket of KFC is being given away every minute for the final two weeks of the KFC Big Bash League 2015-16. That's 60 Buckets every hour. 1440 Buckets every day. Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Twitter only. ELIGIBILITY 2. Entry is only open to Australian residents aged 15 years or older (Entrants). The directors, management and employees (and their immediate families, including their children and wards) of the Promoter, its related entities, corporations or franchisees, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 3. The promotion starts at 12:00AM (AEDT) on 11/01/2016 and ends at 11:59pm (AEDT) on 24/01/2016 (AEDT) (Promotional Period). 5. The Promotional Period will be divided into promotional minutes, which will commence and close every sixty (60) seconds over the entire duration of the Period (each, a Promotional Minute). HOW TO ENTER 6. To enter the promotion, Entrants must, during the Promotional Period: a. become a registered user of Twitter (Entrants who are already registered users of Twitter will not be required to complete this step). Entrants must ensure that their Twitter account is set to ‘public’ and that their location settings on their device are turned on; and b. tweet a photograph they have taken of a great tasting KFC meal or product on their personal Twitter page and include a friend or acquaintance’s (Mate’s) Twitter handle with the term #theHCG”. 7. Mates must be residents of Australia aged 15 years or older. Each Entrant warrants that the Mate identified in their tweet is known to them personally and that they have, before submitting their entry, obtained the consent of the Mate to include the Mate in their entry and submit that entry into the promotion. 8. Only one (1) entry per Twitter account per Promotional Minute permitted. Each entry must be submitted separately and must independently comply with these Conditions of Entry. Photographs of KFC meals or products must be unique for each entry. 9. Twitter membership, notifications, pages, applications and use of Twitter generally is subject to its prevailing terms and conditions of use at https://twitter.com/tos. The promotion is in no way sponsored, endorsed or administered by, or associated with Twitter. Entrants and Mates understand that they are providing their information to the Promoter and not to Twitter. Entrants and Mates are solely responsible and liable for any content or information they transmit to other 2 Internet users. To the extent permitted by law, each Entrant and Mate agrees to indemnify, defend and forever hold harmless, Twitter and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant or Mate in respect of the Entrant or Mate’s participation in the promotion respectively. Any questions, comments or complaints about the promotion must be directed to the Promoter and not to Twitter. 10. Entrants and Mates acknowledge that their personal Twitter page will be updated by entering the promotion and that the entries may be featured on the Promoter’s website, the Promotor’s Twitter page, their personal Twitter page and generally on Twitter for public viewing during the Promotional Period and in perpetuity (unless otherwise requested). Once an entry is submitted, Entrants acknowledge that the entry may not be withdrawn, altered or deleted (except as and where required by the Promoter). 11. Costs associated with accessing Twitter remain an Entrant and their Mate’s responsibility and may vary depending on the Internet service provider used. 12. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid. 13. Entries will be deemed accepted at the time they are published on Twitter. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Any details, including contact details, provided incorrectly by an Entrant or their Mate will deem their entry invalid. 14. An Entrant may, during the Promotional Period, be requested by the Promoter to resubmit their entry via Twitter if the Promoter considers the entry submitted to be ineligible to be accepted as a valid entry (Resubmitted Entry). The decision by the Promoter to request a Resubmitted Entry, or to accept or reject a Resubmitted Entry as a valid entry, is in the Promoter’s sole discretion and no correspondence will be entered into. If a Resubmitted Entry is accepted by the Promoter in its sole discretion as a valid entry, the Resubmitted Entry will be deemed to be the entry for the Entrant for the remainder of the promotion. If a Resubmitted Entry is rejected by the Promoter as an invalid entry, or is not received by the Promoter during the Promotional Period, the Entrant will not have gained an entry into the promotion. WINNER DETERMINATION 15. In order to determine the winners of the Instant Win Prizes (as set out in Condition 20), the entries will be sorted according to the State recorded in their entry as follows: QLD, NSW, VIC, SA, WA, TAS/NT/ACT, and for entries where a location has not been disclosed will be sorted into the group ‘Unspecified State’ (each, a State Group). 16. Each Promotional Minute will have its own random electronic draw at Ogilvy House, 72 Christie Street, St Leonards, 2065, whereby an approved electronic draw system will randomly determine the winning entry for that Promotional Minute, and the Mate stipulated in the winning entry will win the Instant Win Prize for that Promotional Minute (each, a Draw). Entries for each Promotional Minute must be received by the Promoter during the Promotional Minute to be eligible for the corresponding Draw. Entries received in a given Promotional Minute are only eligible for the corresponding Draw and will NOT rollover into any subsequent Draw (except where no entries have been received for a Promotional Minute, as per Condition 18). Each Draw will only select entries for a specific State Group. The order in which the State Groups will be selected for a Draw, commencing from the first Promotional Minute and repeating the process during the Promotional Period, is as follows: i. QLD; ii. Instant Win Prize winners will be notified via direct tweet by the promoter to the Mate specified in the winning entry (Winner). The Winners will be published on the Promoter’s Twitter page at @KFCAustralia within 16 hours of the corresponding Draw. Each Winner will be invited to contact the Promoter via the Promoter’s Twitter page to redeem their prize. In order to directly message the Promotor via Twitter, the Mate will be required to follow the Promotor’s Twitter page at @KFCAustralia. All reasonable attempts to notify the winners will be made by the Promoter. The Promoter’s decision is final and no correspondence will be entered into. 18. If no entries have been received for a Promotional Minute(s), the Promoter will conduct electronic draws at Ogilvy House, 72 Christie Street, St Leonards, 2065 in subsequent Promotional Minute(s) (as required) during the Promotional Period to randomly select an entry from all eligible entries received to date, to select a Winner. 19. This is a game of chance and winners will be determined at random and not by the use of any skill. PRIZES 20. Instant Win Prizes: Mates will be notified within 16 hours of the entry being submitted, by Tweet, if they are an instant winner, unless Condition 18 applies, in which case Mates will be notified within approximately 16 hours of the applicable electronic draw, by Tweet, if they are an instant winner. Instant winners will each win one (1) voucher for a HCG bucket of KFC (which includes eight (8) pieces of Original Recipe Chicken on the bone and two large chips) valued at up to AUD $19.95 (RRP) (each, an Instant Win Prize) each valid for 72 hours. There are 20,160 Instant Win Prizes to be awarded in this promotion (one per Promotional Minute). 21. An Instant Win Prize voucher is subject to its prevailing terms and conditions of use, including expiry dates, and is not replaceable if lost, stolen or damaged. Instant voucher must be presented and redeemed at participating KFC restaurants in Australia within the Promotional Period expiration date and within 72 hours of receipt of the voucher. 22. An Instant Win Prize cannot be sold, scalped, auctioned, raffled, pledged or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If an Instant Win Prize is obtained through any of these methods, it will not be honoured by the Promoter or prize supplier. 23. A Mate’s acceptance of an Instant Win Prize is deemed acceptance of these Conditions of Entry. GENERAL 24. Total maximum prize pool value is AUD $402,192.00. Prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). A prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize values. All prize values are the recommended retail price including GST where applicable. 25. The Promoter may draw one (1) additional reserve entry for every minute in case an invalid entry or ineligible Entrant is drawn or the Mate is ineligible to accept or declines to accept the prize. In the event of an invalid entry or an ineligible Entrant, or if the Mate is ineligible to accept or declines to accept the prize, the prize will be awarded to the additional reserve entry drawn. If after this process a prize has still not been awarded, or if an Entrant drawn cannot be notified, the prize will be subject to Condition 33. 26. Entrants can only enter using their own Twitter account. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) 4 in order to confirm the Entrant’s identity, age, eligibility to enter, and any information submitted by the Entrant in entering the promotion, before issuing a prize to their Mate. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid. 27. A Mate acknowledges that his or her opportunity to win a prize is dependent on the Entrant completing and submitting a valid entry that contains the Mate’s Twitter account and the Mate being deemed a winner. The Promoter is not responsible in any way for any incorrect details provided by an Entrant in their entry (including details about their Mate). 28. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant or Mate for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant or Mate is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. A prize will only be awarded following any winner validation and verification that the Promoter, or its nominated agents, requires in their sole absolute discretion. 29. The Promoter also reserves the right to disqualify a Mate, prohibit participation in an Instant Win Prize, or otherwise cease to provide an Instant Win Prize to the Mate if the Entrant or Mate act in a way, or cause material to be published, which the Promoter in its sole discretion deems to be inappropriate, aggressive, defamatory, offensive, or contrary to law, to diminish the good name or reputation of the Promoter, any of its related bodies corporate or its or their products, or otherwise is not in keeping with the spirit of the promotion. For the avoidance of doubt, a Mate can be disqualified after the Mate is notified that they have won an Instant Win Prize if the Entrant or Mate is found to have not acted in accordance with these Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 30. Without limiting any of the provisions of these Conditions of Entry, the Promoter requires that each Entry fully complies with these Conditions of Entry and must not include or make reference to the Intellectual Property Rights of any person including but not limited to any visible logos, drawings, cartoons, phrases, trade marks, copyrighted material, mark that identifies a brand or other third party materials (excluding the Promoter) unless the Entry is submitted with the written consent of the owner of the applicable Intellectual Property Rights. An Entry submitted without obtaining such written consent may result in the Entry becoming invalid for the purposes of the promotion and/or the Entrant being subject to legal liability. Any Entries that contain content that the Promoter, in its sole discretion, considers to be offensive, obscene, crude, inappropriate or objectionable in any way or to infringe any Intellectual Property Rights or other rights of any person, corporation or entity, will not be accepted as eligible Entries into the promotion and can be disqualified even after the Mate is notified that they have won an instant win prize. This includes, but is not limited to, any Entry which the Promoter considers to be disparaging to its products and/or services or is otherwise not in keeping with the spirit of the promotion. Participation in the promotion by an Entrant or Mate will not under any circumstances be taken to constitute a transfer, assignment or grant of any ownership rights in any promotional material or in any of the Promoter's brands, logos, trading names and products and/or services. The Promoter, on a case by case basis and to the extent required, grants to each Entrant and Mate a non-exclusive licence for the Promotional Period to use the promotional material and the Promoter's brands, logos, trading names and products and/or services solely for the purpose, and to the extent necessary, to enable each Entrant and each Mate to participate in the promotion. 32. Entrants are solely responsible and liable for their Entries and any other information they transmit to other Internet users. Twitter may delete or request the deletion of any content posted on Twitter in accordance with its prevailing terms and conditions of use. Any Entries that are removed by Twitter will not be considered eligible Entries for the purpose of the promotion. The Promoter is not responsible and excludes all liability (to the greatest extent allowable by law) for the content of any Entries submitted for the purposes of the promotion (including but not limited to any illegal, incorrect or inaccurate content or third party advertising). 33. Any unclaimed Instant Win Prize(s) at the conclusion of the Promotional Period will be forfeited. 34. If an Instant Win Prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation. 35. If this promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions made under applicable State or Territory legislation. 36. To the extent permitted by law, each Entrant and their Mate indemnifies (as applicable), and must defend and hold harmless, the Promoter and its employees, servants, agents and contractors, from and against all Losses arising from: (i) a breach by the Entrant and/or their Mate of any of these Conditions of Entry; (ii) any third party claim arising directly or indirectly from a breach by the Entrant and/or their Mate of any of these Conditions of Entry; (iii) a negligent, willful or otherwise wrongful act or omission of the Entrant and/or their Mate; (iv) fraudulent or dishonest acts or omissions by the Entrant and/or their Mate; (v) any breach by the Entrant and/or their Mate of any applicable Laws; (vi) any claim by any third party (including individuals, legal entities and governmental departments or agencies) arising directly or indirectly as a result of the Entrant entering the Promotion and/or their Mate redeeming a prize; (vii) the death of, or personal injury to, any person or any damage to, or loss or destruction of, any real or tangible personal property, to the extent caused by any act or omission of the Entrant and/or their Mate; and (viii) any claim or allegation that the Entrant's Entry infringes a third party's Intellectual Property Rights or constitutes an unlawful disclosure or misuse or misappropriation of another party's trade secret or confidential information. 37.
